BY-LAW NO. 4768/96
Being a by-law to authorize the execution of a Transfer of
Easement from The Corporation of the Town of Pickering
to Kathleen Margaret Schmitz-Hertzberg over Block 50,
Plan 40M-1627, Picketing.
WHEREAS, pursuant to the provisions of section 191(1) of the Municipal Act, R.S.O. 1990, Chap.
M.45, the Council of The Corporation of the Town of Pickering may pass by-laws for disposing of
interests in lands owned by it; and
WHEREAS The Corporation of the Town of Pickering wishes to transfer an easement over Block 50,
Plan 40M-1627, Pickering to allow the abutting owner of Part 2, Plan 40R-9794 to utilize Block 50 for
the purpose of installing and maintaining certain services and utilities;
WHEREAS The Corporation of the Town of Pickering is willing to grant the abutting owner an
easement over Block 50, Plan 40M-1627, Pickering subject to certain terms and conditions;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of Easement, in the form
attached hereto as Schedule A, from The Corporation of the Town of Pickering to Kathleen
Margaret Schmitz-Hertzberg.
2. The Council of The Corporation of the Town of Pickering agrees to transfer an easement over
Block 50, Plan 40M-1627, Pickering to Kathleen Margaret Sctunitz-Hertzberg for the purpose of
installing and maintaining certain services and utilities which transfer shall be subject to the
terms and conditions, more particularly set out in the Easement Agreement attached hereto as
Schedule B.
BY-LAW read a first, second and third time and finally passed this 6th day of May, 1996.
