HomeMy WebLinkAboutBy-law 5392/98THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 5392/98 Being a by-law to adopt the estimates of all sums required to be raised by taxation for the year 1998 and to establish the Tax Rates necessary to raise such sums. WHEREAS it is necessary for the Council of The Corporation of the Town of Picketing, pursuant to the Municipal Act, R.S.O. 1990, ch.M.45, as amended, to pass a by-law to levy a separate tax rate on the assessment in each property class. WHEREAS the property classes have been prescribed by the Minister of Finance under the Assessment Act, R.S.O. 1990, ch.A.31, as amended and its Regulations. WHEREAS it is necessary for the Council of The Corporation of the Town of Pickering, pursuant to the Municipal Act, to levy on the whole rateable property according to the last revised assessment roll for The Corporation of the Town of Picketing, the sums set forth for various purposes in Schedule "A", for the current year. WHEREAS the Regional Municipality of Durham has passed a By-law (No. 72-98) to adopt estimates of all sums required by The Regional Municipality of Durham for the purposes of the Regional Corporation and a By-law (No. 69-98) to provide a levy and set rates on Area Municipalities. WHEREAS the Regional Municipality of Durham has passed a By-law (No. 70-98) to direct the Council of the Town of Picketing to levy specified tax rates on the assessment for school purposes. WHEREAS the Regional Municipality of Durham has passed a By-law (No. 71-98) to direct the Council of the Town of Picketing to phase-in 1998 Assessment-Related Increases or Decreases for the Residential Property Class, to be determined in accordance with Section 372(1) of the Municipal Act, as amended. WHEREAS an interim levy was made by the Council of The Corporation of the Town of Pickering (pursuant to By-law No. 5183/97) before the adoption of the estimates for the current year. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: For the year 1998, The Corporation of the Town of Picketing (the "Town") shall levy upon the Property Classes set out in Schedule "A", the rates of taxation as set out in Schedule "A", for the Town of Picketing, the Region of Durham and for Education purposes on the current value assessment as also set out in Schedule The estimates for the current year are as set forth in Schedule "A" and amount to $103,403,421, which estimates were made up as follows: Town of Picketing General Purposes Regional Municipality of Durham Purposes Education Total - General - Waste $ 21,092,429 $ 41,470,606 $ 2,344,001 $ 38,496,385 $103,403,421 o o o The levy provided for in Schedule "A" shall be reduced by the amount of the interim levy for 1998. The first and second instalments of the final tax billing shall be October 30th, 1998 and November 30th, 1998 respectively. If any section or portion of this By-law or of Schedule "A" is found by a court of competent jurisdiction to be invalid, it is the intent of Council for The Corporation of the Town of Pickering that all remaining sections and portions of this By-law and of Schedules "A" continue in force and effect. This By-law comes into force on the date of its final passing.
