PRESENT: J. Sherman Scott, in the Chair Mrs. J. McPherson Harvey Spang Milton J. Mowbray Wm. J. Greening Ross W. Deakin Hubert Wank L. T. Johnston. Clerk The following CORRESPONDENCE was considered: 1. La France Fire Engines claim error in tender and want it reduced $705.40. 2. Our Solicitors submit a by-law and agreement re Township sale ~f ten acres to Hydro-Electric Power Commission. See By-Law No. 2817. 3. Clerk of Markham Township asks Pickering Township to share cost of automatic signal protection at Canadian Pacific Railway on our Town Line. Road Committee cònsider. 4. Our SOlicitors' fees for Kay Mandamus is $529.25. and $418.20 is to be paid us by the Kays. They ask if the Kay money should come to the Township or be applied on their account. AGREED Township pay our Solicitors' fee. 5. Township of Chingacousy asks Council to endorse their resolution to ask the Minister to amend Planning Act so that Planning Boards could control parcels of land up to 25 acres instead of 10 acres. Tab led. 6~ Mr. Frank ~canga of Lot 75, Plan 377. got a building permit for a barber shop on front of his house on east side Harwood Avenue when Mr. Prouse on holidays. The verandah has been removed and shop started. Set-back same as store to south. New zoning by-law requires 40' setback. See Letter of Tolerance. 7. Department of Economics and Development submits a press release re housing. 8. Minutes of Police Conference - Royal York - March 21, 1963. 96 Premier J. P. Robarts circular re Municipal Development and Loan ^ct. 10. Notice of Ontario Building Officials Association meeting - Niagara, October 17-18. Fee, $15.00. 11. B. J. Severs, Dog Report for period July 26 to August 12, as he acted for Mr. Gerigs, who was on holidays - $48.00. 12. Township of Scarborough notice re change of zoning regulations. 13. Fire Prevention Week. October 6 -'12. 14. Canadian National Railway advises contract let for pedestrian walK at Spruce Hill Road. 15. Judge has dismissed Hart Mandamus in West Rouge. 16. Project Planning Associates Ltd. do not recommend 50' lots on Spruce Hill Road to be changed from R4 to R3. but do recommend change so that "coverage of new buildings" can be greater than those homes in the area. 2 17. Resolution of Parks and Recreation Committee: "MOVED by Donald Hopkins, seconded by Gordon Shaver, that the Pickering Township Parks and Recreation Board endorse the Bay Ridges Park Board request to move Consolidated Building Corpor- ation Hall to James Mitchell Park. That if possible the Township check immediately the grants that might be forthcoming from the Province and forward from the Township general fund that amount that will be granted in order that the building might be erected as soon as possible, and that the grant money when received be returned to the general fund. CARRIED, Sept. 18, 1963." 18. Our Solicitors recommend a new Wrecking Yard By-Law to provide for zoning and fees. 19. Health Unit advisee that if Rouge Hills Golf Club does not connect to sewers at time stated, they will force. 20. Planning Board advises that Planning Director will study land for new schools. 21. Present "First Council Meeting" By-Law calls for first Thursday of January at 8 p. m. AGREED By-Law be prepared to have first meeting on First Honday and if such Monday is a holiday, it be held on First Tuesday. PERSONS HEARD 1. Mr. J. G. Jamieson, Solicitor for Mrs. Gallagher of Fairport Beacþ, asked Council to take water off his client's lands so that it would flow through as it did prior to when the Township raised the road. Reeve Scott stated the Township had an obligation and that the Township Engineer had just completed a report giving three ways this could be done and that his clients would be advised when a decision was made. 2. On Motion of Mr. Greening, seconded by Hr. Deakin. Messrs. Raymond Morgan and Terry Mokedanz were heard. These ratepayers stated that about 30 cars per day used Greenwood Avenue in Lot 35, Concession 1. that it had not been assumed by the Township and was very bad. See Resolution No. 246/63. 3. Moved by Mr. Greening, seconded by Mr. Deakin. that Ernest Birnie be heard. CARRIED Mr. Birnie stated that Consolidated Building Corporation had given them the C.B.C. Sales Building and would donate $10,000.00 towards moving it onto Township park lands. He stated that the estimated cost of moving and putting it on a foundation~ installing toilets, etc., would be $15,000.00, so asked if Township would inspect the building and secure the $5,000.00 Provincial grant given Community Centres immediately. Council agreed. 4. Moved by Mr. Greening, seconded by Mr. Deakin, that Mr. A. McInnes be heard. CARRIED . Mr. McInnes stated that he owned 75 acres in North Half Lot 1, Concession 6 and submitted a sketch of his lands broken into 30 two-acre lots, The Planning Board had not approved but he asked what the Township would require in services or lot fees. Reeve Scott said they could not deal with an agreement until the Planning Board had àpproved, but conditions would be at least a good road and at least a $500.00 fee per lot for capi tal costs. 5. Mr. Lloyd Peters asked for a letter of tolerance on a home in Dunbarton which he proposed to use for a Day Nursery as the house is approximately 20 feet from each lot line and By-Law 2572 requires 25 feet. See Resolution No. 245/63. 3 ... I 6. Messrs. Gordon Hughes of King Seagrave Ltd., Mr. Hesk of Hi ckey Ltd.. Mr. Moore of La France, were heard re fire fighting equipment. 7. Chief Don Lynde submitted prices for complete fire fighting equipment as follows: American Marsh La France Hicky King Seagrave $ 19,525.00 20,090.70 20,382.00 21,169.00 '- and that separate tenders for say truck without body were more than "',;"T;':".;. ¡;e unit. Chief Lynde recommended the purchase of La France equipment at changed price of $20.090.70 as it had a heavier pump. See Resolution No. 247/63. RESOLUTION NUMBER 245/63 MOVED by Mr. Deakin, seconded by Hr. Greening, that the Council for toe Town~hip of Pickering grant a Letter of Tolerance. that no action will be t4ken by the Township of Pickering for reason of variance from the requirements of Township By-Law No. 2572 in the matter of variance from the Qide yard requirements on Part of Lot 26, Con. 1 in respect to the use ~f the dweliing erected thereon for the purpose of a Day Nursery, in that the required side yard is 25 feet minimum whereas side yards of 19.36 feet on the west and 22 feet approximately on the east only are provided. CARRIED RESOLUTION NUMBER 246/63 MOVED by Mrs. McPherson, prepare a by-law for the Town(fhip road. seconded by Hr. Wank, that Mr. Johnston Township to take over Greenwood Avenue as a CARRIED RESO~UTION NUMBER 247/63 MOVE by Mr. Mowbray, seconded by Mr. Spang. that the tender of American Marsh for supply of one fire truck and equipment at a price of $19,525.00 be accepted, subject to prior approval by the Ontario Muniqipal Board of the required debenture issue. CARRIED RESOLUTION NUMBER 248/63 MOVED by Mr. Greening, seconded by Mr. Wank, that the Council for the Townåhip of Pickering grant a Letter of Tolerance. that no action will be taken by the Township of Pickering for reason of variance from the requirement of Township By-Law No. 2572 in the matter of variance from the ~ront yard requirements on Lot 75, Registered Plan 377 in respect to the partial use of the dwelling erected thereon for the purpose of a Barber Shop, in that the required front yard set-back for such use is 40 f~et minimum whereas setback in conformity with the adjacent building to tqe south only is provided. CARRIED RESOLUTION NUMBER 249/63 KOVEn by Mrs. McPherson, seconded by Mr. Spang, that the Road Department call1for tenders for 250 tons fine salt for Winter Control, delivered, Township pit, subject to Department of Highways of Ontario approval. CARRIED RESO~UTION NUMBER 250/63 MOVE~ by Mr. Greening. seconded by Mr. Wank, that this Council make application to the Ontario Municipal Board for approval of consent for Arthur Gray Skimin to convey to the Canadian National Railway Company, being part of Lot 9, Plan 330, as recommended by the Township of Pickering Planning Board September 6, 1963. CARRIED RESOLUTION NUMBER 251/63 MOVED by Mr. Wank. seconded by Hr. Spang, that this Council make application to the Ontario Municipal Board for approval of consent for Charlotte Nichols to convey to John and Annie Mallock part of Lot 20. Plan 228, being the south 100 feet of the north 200 feet by a depth of 430 feet; as recommended by the Township of Pickering Planning Board on July 5, 1963. CARRIED 4 RESOLUTION NUMBER 252/63 MOVE, by Mr. Mowbray, seconded by Mr. Wank, that the application of John Richard Church and Margaret Irene Church for Planning Board consent b~ refe~red back to Planning Board with the suggestion that the applicants be r~ferred to the provisions of the Planning Act as amended. CARRIED RESO,UTION NUMBER 253/63 MOVE by Mr. Wank, seconded by Mr. Greening, that the Clerk prepare a new ~recking Yard by-law CARRIED RESOLUTION NUMBER 254/63 MOVED'1ý Mr. Wank, seconded by Mr. Mowbray, that the Clerk send a let~er to ta~ County Health Unit asking if the letter dated September 13 implies that sewers will be connected by the end of the fall season 1963 whether a building is erected or not. CARRIED BY-LAW NUMBER 2817 , Mr. ~owbray, seconded by Mr. Wank, moves for leave to introduce a By-Law of the Township of Pickering to authorize the Corporation to sell certain Townsþip Industrial Lands to the Hydro-Electric Power Commission of Ontario, and that same now be read a first time. Mr. Mowbray, seconded by Mr. Greening, moves that By-Law Number 2817 to authorize the Corporation to sell certain Township Industrial lands to the Hydro-Electric Power Commission of Ontario be now read a second time, and that Council go into Committee of the Whole thereoa. The Committee of the Whole arises and reports the By-Law as read. Mr. Mowbray, seconded by Mr. Deakin, moves that the report of the Committee of the Whole on By-Law No. 2817 be adopted, and that the said By-Law be now read a Third time and PASSED; that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED BY-LAW NUMBER 2818 1 Mr. Wank, seconded by Mrs. McPherson, moves for leave to introduce a By-Law of the Township of Pickering to appoint an inspector to administer the Municipal Drainage Act, and that same now be read a first time. Mr. Wank, seconded by Mr. Spang, moves that By-Law Number 2818 to appoint an inspector to administer the Municipal Drainage Act be now read a second time, and that Council go into Committee of the Whole there on. The Committee of the Whole arises and reports the By-Law as read. Mr. Wank, seconded by Mr. Greening, moves that the report of the Committee of the Whole on By-Law No. 2818 be adopted. and that the said By-Law be now read a Third time and PASSED; that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto.
