HomeMy WebLinkAboutBy-law 4530/94 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 4530/94 Being a by-law to authorize the execution of Releases of a Development Agreement between the Town and Jeremiah Francis Coughlan and J.F. Coughlan Construction Co. Limited, In Trust and a Site Plan Agreement between Town and Jeremiah Francis Coughlan respecting part of Lot 19, Concession 1, Pickering (Parts 4 and 5, 40R- 15638). WHEREAS, it is necessary to remove from title a cloud respecting certain lands within a Development Agreement between the Town of Pickering and Jeremiah Francis Coughlan and J.F. Coughlan Construction Co. Limited, In Trust and certain lands within a Site Plan Agreement between the Town and Jeremiah Francis Coughlan; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule A, of a Development Agreement dated April 21, 1992 and registered June 29, 1994 as Instrument Number LT685242, between The Corporation of the Town of Pickering and Jeremiah Francis Coughlan/J.F. Coughlan Construction Co. Limited, In Trust, insofar as it relates to Parts 4 and 5 on Plan 40R-15638. 2. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule B, of a Site Plan Agreement dated November 23, 1993 and registered November 26, 1993 as Instrument Number LT661789, between The Corporation of the Town of Picketing and Jeremiah Francis Coughlan, insofar as it relates to Parts 4 and 5 on Plan 40R-15638. BY-LAW read a first, second and third time and finally passed this 21st day of November, 1994. ...... ~Bruce Taylor, Clerk Schedule A RELEASE In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING hereby releases and forever discharges JEREMIAH FRANCIS COUGHLAN and J.F. COUGHLAN CONSTRUCTION CO. LIMITED. IN TRUST their heirs, executors, administrators, successors and assigns, of and from all claims, demands, damages, actions or causes of action which may have arisen, are arising, or may arise as a result of or in any way related to a Development Agreement registered as Instrument No. LT685242 on June 29, 1994, between THE CORPORATION OF THE TOWN OF PICKERING and JEREMIAH FRANCIS COUGHLAN and J.F. COUGHLAN CONSTRUCTION CO. L1MITED. IN TRUST insofar as it relates to those parts of Lot 19, Concession 1, Picketing, designated as Parts 4 and 5, 40R-15638. IN WITNESS WHEREOF The Corporation of the Town of Picketing has hereunto affixed its corporate seal attested by its properly authorized officers this 21st day of November, 1994.
