Sherman Scott. in the Chair Mrs. J. McPherson Harvey Spang Milton Mowbray W. J. Greening Ross Deakin Hubert Wank L. T. Johnston. Clerk The following CORRESPONDENCE was read: 1. Mr. T. A. Newman. Solicitor for Kay Salvage Yard. who wishes to operate in Concession 2. Lot 25. asks that agreement be signed as agreed. and permit issued. Claims Official Plan not binding and Zoning By-Law not implemented. See Resolution No. 160/63. 2. John Robson. of County Health Unit, acting on complaints. is con- cerned about sanitary facilities at Township Hall and recommends piped water. three compa~tment sink. and flush toilets and basins. Letter turned over to Councillor Spang. 3. Department of Highways of Ontario advises that its request for the Township to assign to them the small area of Pine Ridge Road between Highway 2 and proposed C.N.R. was in error and now asks that the agreement signed by the Township be cancelled. See Resolution 161/63. 4. Our Solicitors submit a letter recommending Council pass a by-law to ~mit W. M. Bryden $85.63. being garbage charges for 1963 assessed in error in lieu of their withdrawal of appeal. See By-Law No. 2803. 5. S. J. Purdy. Con. 1, Lot 17 - drainage problem. Report, P. H. Poulsson; Report. John Robson. Councillor Wank took reports. 6. Chief R. T. Parker advises that Police Chief Dunne. of Ajax. requests Township to pass a by-law to reduce traffic speed on Pickering Beach Road south of Base Line. See Resolution No. 159/63. 7. Request for a Letter of Tolerance for part Lot 4. Plan 377, because house 3 1/4" too close to lot line on 75' lot. See Resolution 163/63. 8. Report on private roads in Township. Road Committee will consider. 9. Institute of Municipal Assessors of Ontario advises that Joseph Baglier has completed successfully his first year and asks that all Councils encourage such courses. I I t I I I I I I 10. The Muscular Dystrophy Association of Canada solicits funds. 11. Petition of 86 names of persons living near Bayview Heights gchool in Bay Ridges objecting to the location of Recreation or eommunity Centre buildings on adjoining park lands should it be proposed. Council ordered petition filed. 12. A. Hewitt. Manager Bay Ridges Drive-In Theatre. asks Council to request Department of Highways to flood-light Highway 2 at Valley Farm Road so area will be safer. See Resolution Number 164/63. 13. Our Fiscal Agents recommend that the High School debenture issue be sold in United States. 14. Finance Committee recommends that Fire Agreement with PickeRing Village. as submitted. be approved. Clerk prepare a by-l~~ faP signing.. 14. Resolution of Committee of the Whole as to terms of employment for Mr. Harry Billington. No action. 17. Resolution of Dog Control Committee that no action be taken at present re purchase of a vehicle to pick up dogs. See 166/63. 18. Resolution of By-Law Committee as to purchase of a rotary mower. See Resolution No. 165/63. 19. Resolution - Planning Board - re change of zoning, Bay Ridges, for carports. See Resolution No. 169/63. 20. Resolution - that Council approve registration of approxim- ately 115 lots in south half Lot 22. Con. B.F. R.3. by Consolidated Building Corporation. Secretary of Planning Board submit report. 21. Department of Highways of Ontario approval: (1) bagged calcium (2) liquid calcium (3) chips (4) gravel crushing (5) Road Superintendent increase of salary. 22. Ontario Municipal Board - approval for S. S. 5 to call for tenders for two-room school. 23. K. D. Munroe. Public School Inspector. submits estimate of number of expected pupils who will be promoted to Grade 9 over the next four years from School Area 2: 1963 - 248 1964 - 237 1965 - 298 1966 - 334 1967 - 343 High School Board writes that these figures are already in their possession. 24. Group who entertained the blind at Greenwood Conservation Park thanks Council for agreeing to let them use Township Hall free if it rained. It was a fine and successful day. 25. Secretary. Urban Rural Municipal Association advises that the Township of Brantford, population. 8,000; acreage 64,000; has taken over all hydro and has found that it has worked well, with two rate reductions. 26. Letter of resignation from A. W. Cane, Welfare Administrator. See Resolution No. 172/63. 27. Report from Engineer re closing of Altona Road for overhead C. N. R. crossing for approximately three weeks. The following PERSONS. on MOTION, were heard. 1. MOVED by Mrs. McPherson, seconded by Mr. Greening, that Mr. Abjon Broomfield be heard. CARRIED Mr. Abjon Broomfield stated that he had a retail outlet for handicraft, that he was interested in track and field and swimming and that he would like to teach day or night classes in ceramics, painting, copper work and mosaics. Reeve Scott suggested that Mr. Broomfield contact Mrs. Storry for an appointment with the Parks and Recreation Committee. - 3 - 2. MOVED by Mr. Spang, seconded by Mr. Greening. that Mr. Roy be heard. R. G. CARRIED Mr. R. G. Roy complimented Council on discharging the Welfare Administrator. 3. Mr. S. J. Purdy discussed his watercourse problem in Concession 2, Lot 17. and stated that if an award were made easterly. he would enforce the award. 4. Mr. Elfstrom spoke re wrecking yard. RESOLUTION NUMBER 159/63 MOVED by Mrs. McPherson. seconded by Mr. Deakin. that no action be taken on request of the Police Chief of Ajax that a speed limit of 30 miles per hour be placed on Pickering Beach Road South of the Base Line. CARRIED RESOLUTION NUMBER 160/63 MOVED by Mr. Mowbray, seconded by Mr. Wank, that the draft agreement submitted by Mr. T. A. Newman re the Kay application for a salvage yard be submitted to our solicitors together with a copy of the resolution passed in this connection and that our solicitors be requested to advise whether the draft agreement provides enforceable assurances against burning or smelting. CARRIED RESOLUTION NUMBER 161/63 MOVED by Mr. Greening. seconded by Mr. Mowbray. that as under date of March 4, 1963, Council authorized the Reeve and Clerk to sign an agreement for the Department of Highways to take over that portion of Pine Ridge Road which lies between Highway 2 and proposed Canadian National Railway; AND WHEREAS the Department of Highways of Ontario requested such transfer in error as Pine Ridge Road was never officially closed; THEREFORE the Reeve and Clerk be hereby authorized to sign an agreement authorizing the cancellation of the agreement signed March 4, 1963. as prepared by the Department of Highways of Ontario. CARRIED RESOLUTION NUMBER 162/63 MOVED by Mr. Mowbray, seconded by Mr. Spang, that our solicitors . ..., .. be requested to adv~se that legal steps would be ~nvolved ~n restoring the original water course from Mr. Purdy's property through Mr. Van Heswick's property to # 2 Highway. CARRIED RESOLUTION NUMBER 163/63 MOVED by Mr. Deakin. seconded by Mr. Greening. that this Council grant a Letter of Tolerance. that no action will be taken by the Township of Pickering for reason of variance from the requirements of Township By-Law No. 1787 in the matter of side-yards with respect to part of Lot 4, Plan 377. CARRIED RESOLUTION NUMBER 164/63 MOVED by Mr. Mowbray. seconded by Mrs. McPherson. that the Department of Highways of Ontario be requested to provide floodlighting at the intersection of # 2 Highway and Valley Farm Road. CARRIED RESOLUTION NUMBER 165/63 MOVED by Mr. Spang. seconded by Mr. Mowbray. that the By-Law Enforce- ment Officer be authorized to purchase a 22 inch rotary power mower of not less than 3 horse power at a price of not more than $90.00. as recommended by the By-Law Committee. CARRIED RESOLUTION NUMBER 166/63 MOVED by Mr. Spang, seconded by Mr. Wank, that no action be taken at the present time with respect to purchase of a vehicle for the dog catcher. as recommended by the Dog Control Committee. CARRIED - 4 - RESOLUTION NUMBER 167/63 MOVED by Mr. Deakin, seconded by Mrs. McPherson. that no action be taken on the request for funds from the HÐad Office of the Muscular Dystrophy Association of Canada. CARRIED RESOLUTION NUMBER 168/63 MOVED by Mr. Deakin, seconded by Mr. Spang, that this Council obtain tentative approval from the Ontario Municipal Board to issue debentures of not more than $15,000.00 for a term of five years. for the purchase of a new Fire Truck for Fire Area No.1. CARRIED RESOLUTION NUMBER 169/63 MOVED by Mr. Mowbray, seconded by Mr. Greening, that the Clerk be and is hereby instructed to prepare a draft by-law to amend the Bay Ridges zoning with respect to side yards in accordance with the resolution passed by the Planning Board on 7 June. 1963. CARRIED RESOLUTION NUMBER 173/63 MOVED by Mr. Spang, seconded by Mrs. McPherson. that this council make application to the Ontario Municipal Board for approval of consent for Arthur Lawson Milne to convey to the Canadian National Railway Company a parcel of land 9.42 acres in area being part of Lot 25. Concession 1 (to be used for Highway 2 diversion purposes); as recommended by the Township of Pickering Planning Board June 7. 1963. CARRIED RESOLUTION NUMBER 174/63 roVED by Mr. Deakin, seconded by Mr. Greening. that this Council make application to the Ontario Municipal Board for approval of 'consent for William G. McKay to convey to Goodwin Farms Limited a parcel of land 16 1/2 feet by 660 feet in area. part of Lot 10, Concession 5 (required to build a farm fence unobstructed by tree ~tumps and boulders along the old fence line); as recommended by the Pickering Township Planning Board June 7th, 1963. CARRIED RESOLUTION NUMBER 175/63 MOVED by Mr. Wank, seconded by Mrs. McPherson, that this Council make application to the Ontario Municipal Board for approval of consent for Norman Wilfred Waller and Yvonne Mary Ballik to convey to George Kolodziez a parcel of land with frontage 75 feet and depth 296 feet - part of Block 3, Plan 353. Spruce Hill Road; as recommended by the Pickering Township Planning Board June 7th, 1963. CARRIED RESOLUTION NUMBER 176/63 MOVED by Mr. Greening. seconded by Hr. Mowbray, that this Council make application to the Ontario Municipal Board for approval of consent for Joseph Charles Brook and Joan Madeline Brook to convey to John William McAdam and Carol Elizabeth McAdam Lots 85, 86. and part Lot 87, Registered Plan 283 as one parcel with existing dwelling built in 1959; as recommended by the Township of Pickering Planning Board on June 7th, 1963 (Planning Board consent was not obtained to a conveyance of this parcel in 1959). CARRIED - 5 - RESOLUTION NUMBER 177/63 MOVED by Mr. Greening, seconded by Mr. Mowbray. that this Council make application to the Ontario Municipal Board for approval of consent to a deed which establishes a permanent boundary line (according to survey) between the respective lands of Judith C. Donaldson and James Edward Stephens (part of Lot 28, Concession 5); as recommended by the Township of Pickering Planning Board June 7th, 1963. CARRIED RESOLUTION NUMBER 178/63 MOVED by Mrs. McPherson, seconded by Mr. Spang, that this Council make application to the Ontario Municipal Board for approval of consent for a grant of a 20 ft. right-of-way from John Edward Hewson to Thorall Anne Blomley across the rear of Lot 33. Plan 270, Fairport Beach, to provide access to Lot 33, Plan 270 (former access now cut off by erosion of Lake Ontario); as recommended by the Township of Pickering Planning Board June 7th. 1963. CARRIED RESOLUTION NUMBER 179/63 MOVED by Mr. Mowbray, seconded by Mr. Spang, that this Council make application to the Ontario Municipal Board for approval of consent for Orval and Rose Wilson. owners of a 12.26 acre parcel at Whitevale to convey to themselves, Orva~ and Rose Wilson a separate parcel about 165 feet by 165' in area and being com- prised of part of Village Lot 26 and all lots 27 and 28, Registered Plan 21. north side 5th Concession Road; as requested by the Township of Pickering Planning Board June 7th. 1963. CARRIED BY-LAW NUMBER 2803 Mr. Deakin. seconded by Mr. Mowbray, moves for leave to introduce a By-Law of the Township of Pickering to authorize a rebate of the garbage rates charged in error against a ratepayer, and that same now be read a first time. Mr. Deakin, seconded by Mr. Wank, moves that By-Law Number 2803 to authorize a rebate of the garbage rates charged in error be now read a second time, and that Council go into Committee of the Whole thereon. The Committee of the Whole arises and reports the By-Law as read. Mr. Deakin, seconded by Mr. Greening, moves that the report of the Committee of the Whole on By-Law No. 2803 be adopted. and that the said By-Law be now read a Third time and PASSED; that the Reeve and Clerk sign the same, and the Seal of the Corpor- ation be affixed thereto. CARRIED DIRECTIONS 1. Clerk prepare resolution for next meeting to give a Township grant to the Muscular Dystrophy Association through Fire Area No.1. 2. Clerk prepare debenture by-law for $15.000.00 - five year. for new fire truck for Area 1. 3. Clerk get copy of our solicitor's letter re $500.00 residential fee for breaking land from Planning Board. 4. Clerk find out if new subdivision agreement necessary for C.B.C. plan in south half Lot 21, Concession B.F. R.3. 5. By-Law Enforcement Officer contact Mr. Theall re Noise By-Law and C. N.
