HomeMy WebLinkAboutBy-law 4777/96 THE CORPORATION OF THE TOWN OF PICKER/NG BY-LAW NO. 4777/96 Being a by-law to authorize the execution of an Agreement incorporating an option to acquire certain lands for future road and walkway purposes (Part of Lot 24, Concession 1, Pickering, designated as Parts XX on Plan 40R-XXXX; Walnut Grove Plaza Inc.). WHEREAS, Walnut Grove Plaza Inc. has made an application to The Corporation of the Town of Pickering under section 34 of the Planning Act, R.S.O. 1990, chapter P. 13 to permit certain additional uses on lands comprising part of Lot 24, Concession 1, Pickering; WHEREAS, Walnut Grove Plaza Inc. has agreed to enter into an Agreement which will grant an option to The Corporation of the Town of Pickering to purchase, at a nominal fee, certain lands for roadway purposes; and WHEREAS, the Agreement will also grant an option to The Corporation of the Town of Pickering to purchase, at a nominal fee, certain lands for walkway purposes and will require Walnut Grove Plaza Inc. to contribute financially to the construction thereof upon request by the Town; WHEREAS, pursuant to the provision of the Municipal Act, R.S.O. 1990, chapter M.45, section 191, the Council of The Corporation of the Town of Pickering may pass by-laws for acquiring any land or interest therein for the purposes of the Corporation; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute an Agreement in a form acceptable to the Town Solicitor which includes an option for the Town to purchase certain lands set out as those parts of Lot 24, Concession 1, Pickering, designated as Parts XX on Plan 40R-XXXX, for a nominal fee, for roadway and walkway purposes and which Option Agreement will require Walnut Grove Plaza Inc. to contribute financially to the construction of the walkway upon request by the Town.
