HomeMy WebLinkAboutBy-law 5537/99THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 5 5 3 7/9 9 Being a By-law to amend Zoning By-law 4366/93, which amended Zoning By-law 3036, which was also amended by By-law 2822/88, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham in Block 69, Plan 40M-1700 and Part of Lot 33, Concession 1, in the Town of Picketing. (A 10/97) WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit additional residential units and provide for a minimum amount of retail commercial space (rather than the current maximum) on the easterly portion of the subject property, being Block 69, Plan 40M-1700 and Part of Lot 33, Concession 1, in the Town of Picketing; AND WHEREAS amendment of By-law 4366/93 is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: TEXT AMENDMENTS Section 5. PROVISIONS is hereby amended, as follows: (1) Subsection (2)(a) Zone Requirements CLCA-6" Zone) NUMBER OF DWELLING UNITS is repealed and replaced with the following: (a) NUMBER OF DWELLING UNITS: No less than 50 and no more than 138 dwelling units shall be permitted. (2) Subsections (2)(b)B, D and E Zone Requirements CLCA-6" Zone) BUILDING RESTRICTIONS are repealed and replaced with the following: B No building, part of a building, or structure that exceeds a height of 12.0 metres shall be erected, except that (i) in the area cross-hatched on Schedule I attached to this By-law, the minimum building height shall be 12.0 metres, and the maximum building height shall be 18.0 metres; and (ii) in the area hatched on Schedule I attached to this By-law, the minimum building height shall be 9.0 metres, and the maximum building height shall be 18.0 metres; D The aggregate of the gross leasable floor areas of all buildings on the lands, except multiple dwellings - horizontal and multiple dwellings - vertical, shall be a minimum of 940 square metres; E Notwithstanding Section 5.7 of By-law 3036, as amended, and clause 5(2)(b)A above, bay windows, balconies, decks, and porches, whether covered or uncovered, shall be permitted to project a maximum of 1.5 metres beyond the limits of the building envelope illustrated on Schedule I attached hereto, except for where the building envelope is immediately abutting the Altona Road frontage; (3) (4) Subsection (3) Uses Permitted COS-A" Zone) is amended by adding the following after (d): (e) a maximum of 15 parking spaces; Subsection (4)(a)A and C Zone Requirements ("OS-A" Zone) SPECIAL REGULATIONS: are repealed and replaced as follows: A No buildings or structures shall be erected, nor any existing buildings or structures be enlarged, modified or changed, nor shall fill be placed or removed except for the purposes of flood and erosion control, resource management, landscape open space, or parking areas; C For the purpose of this clause, "outdoor patio" shall mean an uncovered outdoor eating area not exceeding 150 square metres in area, which occurs in conjunction with any restaurant use permitted under the "LCA-6" zone, where seating accommodation is provided, and where meals and refreshments are served. SCHEDULE AMENDMENT Schedule I of By-law 4366/93 is hereby repealed and replaced by Schedule I attached to this By-law. BY-LAW 3036 (1) By-law 2822/88 is hereby repealed. (2) By-law 3036, as amended by By-law 4366/93, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
