HomeMy WebLinkAboutBy-law 4539/94 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 4 5 39 / 9 4 Being a By-law to amend Restricted Area (Zoning) Byqaw 3036, as amended to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham in Part of Lot 24, Concession 1, in the Town of Picketing. (A 15/94) WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 2836/88, amending By-law 3036, as amended, to permit the establishment of special purpose commercial uses on the subject lands, being Part of Lot 24, Concession 1, in the Town of Pickering; AND WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 3891/91 permitting an audio home entertainment store, a golf sports store, and a video store as temporary uses on the subject lands, being Part of Lot 24, Concession 1, in the Town of Pickering, during the period between December 16, 1991 and December 15, 1994; AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it desirable to permit retail and personal service uses, as well as, an audio home entertainment store, a golf sports store, and a video store as temporary uses on the subject lands, being part of Lot 24, Concession 1, in the Town of Picketing; AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. ~ Schedule I attached hereto with notations and references shown thereon is hereby declared to be parl of this By-law. 2. ~ The provisions of this By-law shall apply to those lands in part of Lot 24, Concession 1, designated "SC-25(TC-l)" on Schedule I attached hereto. 3. GENERAL PROVISION No building, land or part thereof shall hereafter be used, occupied, erected, moved or structurally altered except in conformity with the provisions of this By-law. 4. ~ In this By-law, (1) "Audio Home Entertainment Store" shall mean a building or part of a building in which home audio equipment, video cassette recorders, and televisions and accessories thereto are stored, displayed and offered for retail sale to the public; (2) ~ shall mean a building or part of a building in which golfing equipment and accessories thereto, including golf clothing and golf shoes are stored, displayed and offered for retail sale to the public; (3) "Personal Service Shop" shall mean an establishment in which a personal service is performed and which may include a barber shop, a beauty salon, a shoe repair shop, a tailor or dressmaking shop or a photographic studio, but shall not include a body-mb parlour as defined in the Municipal Act, R.S.O. 1990, Chapter M.45, as amended from time-to-time, or any successor thereto; -2- (4) ~ shall mean a building or part of a building in which goods, wares, merchandise, substances, articles or things are stored, kept and offered for retail sale to the public; (5) ~ shall mean a building or part of a building in which video cassette recorders and tapes and accessories thereto are stored, serviced, displayed and offered for rent or retail sale to the public for use off the premises only. 5. TEMPORARY USES PERMITTED ("SC-25(TC-I]" ZONE) (1) Subject to the provisions of subsection (2) of this section, during the period from December 19, 1994 to December 18, 1997, both inclusive, the lands designated "SC-25(TC-1)" on Schedule I attached hereto, and any building, part of a building, or structure thereon, may be used for the following uses, in addition to the uses permitted by clause 5(1)(a) of By-law 2836/88: (a) audio home entertainment store (b) golf sports store (c) personal service shop (d) retail store (e) video store (2) No person shall within the lands designated "SC-25(TC-1)' on Schedule I attached hereto, use any lot or erect, alter or use any building, pan ora building, or structure except in accordance with the following provision: (a) The gross leasable floor area of any use permitted by subsection 5.(1) of this By-law shall not exceed 750 square metres. By-law 3036, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3036, as amended. This By-law shall take effect from the day of passing hereof, subject to the approval of the Ontario Municipal Board, if required. READ A FIRST AND SECOND TIME THIS 19'ch DAY OF December 1994. The Notice for By-law 4539/94 (A 15/94) of the Corporation of the Town of Picketing, passed by the Council of the Corporation on the 19th day of December, 1994 was given pursuant to Section 34.17 of the Planning Act, 1983. 2. The last day for filing with the Clerk a notice of appeal setting out an objection to the by- law expired on the 10th day of January, 1995. 3. To this date, no notice of appeal setting out an objection to the by-law has been filed by any person in the office of the Clerk.
