HomeMy WebLinkAboutBy-law 5618/00THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5618/00 Being a By-law to amend Restricted Area (Zoning) By-law 2511, as amended by By-law 4444/94, to implement the Official Plan of the City of Pickering District Planning Area, Region of Durham in Part of Lot 18, Concession 1, in the City of Pickering. (A 33/99) WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 4444/94, amending Zoning By-law 2511, to permit the development of associated industrial and industrial-commercial uses on the subject lands, being Part of Lot 18, Concession 1, in the City of Pickering; AND WHEREAS the Council of the Corporation of the City of Picketing now deems it desirable to amend By-law 4444/94 to Zoning By-law 2511, to permit the development of an office building on the subject lands; AND WHEREAS an amendment to By-law 4444/94 to Zoning By-law 2511, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: TEXT AMENDMENTS (1) Section 4.(8) of amending By-law 4444/94 is hereby revoked and the following is substituted thereto: (8) "Gross Leasable Floor Area" shall mean the aggregate of the floor areas of all the storeys of a building or structure, or part thereof as the case may be, other than rooms or space jointly used by tenants of the building, such as garbage storage areas, mechanical and electrical rooms, lobbies, stairwells, elevators and service corridors; (2) Section 4. of amending By-law 4444/94 is hereby further amended by renumbering Subsections (1) to (21) and by adding thereto the following subsection: (7) "Gross Floor Area" shall mean the aggregate of the floor areas of all storeys of a building or structure, or part thereof as the case may be, but excluding basements. (3) Section 5.(2)(f) of said By-law is hereby revoked and the following is substituted thereto: (f) BUILDING HEIGHT (maximum): 16 metres (4) Section 5.(2)(g)(ii) of said By-law is hereby revoked and the following is substituted thereto: (ii) There shall be provided and maintained on the lands designated "MC-9" on Schedule 'T' attached hereto, a minimum of 4.0 parking spaces per 100 square metres of building gross leasable floor area. 2 (5) (6) Section 5.(2)(h)(i) of said By-law is hereby amended by removing all references to the term "business offices". Section 5.(2)(h) of said By-law is hereby amended by renumbering Subsections (i) to (v) and adding thereto the following subsection: (i) The aggregate gross floor area of all buildings on the lot shall not exceed 2300 square metres. BY-LAW By-law 2511, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law. Definitions and subject matters not specifically dealt with in this By-law shall be governed by relevant provisions of By-law 2511, as amended. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required. Brace Taylor, Clerk February 15, 2000 INTERDEPARTMENTAL CORRESPONDENCE PLANNING AND DEVELOPMENT DEPARTMENT TO: Bruce Taylor City Clerk FROM: Ron Taylor Planner 1 Draft Amending By-law for Zoning By-law Amendment Application A 33/99 Dalar Properties Limited South part of Lot 18, Concession 1 (East side of Brock Road, north of Bayly Street) Executive Committee, on February 14, 2000, recommended to Council the approval of Zoning By-law Amendment Application A 33/99, to permit the development of a three-storey office building on the subject property, and to amend some of the performance standards in the current zoning by-law to accommodate the office building use. All of the recommended conditions of approval will be satisfied through the provisions of the enclosed draft by-law. The enclosed draft by-law has been circulated to, and approved by, the applicant. Should Council adopt Executive Committee's recommendation for approval, then Council may consider the attached Implementing zoning by-law later in the meeting. A Statutory Public Meeting was held for this application on December 16, 1999. Please note that this by-law may be given all three readings at the February 21, 2000 Council Meeting, provided Council approves the above-noted application earlier that same meeting. The purpose and effect of this by-law is to permit a three-storey office building to be developed on the subject lands.
