HomeMy WebLinkAboutBy-law 5216/98THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 5216/98 Being a by-law to authorize the execution ora Development Agreement and related documentation respecting the development of a turning circle at the south end of part of the Road Allowance between Lots 30 and 31, Range 3, B.F.C., Pickering, designated as Parts 6, Plan 40R-XXXXX [Yorkville Sound]. WHEREAS Yorkville Sound is desirous of purchasing a portion of the road allowance known as Parts 4 and 5, Plan 40R-XXXX; AND WHEREAS, the Council of The Corporation of the Town of Pickering passed a by-law to stop-up and close that part of the Road Allowance between Lots 30 and 31, Range 3, B.F.C, Pickering, designated as Parts 4 and 5, Plan 40R-XXXXX (Rosebank Road) for the purposes of selling to Yorkville Sound; and AND WHEREAS, one of the conditions imposed by the Town was that, prior to the finalization of this transaction, Yorkville Sound enter into a Development Agreement with the Town to provide for the construction of a turning circle at the south end of the closed road allowance; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. (a) (b) The Mayor and Clerk are hereby authorized to execute a financially secured Development Agreement prepared in a form satisfactory to the Town Solicitor, between Yorkville Sound and The Corporation of the Town of Pickering, respecting the development of a turning circle at the south end of the closed Road Allowance between Lots 30 and 31, Range 3, B.F.C, Pickering, designated as Part 6, Plan 40R-XXXXX. The Corporation of the Town of Pickering shall acquire those lands or interests in the lands identified in Schedule A of the Development Agreement subject to the terms and conditions and for the purposes set out therein.
