the Council of the Corporation of the Town of Pickering hereby resolves to conduct a
meeting closed to the public for the purpose of considering a matter of possible li.:gation

That Allan D, Weiss of the firm :>fKronis, Rotsztain, Margles, Cappel & Gertler,
Barristers and Solicitors, are hereby authorized to commence legal action against Novacor
Construction Ltd to recover all losses incurred by the Town of Pickering ûom the
overpayment of the sum of$517,093.88 to Novacor under the Fairport Road
Reconstruction Project Contract (No. T-14-04); and
That funding for the retention of this finD be paid ûom Account 2126-2392 (General
Government Purchased Services - Consultative and Professional),

That the Town of Pickering offers to purchase from McKean and Price Waterhouse
Limited lands being Water Lots 1,2,4, 5, 6 and 7 and Part of Water Lot 3, Plan 65,
Pickering, at a price not to exceed $1,150,000.00 conditicnal upon the Metropolitan
Toronto and Region Conservation Authority confinning approval by the Province of
Ontario of its funding to the extent of$250,OOO prior to closing, failing which the
purchase price would be $900,000; and
That tOO final date for closing shall be December 20, 1996.

WHEREAS at its regular monthly meeting held on May 30, 1996, the Pickering Public
Library Board passed the following motion:
The Chairman (oJ the Library Board] advise Council oJ the Board's
interest in pursuing the examination oj the Steeple Hill Church property,
with a view to its acquisition (as the new western branch], contingent on
its suitability Jor library service,
NOW THEREFORE BE IT RESOLVED THAT:
1.
Town staff, in conjunction with Library statt: shall talce whatever steps are
nec;essary to determine the suitability of the Steeple Hill Church property as a
how')' branch and multi-purpose facility, including determining the cost of any
required retrofitting,
2,
TdC Town Solicitor shall obtain an appraisal of the Steeple Hill Church property.

3.
The Town Manager, in conjunction with Library staff, shall begin negotiations with
the owners of the steeple Hill Church property with a view to acquiring it for a
new western branch horary.
