PRESENT: J. Sherman Scott, in the Chair Edgar James Harvey Spang Milton Mowbray Harry Boyes Ross Deakin Clifford Laycox L. T. Johnston, Clerk MOVED by Mr. James, seconded by Mr. Boyes, that Minutes of meeting held September 5, 1961, be adopted. CARRIED The following CORRESPONDENCE was considered: 1. 2. East Rouge Water Committee will ask Council re progress of water_ mains for their area. 3. W. P. Neale submits resignation as member of the Court of Revision due to ill health. See Resolution No. 314/61. 4. Markham Village ask for a meeting of Fire Committee to discuss a Fire Àgreement as they have attended three fires in the Township in recent weeks. Councillor Deakin to arrange meeting. 5. Fire Marshal, by circular letter, asks Council to become more fire conscious, especially for Fire Prevention Week, Oct. 8 to 14, and possibly declare this week Fire Prevention Week in the Township. 6. Hy·dro-Electric Power Commission ask permission to place a "guy" to a Hydro pole 10' ins~de new road allowance 300' west of Dixie Road in deeded Township park lands for regular $16.50 fee. See Resolution NO.322/61. 7. Two resolutions - as submitted by Works Committee for Council approval re sewage treatment. 8. Messrs. D. Arbour and Don Scott have made application for a Wrecking Yard Licence. They propose to buy auto wrecks, etc., break them up where they are purchased, and transport to Scarborough Township and sell the parts from Scarborough Town- ship wherever there is a demand. There will be no wrecking yard in the Township. Deferred for two weeks. 9. Ontario Water Resources Commission give final approval for Sewage Works for West Rouge at cost of $283,000.00. 10. Our Engineer submits monthly report on service installation: (a) Estimate completed date of water treatment plant - Nov. 20/61- (b) Estimate completed date of sewer treatment plant - Nov. 14/61. ~ 11. West Rouge Community Park Board ask Council to survey the Kirkdene - East Avenue Park to establish proper boundaries, Mr. Jefferson is contacting Donald McIntosh for costs of re- staking. - 2 - 12. Rou~e Hill Communit¥ Park Board ask Council to set apart for the~r use ~n ~mprov~ng the1r hall, any funds received by the Township from the sale of their lands to the Department of Highways of Ontario. The following PERSONS, on MOTION, were heard: 1. MOVED by Mr. Mowbray, seconded by Mr. Laycox, that Mrs. McPherson be heard. CARRIED Mrs. Jean McPherson asked that nominations this year be held one week earlier with two full weeks before voting, and that if questions are to be voted on, coloured ballots be used for such questions. 2. MOVED by Mr. Laycox, seconded by Mr. Deakin, that Mr. Wank be heard re progress of water in East Rouge. CARRIED Mr. Wank asked for progress of securing Ontario Municipal Board approval for their water system. Reeve Scott stated that all requests of the O. M. B. were being acted upon as soon as possible; that the Auditor's report on taxation in 1966 should be completed this week, and that the O.M.B. was extremely cautious on such approvals. 3. MOVED by Mr. Boyes, seconded by Mr. Deakin, that Mr. Picov be hèard. CARRIED Mr. Michael Picov discussed the expropriation of 10 acres of his lands at Concession Broken Front, Range 2, Lot 19. It was AGREED that Reeve Scott and our solicitor meet him and his solicitor and endeavour to work out a settlement. 4. MOVED by Mr. Deakin, seconded by Mr. Boyes, that Mrs. Corry be heard. CARRIED Mrs. AUdre* Corry asked that the exchange of deeds be made - Old Greenwood oad for unopened sideline between Lots 13 and 14. See By-Law No. 2630. Secondly, Mrs. Corry objected to Mr. Benham's park, swimming pool and golf operations. ~ 5. MOVED by Mr. Deakin, seconded by Mr. Boyes, that Mr¡ Benham be heara. CARRIED Mr. Norman Benham stated that he felt that his golf range was not dangerous with a 120' road between his lands and his neigh- bour's, and he only had one agreement with the Township which related to his building a summer cottage for his personal use during the summer. - 3 - r 6. MOVED by Mr. Spang, seconded by Mr. Boyes, that Mr. Arbour and Mr. Scott be heard re wrecking yard. CARRIED Mr. Arbour stated they would not operate a wrecking yard in the Townsh~p if granted a licence to pick up old cars, etc. 7. MOVED by Mr. Laycox, seconded by Mr. Boyes, that Mr. Taylor be heard. CARRIED Mr. Taylor asked that Mr. C. Laycox be appointed to the Bay Ridges Recreat~on Committee, but as the By-Law had been passed naming Messrs. Boyes and Deakin, and no resolution to amend same was forthcoming, no action was taken. 8. MOVED by Mr. Mowbray, seconded by Mr. James, that Mr. W. G. Lawson be heard. CARRIED Mr. Lawson stated he represented Odeon Theatres and asked that Council permit a vote of the electors on Sunday Drive-In Theatres. see Resolution No. 313/61. 9. MOVED by Mr. Deakin, seconded by Mr. Laycox, that Mr. John Keogh be heard re Sunday Theatres. CARRIED Mr. Keogh stated his Puppet Theatre at Kinsale had a very good beginning, but he had to stay at home on Sundays to tell people he could not operate. He felt that families wanted his kind of theatre on Sundays, and asked that Council give consideration to Mr. Lawson's request. 10. MOVED by Mr. Deakin, seconded by Mr. Laycox, that Mr. BentleYt of Pickering Beach Fire Area, be heard. CARRIED Mr. Bentley stated his area had subscribed $600.00, and purchased a resuscitator, but needed special attachments, which would cost $217.25, so asked if Council would advance the money. It was AGREED that the Fire Committee meet the Pickering Beach group on October 10th. 11. Mr. Kinsman confirmed Mrs. Corry's statement that golf balls from Mr. Benham's golf range were dangerous to children on his property. RESOLUTION NUMBER 307/61 MOVED by Mr. Laycox, seconded by Mr. Deakin, that all monies realized from the sale of lands abutting the Rouge Hills Community Park to the Department of Highways be expended on improvements on that park, and that all expenditures be submitted to Parks and Recreation Committee for their approval, prior to Council approval. CARRIED RESOLUTION NUMBER 308/61 MOVED by Mr. Mowbray, seconded by Mr. Spang, that the sum of $1000.00 held by the Township at the present time be made available for approved expenditures by the Board of the Bay Ridges Community Centre. CARRIED ~ RESOLUTION NUMBER 309/61 MOVED by Mr. Laycox, seconded by Mr. Deakin, that the Township Solicitors, Stevens, Hassard and Elliott, and also the Township Planning Consultants, Project Planning Associates, be in attendance at the Municipal Board Hearing to be held in Brougham on Wednesday, October 4, at 10 a. m. CARRIED RESOLUTION NUMBER 310/61 MÒVED by Mr. Laycox, seconded by Mr. Deakin, that the date of Nomination be set as Friday, November 24th, between the hours of 6 and 7 o'clock p. m., and that Election day be set as December 9th, 1961. CARRIED - 4 - RESOLUTION NUMBER 311/61 MOVED by Mr. Spang, seconded by Mr. James, that voting hours be held between the hours of 10 o'clock a. m. till 7 o'clock p. m. CARRIED r RESOLUTION NUMBER 312/61 MOVED by Mr. James, seconded by Mr. Spang, that the Road Superintendent call for tenders for the crushing of: (1) 20,000 tons 2" gravel (2) Screen 5,000 tons sand all in our Fifth Concession pit. CARRIED RESOLUTION NUMBER 313/61 MOVED by Mr. Laycox, seconded by permit the placing on the Ballot Sunday Amusements and Sports. Mr. Deakin, that this Council do of a question or questions permitting CARRIED RESOLUTION NUMBER 314/61 MOVED by Mr. Mowbray, seconded by Mr. James, that the resignation of Mr. W. P. Neale from the Court of Revision be accepted, with regret. CARRIED RESOLUTION NUMBER 315/61 MOVED by Mr. James, seconded by Mr. Mowbray, that this Council make application to the Department of Highways of Ontario for the grant on road expenditures for period January 1st to August 31st, 1961, amounting to $203,830.00. CARRIED RESOLUTION NUMBER 316/61 MOVED by Mr. Spang, seconded by Mr. Mowbray, that this Council proclaim the week of October 23 to 28 "Retarded Children's Week" and permit the Ajax, Pickering and Whitby Association for Retarded Children to canvas the Township for funds during this week. CARRIED RESOLUTION NUMBER 317/61 MOV~D by Mr. Deakin, seconded by Mr. Mowbray, that this Council make application to the Ontario Municipal Board for approval of the endor- sation of consents on conveyances by which Edith Elsie Shea deeds to herself, Edith Elsie Shea, three separate parcels, each with frontage 63.79 feet and depth approximately 300 feet, from her total present holdings - a parcel 292' by 300' - part of Block 1, Registered Plan 353, west side of Spruce Hill Road; as approved by the Township of Pickering Planning Board October lath, 1960. CARRIED RESOLUTION NUMBER 318/61 MOVED by Ar. Mowbray, seconded by R. W. Deakin be designated as the Bay Ridges Park Board. Mr. Spang, that H. W. Boyes and representatives of Council on the CARRIED RESOLUTION NUMBER 319/61 MOVED by Mr. Boyes, seconded by Mr. Deakin, that: (1) No charge be made for sewage treatment prior to the date when the Township commences to operate the sewage treatment plant. (2) No change be made in the sewage treatment rates for the balance of this year. (3) A sewage treatment rate of $22.00 per year per house be charged in the Bay Ridges area commencing January, 196?. all as recommended by the Works Committee on Sept. 20, 1961. CARRIED RESOLUTION NUMBER 320/61 MOVED by Mr. Laycox, seconded by Mr. Boyes, that the By-Law No. 2585 setting out sewerage charges be repealed and a further by-law be drafted. CARRIED - 5 - RESOLUTION NUMBER 321/61 MOVED by Mr. Deakin, seconded by Mr. Boyes, that all water and sewage bills issued in the Bay Ridges Development be cancelled and a new billing for water only, at the minimum charge, be re- issued. CARRIED RESOLUTION NUMBER 322/61 MOVLD by Mr. Mowbray, seconded by Mr. Spang, that the Reeve and Clerk be authorized to sign an Agreement with the H. E. P. C. for their placing a guy wire to a hydro pole, 10 feet on Township property approximately 300 feet west of Dixie Road south of the Canadian National Railway tracks for the sum of $ 16.50. CARRIED MOVED by Mr. Deakin, seconded by Mr. Boyes, that the accounts, as submitted by the FIRE COMMITTEE,in the amount of $3,954.74, be adopted. CARRIED MOVED by Mr. James, seconded by Mr. Spang, that the report of the accounts, in the amount of $21,416.07, as submitted by the ROAD AND BRIDGE COMMITTEE, be adopted. ~IED MOVED by Mr. Deakin, seconded by Mr. Mowbray, that the report of the accounts, in the amount of $7,093.42, as submitted by the POLICE COMMITTEE, be adopted. CARRIED MOVED by Mr. Boyes, seconded by Mr. Mowbray, that the report of the accounts, in the amount of $2,175.12, as submitted by the WATER COMMITTEE, be adopted. CARRIED MOVED by Mr. Laycox, seconded by Mr. Mowbray, that the report of the accounts, in the amount of $195,007.08, as submitted by the FINANCE COMMITTEE, be adopted. CARRIED MOVED by Mr. Laycox, seconded by Mr. Spang, that the report of the accounts, in the amount of $86.03, as submitted by the RECREATION COMMITTEE, be adopted. CARRIED MOVED by Mr. Mowbray, seconded by Mr. James, that the report of the accounts, in the amount of $944.68, as submitted by the BY-LAW COMMITTEE, be adopted. CARRIED MOVED by Mr. Mowbray, seconded by Mr. Spang, that the report of the accounts, in the amount of $2,773.25, as submitted by the WELFARE COMMITTEE, be adopted. CARRIED MOVED by Mr. Boyes, seconded by Mr. Deakin, that the report of the accounts, in the amount of $10,830.64, as submitted by the WORKS COMMITTEE, be adopted. CARRIED BY-LAW NUMBER 2629 Mr. Laycox, seconded by Mr. Boyes, moves for leave to introduce a By-Law of the Township of Pickering to establish a Community Centre at Bay Ridges, and that same now be read a first time. Mr. Laycox, seconded by Mr. Spang, moves that By-Law Number 2629 to establish a Community Centre at Bay Ridges, be now read a second time, and that Council go into COID~ittee of the Whole thereon. Mr. Laycox, seconded by Mr. Mowbray, Committee of the Whole on By-Law No. said By-Law be now read a Third time Clerk sign the same, and the Seal of thereto. moves that thè report of the 2629 be adopted, and that the and PASSED; that the Reeve and the Corporation be affixed CARRIED - 6 - BY-LAW NUMBER 2630 Mr. Mowbray, seconded by Mr. Spang, moves for leave to introduce a By-Law of the Township of Pickering to declare that all that part of the original allowance for road between Lots No. 12 and No. 13 in the Fourth Concession of the Township of Pickering lying south of the Canadian Pacific Railway right-of-way is no longer of use to the pUblic, and that same now be read a first time. Mr. Mowbray, seconded by Mr. Boyes, moves that By-Law Number 2630 to declare that all that part of the original allowance for road between Lots No. 12 and No. 13 in the Fourth Concession of the Township of Pickering lying south of the Canadian Pacific Railway right-of-way is no longer of use to the public, be now read a second time, and that Council go into Committee of the Whole thereon. The Committee of the Whole arises and reports the By-Law as read. Mr. Mowbray, seconded by Mr. Deakin, moves that the report of the Committee of the Whole on By-Law No. 2630 be adopted, and that the said By-Law be now read a Third time and PASSED; that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED CLERK'S INSTRUCTIONS 1. Check 1955 records re regulations for Mr. Benham's park. 2. Find out if coloured ballots for questions at election are valid. AGREED Council meet October 16th at 8 p. m. for general business.
