HomeMy WebLinkAboutBy-law 4535/94 THE CORPORATION OF THE TOWN OF PICKERING BY-LAWNO. 4535 /94 Being a by-law to stop up and close as public highway that part of the Road Allowance between Concession 1, Pickering, and Range 3, Broken Front Concession, Pickering, designated as Parts 11, 12 and 13, Plan 40R- 1090, and to authorize its sale to The Regional Municipality of Durham, the abutting owner. WHEREAS, on November 21, 1994, pursuant to subsection 191(1) of the Municipal Act, R.S.O. 1990, chapter M.45, and By-law 4532/94 enacted thereunder, The Corporation of the Town of Picketing (the "Town") acquired that part of the Road Allowance between Concession 1, Picketing, and Range 3, Broken Front Concession, Picketing, designated as Parts 11, 12 and 13, Plan 40R-1090, for the purpose of enabling the Council of the Town to exercise its jurisdiction to stop up those lands as public highway; and WHEREAS, pursuant to section 263 of that Act, the Council of the Town has jurisdiction over that part of that Road Allowance, such jurisdiction not having been conferred upon another council; and WHEREAS, pursuant to subsection 262(1) of that Act, the soil and freehold of that part of that Road Allowance is vested in the Town, the Council of which has jurisdiction over it; and WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(1)(d) and 315 of that Act, the Council of the Town may pass by-laws to stop up a highway or part thereof and to authorize its sale to the abutting owner at a fixed price; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. That part of the Road Allowance between Concession I, Picketing, and Range 3, Broken Front Concession, Picketing, designated as Parts 11, 12 and 13, Plan 40R-I090, is hereby stopped up as public highway. 2. That part of the Road Allowance between Concession I, Pickering, and Range 3, Broken Front Concession, Picketing, designated as Parts 11, 12 and 13, Plan 40R-1090, shall be offered for sale to The Regional Municipality of Durham, being the abutting owner, at a sale price of $2.00, subject to any existing utility easement or easements. 3. The Mayor and Clerk are hereby authorized to execute any documents approved by the Town Solicitor and required to effect the stopping up, offer, sale and transfer provided for in sections 1 and 2 of this By-law.
