HomeMy WebLinkAboutBy-law 5603/99THE TOWN OF PICKERING BY-LAW NO. 5603/99 Being a by-law to exempt Lots 1 to 14, inclusive, Plan 40M- 1918, Pickering, from part lot control. WHEREAS pursuant to the provisions of section 50 of the Planning Act, R.S.O. 1990, chapter P. 13, the council of the municipality may by by-law provide that section 50(5) of the Act does not apply to certain lands within a plan of subdivision designated in the by-law; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: Section 50(5) of the Planning Act, R.S.O. 1990, chapter P.13, does not apply to the lands described as follows: Lots 1 to 14, inclusive, Plan 40M-1918, Pickering. This by-law shall remain in force and effect for a period of one year from the date of the passing of this by-law and shall expire on December 20, 2000. BY-LAW read a first, second and third time and finally passed this 20th day of December, 1999. Raponi - Lots 1 to 14, Plan 40M-1918 - File: P4101.192 The above-mentioned lands are being developed in accordance with the appropriate Subdivision Agreement and Zoning By-Law in such a manner to permit the realignment of lot lines within the Plan. Attached hereto is a location map and a draft by-law, enactment of which will exempt these lands from the part lot control provisions of the Planning Act, thus permitting such realignment. It should be noted that on July 20, 1999, Council enacted By-law 5534/99 exempting the above-noted lands from the part lot control provisions of the Planning Act for the same purpose as set out herein. The developer for this project has been unable to complete the project within the time limit set out in By-law 5534/99 due to extenuating circumstances and is requesting that another part lot control by-law be enacted. This by- law is in the form usually used in such cases and is attached for the consideration of Town Council at its meeting scheduled for December 20, 1999.
