HomeMy WebLinkAboutBy-law 4826/96 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 4 8 26/9 6 Being a By-law to amend Restricted Area (Zoning) By-law 2520, as amended, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham, in Lot 71, Plan M-14, in the Town of Pickering. (A 18/95) WHEREAS the Council of the Corporation of the Town of Picketing deems it desirable to permit the development of a detached dwelling or a personal service shop on the subject land; AND WHEREAS an amendment to By-law 2520, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. SCHEDULE AMENDMENT Schedule "A" to By-law 2520, as amended, is hereby further amended by altering, from "RMI" to "RM1/PS", the zone designation of the land shown on Schedule I attached hereto. Schedule I attached hereto with notations and references shown thereon is hereby declared to be part of this By-law. SECTION 8 - MULTIPLE FAMILY DWELLING FIRST DENSITY ZONE "RMI", as amended, is hereby further amended by adding the following subsection: 8.6 LOT 71, PLAN M-14 (1) Notwithstanding any provision of this By-law, the land zoned "RM1/PS" on Schedule I to By-law ~826 /96 may be used exclusively for the purposes of either a detached dwelling or a personal service shop; (2) A detached dwelling shall be subject to the provisions of Section 7.2; (3) A personal service shop use shall be subject to the following provisions: (a) There shall be provided and maintained on the lot a minimum of 5 parking spaces for customers; (b) For the purpose of this Subsection, "parking space" shall mean a usable and accessible area of not less than 2.6 metres in width and not less than 5.3 metres in length for the temporary parking of vehicles; (c) Parking spaces shall be setback a minimum of 1.0 metre from the front property line; 1.5 metres from the northern (side) lot line; and 2.0 metres from the southern (tankage side) lot line; and (d) All of the required customer parking may be located in the front yard; (4) For the purpose of this Subsection, "Personal Service Shop" shall mean an establishment in which a personal service is performed, which may include a barber shop, beauty salon, tanning salon, nail salon, shoe repair shop, tailor or dressmaking shop, photographic studio, or similar use, but shall not include a body-mb parlour as defined in Section 224 (9)(b) of the Mtmicipal Act, RSO 1990, Chapter M.45, as amended from time to time, or any successor thereto. -2- By-law 2520, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by relevant provisions of By-law 2520, as amended. This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required. READ A FIRST AND SECOND TIME THIS 6th DAY OF August ,1996.
