HomeMy WebLinkAboutBy-law 4256/93 THE CORPORATION OF THE TOWN OF PICKERING 4256/93 BY-LAW NO. Being a by-law to assume Dahlia Crescent, Plan 40M-1529, Pickering, for public use as public highway under the jurisdiction of the Town. WHEREAS, Dahlia Crescent is a highway shown on a plan of subdivision and is therefore deemed, pursuant to the Surveys Act, R.S.O. 1990, Chap. S.30, s.57, to be public highway; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, Chap. M.45, s.262, 263, the Council of The Corporation of the Town of Picketing has jurisdiction over this highway (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipalities Act, R.S.O. 1990, Chap. R.8, s.23, to add this highway to the regional road system); and WHEREAS pursuant to the Municipal Act, s.262, the soil and freehold of this highway is therefore vested in The Corporation of the Town of Picketing; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The following highway is hereby assumed for public use as public highway under the jurisdiction of the Council of The Corporation of the Town of Picketing: Dahlia Crescent according to Plan 40M-1529, Town of Picketing, Regional Municipality of Durham. 2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles Act, R.S.O. 1990, Chap. L.5, s.152, to have the Corporation entered as the owner of the highway referred to in section 1. BY-LAW read a first, second and third time and finally passed this 21st day of June, 1993.
