Being a By-law to adopt Amendment Number 3 to the Official Plan for the Town of Picketing (OPA 97-006/P) WHEREAS pursuant to the Planning Act, R.S.O. 1990, c.p. 13, subsections 17(22) and 21(1), the Council of the Corporation of the Town of Picketing may by by-law adopt amendments to the Official Plan for the Town of Picketing, and submit them to the Region of Durham for approval. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: Amendment Number 3 to the Town of Picketing Official Plan, attached to this By-law as Exhibit "A", including the Explanatory Text, is hereby adopted. Amendment Number 3 to the Picketing Official Plan shall not come into effect until the related Regional Official Plan Amendment (OPA 97-023/D) is approved and has taken effect. The Clerk of the Town of Picketing is hereby authorized and directed to submit Amendment Number 3 to the Picketing Official Plan to the Region of Durham for approval. 4. Taylor, Clerk · Exhibit "A" to By-law 5 5 0 4/ -99 AMENDMENT NUMBER 3 TO THE TOWN OF PICKERING OFFICIAL PLAN AMENDMENT NUMBER 3 TO THE PICKERING OFFICIAL PLAN PURPOSE: The purpose of this amendment is to redesignate a portion of the subject lands from"Agricultural Areas" and "Open Space System - Natural Areas" to "Open Space System - Active Recreational Areas" in order to permit the establishment of a golf course with a maximum of 18-holes, including a clubhouse, maintenance building, and other ancillary buildings. LOCATION: The subject lands have a total area of approximately 79 hectares, of which approximately 76 hectares are being redesignated for golf course purposes. The subject lands are located in Part of Lots 1 and 2, Concession 7, in the Town of Picketing. The lands have frontage on Lake Ridge Road, Seventh Concession Road, and Sideline 2. BASIS: ACTUAL AMENDMENT: The amendment has been determined to be appropriate for the following reasons: · it will provide the opportunity of development of a golf course that has been determined to be an overall benefit for the community; · it is not contrary to the rural goals, objectives, purpose and intent of the Picketing Official Plan; and · it has been demonstrated to the Town's satisfaction that the proposed use will not significantly adversely affect the amount or quality of Class 1 to 3 agricultural lands; is located and will be operated in compliance with minimum separation distance formulae; cannot be accommodated on less significant agricultural lands; will not .adversely affect the quality or function of natural features, and resources, including groundwater; and is environmentally appropriate in terms of its water usage and sewage disposal. In addition, the related application to amend the Regional Official Plan has also been determined by the Town to be appropriate and comments in support of the required Regional Amendment are being forwarded to the Region with the Amendment. The Town of Picketing Official Plan is hereby amended by: Revising Schedule I - Land Use Structure, as set out on Exhibit "1" attached. IMPLEMENTATION: The provisions set forth in the Town of Pickering Official Plan, as amended, regarding the implementation of the Plan shall apply with regard to this Amendment.
