HomeMy WebLinkAboutBy-law 4466/94 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 4466/94 Being a By-law to adopt Amendment Number 86 to the District Plan for the Town of Picketing (OPA 93-005/P WHEREAS pursuant to the Planning Act, R.S.O. 1990, chapter P.13, Subsections 17(6) and 21(1), the Council of the Corporation of the Town of Picketing may by by-law adopt amendments to the District Plan for the Town of Picketing, being an official plan, and submit them to the Minister of Municipal Affairs for approval. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. Amendment Number 86 to the District Plan for the Town of Pickering, attached hereto as Exhibit "A" and including the Explanatory Text, is hereby adopted. 2. The Clerk of the Town of Picketing is hereby authorized and directed to submit Amendment Number 86 to the District Plan for the Town of Pickering to the Ministry of Municipal Affairs for approval. 3. Exhibit "A" to By-law 4466 /94 AMENDMENT NO. 86 TO THE TOWN OF PICKERING DISTRiCT PLAN (Liverpool Community Plan) AMENDMENT NO. 86 TO THE PICKERING DISTRICT PLAN (Liverpool Community Plan) PURPOSE: The purpose of this amendment is to permit the establishment of a greater mix and intensity of uses in Special Design Precinct No. 5 by increasing the limitation on retail uses, removing the limitation on personal service uses, and adding community uses to the currently permitted professional office/personal service/commercial and low density residential uses. LOCATION: The subject lands are located along the north side of Kingston Road between Glengrove Road and Valley Farm Road, in the Town of Picketing. BASIS: The amendment has been determined to be appropriate as it will provide the opportunity for an increased mix and intensity of uses on the subject lands by adding the opportunity for further retail, personal service, commercial and community uses to be established in the precinct, without adversely impacting the Main Central Area. ACTUAL The Town of Picketing District Plan {,Liverpool Community AMENDMENT: Plan - Planning Community Number 3) is hereby amended by: Deleting, in its entirety, Subsection 5.B(e) (Land Use Guidelines for Special Design Precinct No. 5), and replacing it with the following: (e) Precinct No. 5 is suitable for mixed uses. These uses may be Low Density II housing, business offices principally devoted to professional uses, commercial uses (including retail and personal service uses), and community uses, subject to the following limitations: (i) the maximum gross leasable floor area for all retail store uses shall be approximately 2,500 square metres; and (ii) the maximum gross leasable floor area for the retail/office/commercial/community component shall be approximately 4,000 square metres. IMPLEMENTATION: The provisions set forth in the Town of Pickering District Plan, as amended, regarding the implementation of the Plan shall apply with regard to this Amendment. -2- INTERPRETATION: The provisions set forth in the Town of Pickering District Plan, as amended, regarding the interpretation of the Plan shall apply with regard to this Amendment.
