HomeMy WebLinkAboutBy-law 4180/93 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 4180/93 Being a By-law to amend Restricted Area (Zoning) By-law 2520, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in Part of Lot 23, Range 3, being Part of Block Y, Plan M-16, in the Town of Pickering. (A 16/92) WHEREAS the Council of the Corporation of the Town of Picketing deems it desirable to permit the establishment of an apartment building containing up to 90 residential units on the subject lands in Part of Lot 23, Range 3, specifically being Part of Block Y, Plan M-16, in the Town of Pickering; AND WHEREAS an amendment to By-law 2520, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACIXS AS FOLLOWS: 1. SCHEDULE I Schedule I attached hereto with notations and references shown thereon is hereby declared to be part of this By-law. 2. AREA RESTRICTED The provisions of this By-law sha!l apply to those lands in Part of Lot 23, Range 3, designated "RHII-3" and "OS-HL-I' on Schedule I attached hereto, whether or not that designation is preceded by the (H) Holding symbol. 3. GENERAL PROVISION No building, land or part thereof shall hereafter be used, occupied, erected, moved or structurally altered except in conformity with the provisions of this By-law. 4. DEFINITIONS In this By-law, (1) (a) "Dwelling" shall mean a building or part of a building containing one or more dwelling units, but does not include a mobile home or trailer; (b) "Dwelline Unit" shall mean one or more habitable rooms occupied or capable of being o~cupied as a single, independent and separate housekeeping unit containing a separate kitchen and sanitary facilities; (c) "Avartment Dwelling" shall mean a dwelling containing four or more dwelling units attached horizontally or vertically, each unit having access from an internal corridor system connecting with at least one common entrance from outside the dwelling. 5. PROVISIONS (1) (a) Uses Permitted CRHII-3"Zone) No person shall within the lands designated "RHII-3" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure for any purpose except the following: (i) apartment dwelling residential uses -2- (2) (b) Zone Requirements ("RHII-Y Zone) No person shall within the lands designated "RHII-3" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure except in accordance with the following provisions: (i) NUMBER OF DWELLING UNITS (maximum): 90 (ii) BUILDING RESTRICTIONS: A No building, part of a building, structure, or part of a structure, including an underground parking structure, shall be ere,c, ted les,s, than 4.0 metres from the zone boundary line between the RHII-3 and "OS-HL-i" zone designations illustrated on Schedule I attached hereto; B Notwithstanding subsection 5.10 of By-law 2520, as amended, no building, part of a building, structure, or part of a structure, shall be erected that exceeds a maximum height of 24.0 metres having no more than seven storeys of habitable dwelling units. (iii) PARKING REQUIREMENTS: A For the purpose of this clause "parking space" shall mean a usable and accessible area of not less than 2.6 metres in width and not less than 5.3 metres in length for the temporary parking of vehicles, but shall not include any portion of a parking aisle or driveway; B Notwithstanding clause 5.21.1.1 of By-law 2520, as amended, there shall be provided and maintained on the lands a minimum of 1.0 parking spaces per dwelling unit for residents, and 0.2 parking space per dwelling unit for visitors. Not less than 65% of all required parking shall be provided below grade. Visitor parking shall be provided at grade or below grade, or both; C Notwithstanding subsection 2.2.1 of By-law 2520, as amended, underground parking aisles and ramps leading thereto shall have a minimum perpendicular width of 6.0 metres; D Clauses 5.21.2a), 5.21.2b), 5.21.2c), 5.21.2e), 5.21.2f), and 5.21.2i) of By-law 2520, as amended, shall not apply to lands designated "RHII-Y on Schedule I attached hereto; E Notwithstanding clauses 5.21.25) and 5.21.2k) of By-law 2520, as amended, all entrances and exits to parking areas and all parking areas shall be surfaced with brick, asphalt or concrete, or any combination thereof. (3) (a) Uses Permitted COS-HL-I" Zone) No person shall within the lands designated "OS-HL-I" on Schedule I attached hereto use any lot or erect, alter or use any building or structure for any purpose except the following: (i) preservation and conservation of the natural environment, soil and wildlife; and (ii) resource management. (b) Zone Requirements ("OS-HL" Zone) No buildings or structures shall be permitted to be erected, nor any existing buildings or structures be modified or changed, nor shall the placing or removal of fill be permitted, except where buildings or structures are used only for purposes of flood and erosion control, or resource management. -3- (3) Holding Provisions C(H)"Symbol) Prior to an amendment to remove the "H" Holding symbol preceding the zone category "RHII-Y', the following condition must be met: (a) an agreeme,n,t ,b, etween the Town of Picketing and the owner of the lands to which the '(H)' - Holding symbol applies, to provide for the development thereof in accordance with the provisions of this by-law, shall be entered into and registered on title to the lands, pursuant to the provisions of section 41 of the Planning Act, R.S.O. 1990, Chapter P. 13. 6. BY-LAW 2520 By-law 2520, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 2520, as amended. 7. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof, subject to the approval of the Ontario Municipal Board, if required. READ A FIRST AND SECOND TIME THIS DAY OF , 1993.
