HomeMy WebLinkAboutBy-law 4889/96 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 4889/96 Being a by-law to authorize the sale of those lands being part of Water Lots 1, 2, 3, 4, 5, 6 and 7, Plan 65, Pickering, to the Metropolitan Toronto and Region Conservation Authority. WHEREAS Section 193(1) of the Municipal Act, R.S.O. 1990 c. M45 authorizes the Corporation of the Town of Pickering to dispose of lands surplus to the needs of the Corporation; AND WHEREAS The Corporation of the Town of Pickering wishes to dispose of certain lands to the Metropolitan Toronto and Regional Conservation Authority; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The portion of the lands abutting the shoreline of Frenchman's Bay and described as part of Water Lots 1, 2, 3, 4, 5, 6 and 7 Plan 65, Pickering, being designated as Parts XXX on Plan 40R- XXXXX are hereby declared surplus to the needs of the Corporation. 2. Provided that the Town of Pickering completes its purchase of those lands designated as Water Lots 1, 2, 4, 5, 6, 7 and part of Water Lot 3, Plan 65, Picketing, from James McKean and from Price Waterhouse Limited, Trustees in Bankruptcy of Keen Kraft Marina Co. Limited, on or before December 24, 1996, then the Mayor and the Clerk shall be authorized to enter into an agreement to sell parts of Water Lots 1, 2, 3, 4, 5, 6, and 7, Plan 65, Pickering, designated as Parts XXX on Plan 40R-XXXXX to the Metropolitan Toronto and Regional Conservation Authority for the sum of $250,000. 3. The Corporation of the Town of Pickering shall pay one half of the cost of the preparation and registration of a plan of survey to be registered on title to the subject lands prior to January 31, 1997. 4. The Corporation of the Town of Pickering shall be authorized to reserve easements over the lands designated as Parts XXX, on Plan 40R-XXXXX. 5. The Corporation of the Town of Picketing shall be authorized to grant a right of first refusal in favour of the Metropolitan Toronto and Regional Conservation Authority over the lands being part of Water Lots 1, 2, 3, 4, 5, 6, and 7, Plan 65, being designated as Parts XXX, on Plan 40R- XXXXX.
