Plitz ADOPTION OF MIN~ Moved by Councillor A. King, seconded by Councillor D. Kitchen, that the minutes of Council meeting of January 8,1968, be adopted as presented. CARRIED Councillor J. Kruger inquired as to whether the various recreational committees have been advised of the policy as set out in Resolution #3/68, with respect to purchase of equipment or ice time. Clerk to bring this to the attention of the various groups. Councillor J. Kruger suggested the Resolution #2/68 with copy of the Ontario Municipal Board's Order be referred to the Township Solicitor for his opinion as to the resolution's wording and legality. CORRESPONDEill Mr. James A. Taylor, Township Solicitor, advises that a right- of-way over the Township lands should be granted to Mr. Bazarin, Tillings Road, and suggests that a clause be incorporated in same which would provide for its extinction upon any subsequent dedication of the Tewnship lands as a public highway. See Resolution #13/68. Mr. J. A. Taylor advises that the Solicitors for Mr. Ranier Franzen, Lot 47, Plan 270, 551 Park Crescent have informed him their client will payoff the moneys payable under the sewer agreement affecting the above property; and that a release for same should be signed by the Reeve and Clerk and given to Mr. Franzen when he has paid all moneys owing to the Township. See By-law #3443. The West Rouge Ratepayers' Association requests stricter enforcement of dog control By-law. Referred by By-law Department. Mr. Thomas E. Austin, President, Temple Taxi, would like to meet with Councilor representative of Council to discuss the amount of Public Liability Insurance required by the Township on his vehicles. Referred to By-law Department. The West Rouge Ratepayers' Association suggests that Council Meeting Agenda be forwarded to the various Ratepayers' groups. Referred to Committee of the Whole Council. 6. ~ 7. l. 2. 3. 4. 5. 6. - 2 - 2/68 The Ontario Development Corporation advises that the municipality's application for financial assistance under the Equalization of Industrial Opportunity Program cannot be included on the list as eligible for assistance as the Township of Pickering is located within a thriving industrial area. All members of Council did not agree with this view, recommend- ing that a reply be made to this letter outlining the Town- ship's position with respect to its need for industrial assessment and assistance in obtaining same. Reeve Williams advised Council that he would acknowledge the Ontario Development Corporation's letter. Mrs. Catherine E. Pickard, 926 Beachpoint Blvd.~ is requesting Township Council's assistance in providing the uunbarton . Shores area with improved roads and water services. Letter referred to Roads Committee and Public Utilities Committee for further study and consideration. INFORMATION Ferguson, MOntgomery, Cassels & Mitchell, Barristers and Solicitors, confirm Wednesday, February 14,1968, as the date of the Arbitration hearing re the Township of Pickering and the Professional FirefightersY Association, Local 1632- time and place to be advised at a later date. Canadian Union of Public Employees, Local 129, submits amendments to present Agreement. Copies to Council. Council, in Committee of the Whole, will meet with representa- tives of the staff, Canadian Union of Public Employees, Local 129, 7:30 p.m., Thursday, January 25, 1968, to review Union amendments to present Agreement. The Ontario Police Commission advises of the appointment of His Worship, Magistrate Harry W. Jermyn, to the Board of Commissioners of Police for the Township of Pickering to fill the vacancy created by the recent death of Magistrate Ebbs. The Ontario Municipal Water Association advises of their annual meeting to be held at the Royal York Hotel, Toronto, Monday, March 25, 1968. Members wishing to submit resolu- tions should mail them to the Secretary-Treasurer not later than February 26,1968. Mr. P. Poulsson, Township Engineer, to be advised of this meeting and suggest that he attend. The Canadian Transport Commission forwards Order No. R-877, authorizing the Township to reconstruct and improve the overhead bridge carrying Moore Road across and over the track of the Canadian National Railways, between Lots 28 and 29, Range 3, Township of Pickering. The City of Woodstock requests that Council give support to their Resolution to help reduce the complaints received from voters on election day of their names being missed, and not being able to vote. See Resolution #25/68. - 3 - 2/68 7. The Canadian Pacific Railway Company gives notice that application has been made to the Canadian Transport Commission for approval of a proposed Customer Service Centre to be located at Agincourt~ Ontario; the establish- ment of which will result in the removal of the Agent at Claremont. Kruger, seconded by Councillor A. Kingi moves that the report of the Committee of the Whole on By- aw Number 3396, to authorize the borrowing of $86,900.00 upon debentures for the construction of watermains and sewers in the Frenchman's Bay area be adopted, and that the said By-law be now read a Third Time and PASSED, that the Reeve and Clerk sign the same~ and the Seal of the Corporation be affixed thereto. CARRIED By-Law Number 3437 Councillor V. Rudik, seconded by Deputy Reeve R. Chatten, moves for leave to introduce a By-law of the Township of Pickering to authorize the execution of a Quit Claim Deed to Anthony Kormos for lands expropriated from him being re-conveyed at his request, Part Lot 32, Concession 1, and that same now be read a first time. King, moves for leave to introduce a By-law of the Township of Pickering to authorize the construction of watermains and sanitary sewers on Brock Road as local improvements under the provisions of Section 8 of The Local Improvement Act, and that same now be read a first time. Deputy Reeve R. Chatten, seconded by Councillor D. Kitchen, moves that By-law Number 3444 to authorize the construction of watermains and sanitary sewers on Brock Road as local improvements under the provisions of Section 8 of The Local Improvement Act, be now read a second time, and that Council go into Committee of the Whole thereon. ill] RESO~UTIONS Resolution #11/68 MOVED by Councillor D. Kitchen, seconded by Councillor A. King, that whereas Pi.ckering Township has recently been subjected to the worst winter storm in the last seventeen years, and WHEREAS our Roads Department employees responded quickly, and worked many overtime hours to plow, salt and sand the Township's roads to secure the safe and easy passage of motor vehicles thereupon very soon after the storm, This Council would like to congratulate and thank these men for their efforts and for a job well done, AND that the Clerk be instructed to post this resolution on the Bulletin Board. CARRIED Resolution #12/68 MOVED by Councillor J. Kruger seconded by Councillor D. Kitchen, that whereas the William G. Davis Public School has been operational since September, 1967; AND WHEREAS the approach to th:is school north and south on East Avenue and east on WillowGate is unmarked, and further as East Avenue is a heavily travelled road because it provides access to the Rouge Hill G.O. Commuter Station, AND WHEREAS there are no road signs designating this school area or any restriction on the speed of traffic, BE IT THEREFORE RESOLVED AS FOLLOWS: 1. That the Engineering Department be instructed to place road signs designating a school area in necessary positions on East Avenue, Willow Gate and such other streets as recommended by the Engineering Department. That instructions be given to prepare a By-law limiting the speed of traffic in the school area designated. 2. ~ CARRIED - 7 - 2/68 Resolution #13/68 MOVED by Councillor J. Kruger, seconded by Councillor A. Kingf that whereas Mr. Bazarin has requested the Township of : Pickering grant him a right-of-way to his property to ensure that there is ingress and egress at all times, ~ AND WHEREAS our Solicitors have indicated the granting of such a right-of-way would be in order, BE IT THEREFORE RESOLVED AS FOLLOWS: 2. THAT the Township Solicitors be instructed to proceed in accordance with their letter dated January 11,1968. THAT the Reeve and the Clerk be authorized to sign any conveyance to give effect to the granting of the right- of-way mentioned in the Township Solicitor's letter of January 11, 1968. 1. CARRIED Resolution #16/68 MOVED by Councillor J. Kruger, seconded by Councillor A. King, that Resolution 324/67 be and the same is hereby rescinded. CARRIED Resolution #17/68 MOVED by Councillor V. Rudik, seconded by Councillor A. King, that the Council of the Township of Pickering approve of the expenditure of $450.00 for the purchase of a snow plow attachment for the Parks and Recreation Department, purchased in 1967, and charged to the budget for that year, as recommended by the Committee of the Whole Council, January 17,1968. þ CARRIED - 8 - 2/68 Resolution #l8/68 MOVED by Councillor J. Kruger, seconded by Councillor V. Rudik, that whereas it appears to be in the long term interests of the Corporation of the Townshjp of Pickering to explore the feasibility of some form of Regional Government for the Township, AND WHEREAS certain major municipalities in the area local to Pickering Township have already expressed certain intents regarding Regional Government for the urbanized southern section of Ontario County, AND WHEREAS the Corporation of the Township of Pickering must lend active voice to these discussions in order to best protect the interests of all its residents both rural and urban, BE IT THEREFORE RESOLVED AS FOLLOWS: l. 2. That a Committee of Council be established to consult with municipalities interested in exploring the feasibility of Regional Government, That the terms of reference governing the conduct of this Committee be drafted and agreed to by the Committee of the Whole Council, 3. That the membership in the Committee be comprised of the Committee of the Whole Council. That this Committee of Council be called ¡¡Regional Government Study Groupi¡ and be activated as soon as possible. 4. as recommended by the Committee of the Whole Council, January 17,1968. Green of the conveyance of a 30 foot by 30 foot parcel of land on which are erected certain memorial plaques commemorating the Green family and giving a short summary of the history of Greenwood, as recommended by the Committee of the Whole Council, January 17,1968. Chatten that the two positions of Captain for the Pickering Township Fire Department be filled as recommended by the Fire Committee at their meeting of October 3rd, 1967. WHEREAS the applicants were given written and oral practical tests, AND WHEREAS said applicants were interviewed as part of said tests before officers of the Oshawa and Scarborough Fire Department s, BE IT THEREFORE RESOLVED that effective January 1, 1968, the successful applicants - J. Glendenning G. Wilson be promoted to the rank of acting Captain on a 6 month pro- bationary period, salary to be in accordance with Section 9.01 of the Agreement dated January 1, 1965 between the Corporation of the Township of Pickering and the Pickering Township Professional Firefighters9 Association. CARRIED Resolution #22/68 MOVED by Councillor D. Beer, seconded by Councillor V. Rudik, that whereas the Metropolitan Toronto Planning Bœ. rd had requested the Corporation of the Township of Pickering to appoint a member to the Metropolitan Waterfront Advisory Committee for the years- 1968-69; BE IT THEREFORE RESOLVED that the Council of the Township of Pickering appoint Reeve J. R. Williams, to represent this Municipality on this Committee. CARRIED Resolution #23/68 MOVED by Deputy Reeve R. Chatten, seconded by Councillor J. Kruger, that whereas the Clerk has received a petition for local improvements (watermain) from the residents on Rosebank Road North, Sideline, Lot 30, Concession l; AND WHEREAS the said petition is sufficiently signed by the property owners representing 2/3 of the owners and 6~ of the assessment; AND WHEREAS the Clerk of the Township of Pickering has certified the said petition as being sufficiently signed; BE IT THEREFORE RESOLVED that the Township Engineer be required to make a feasibility study on this proposed local improvement and report back to Council. CARRIED Resolution #24/68 MOVED by Councillor V. Rudik, seconded by Councillor D. Beer, that this Council does hereby direct that the following policies related to the granting of Consents in the rural area, be adopted to become effective upon adoption. l. In view of the municipal policy of discouraging residential construction in agriculturally designated areas no variance applications shall be approved by the Committee of Adjustment, tåle results of which would enable the creation of a new residential parcel. Consents shall only be considered in the areas shown as fihamletil or iîclusterU on Schedule IYAii attached hereto, and forming part of this Resolution. 2. - 10 - 2/68 3. An annual maximum ceiling of 50 new residential lots shall not be exceeded in the rural area, within those areas referred to in (2) above. (Note: Policy number (3) shall be subject to review after a trial period, to be determined by Council.) CARRIED Resolution #25/68 MOVED by Councillor D. Kitchen, seconded by Councillor J. Kruger, that whereas many municipal voters each year are deprived of the privilege of voting on election day by having been omitted from the voters? list; AND WHEREAS the majority of people will not check the voters' list in sufficient time to have their names properly added to the list according to the present provisions of The Voters' List Act; AND WHEREAS The Municipal Act would appear to recognize the fact that people will not check the voters' list by providing that names of omitted voters may be added after the final date for appeals if they appear on the assessment roll; AND WHEREAS The Election Act provides that for Provincial elections in rural polling subdivisions the deputy returning officer may allow a person to vote whose name was omitted in error from the voters~ list provided such person takes an appropriate oath and who is vouched for by a voter whose name is on the voters? list and who is a resident of the polling subdivision; THEREFORE BE IT RESOLVED that the Minister of Municipal Affairs be requested to amend Section 37 of The Municipal Act by adding thereto a new subsection as follows: (10) Where after the voters' list has been finally revised the Clerk is satisfied that the name of a person entitled to be entered thereon has by error been omitted therefrom, he may, where such person is vouched for by a voter whose name is on the voters? list, issue a certificate (Form 10), authorizing the returning officer or proper deputy returning officer to enter the name of such person on the voters' list to entitle him to a vote as if his name had been entered thereon before the list was revised, provided such person shall take and subscribe before the said clerk the following a copy of which shall be retained by the said Clerk with other records of the election -- I (full name of applicant) swear that I presently reside at (give street, lot, concession, etc.) and that my name has been omitted from the voters' list and that: (1) (2) (3) (4) (5) I am a British subject by (indicate whether by birth or naturalization), I have resided at the above address since (date), I am over twenty-one years of age, I am otherwise qualified to vote in this election and I have been vouched for by (name as shown on voters' list) who resides at (address shown on voters' list) and whose name appears on the vo~ers' list. ' CARRIED Resolution #26/68 MOVED by Deputy Reeve R, Ghatten, seconded by Councillor J. Kruger, that the Township Clerk be instructed to write a letter to Mrs. Pemberton-Piggot and family, conveying the Township's sincere appreciation of the many years of dedicateØ service her late husband gave to the Township as a valuable member of the Industrial Committee and various other public duties he undertook so unselfishly. We wish to express this Council's heartfelt and sincere sympathy at this time of personal loss. CARRIED 1-YII1--NOTICE OF ~OTIO~ 1. Moved by Councillor J. Kruger, seconded by A. King, that whereas certain elements of the general public receive minutes of Council meetings, AND WHEREAS a request has been made to supply an agenda of these meetings; AND WHEREAS it is in the interests of good public relations to keep ratepayers informed of upcoming legislation in their community: BE IT THEREFORE RESOLVED AS FOLLOWS: 1. That agenda of all Council meetings be distributed in advance of the scheduled meeting time to the present recipients of the minutes of Council meeting:s.'
