Plitz ill ADOPI'ION OF MINUTES Moved by Councillor Kruger, seconded by Councillor Mrs. J.L. McPherson, that the minutes of the Council meeting held on September 8, 1970, be adopted as presEn ted. Carried lliJ DELEGATIONS - 1. Moved by Mrs. J. L. McPherson, seconded by Councillor V.Rudik that Mr. H. Burton be heard. Mr. Burton read from a prepared report in support of his application for a rezoning application on Part Lot 19, Concession 7, Township of Pickering. See copies of report on file. Copies to Council. Mr. Burton contends that his business was always a combination of window sash manufacturing, buying and selling of machinery, and selling of building materials, this being carried on prior to the zoning coming into effect. The only difference is that he is now repairing the equipment on the present site. If permitted to carry on, he would completely brick the existing building, relocate a portion of the outside storage to the rear of his building and erect a board fence to shut it off from view of the road. He would also erect a chain- link fence around the perimeter of the property. The Council took the stand that the intended proceedings for an injunction by the Township should be withheld until Council has had an opportunity to examine the report submitted by Mr. Burton, and further, upon Mr. Burton supplying evidence of his being in the selling of machinery prior to the present zoning by-laws going into effect. (See motion of Council, page 7 ) Instructio~: 1. Clerk to prepare copies for Council, of the Burton presentation. 2. Mr. Burton to submit copies of purchase and sale invoices dealing with the buying and selling of equipment. 2. Moved by Councillor Kruger, seconded by Deputy Reeve Ashe that Mr. J. Coates be heard. Mr. J. Coates, Chairman of the United Appeal Study and Organization Committee and Mr. A. Tyas, Director of Finance, appeared before Council to present the Chairman's report on the Committee's findings relative to the organization of a United Appeal in Pickering Township. - 2 - The report was read by the Clerk at the request of Mr. Coates. MOTION Moved by Councillor Kruger, seconded by Councillor Kitchen, that the Council move a vote of thanks for the excellent work done by the Committee in preparing their report on a United Appeal Organization for the Pickering Township area, and that Council concur with the recommendation to have its opening campaign held in 1971. See Report on file - Copies to Council. (III) INFOm~TION 1. Resolution #312/70 re assumption by the County of Finch Avenue - referred by Standing Committee on Roads and Bridges to the Needs Study Co-ordinating Committee for study and report. 2. Community Planning Association of Canada, Ontario Division advises of conference October 13, 14 and 15, at the Inn of the Black Walnut in Kitchener. 3. Consumers' Gas advises they propose no change in present level of rates now being charged to consumers of natural gas in the Township. ll!) REPORTS 1. William Saccoccio, Architect, advises of September 11, 1970 as date of occupancy of arena. Also, that the guarantee period for the building will not commence until the Betonite Exterior Wall Coating has been applied. $1,000.00 will be withheld until the three interior wood doors have been replaced and the calking completed. McCarten, President, Rosebank Ratepayers' Association, making reference to Council's grant of $30,000.00 for a teen-age clubhouse for erection in the Bay Ridges area, also making reference to a similar need for the teen-agers in the East and West Rouge areas. 2. West Rouge Canoe Club acknowledges Council's generous grant of $30,000. for a teen clubhouse, requesting Council's considera- tion for a similar donation towards a new clubhouse. Ins~ruction: Copies of correspondence to members of Council. - 3 - (VI) RESOLUTIONS Resolution #337/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor D. Kitchen that Mr. T. W. Beddall and Mr. W. Saccoccio be invited to submit preliminary designs for a Swimming Pool to be located at the Arena or other sites; that the cost of the pool be approximately $350,000.00; and that the successful Architect be asked to submit preliminary cost estimates of a pool of standard and olympic size for cost comparison purposes, as recommended by the Standing Committee on Parks and Recreation, August 31, 1970. CARRIED Resolution #338/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor D. Kitchen that the tender of Pinecone Wood Products in the amount of $2~594.00 be accepted for a snack bar for the Arena and that the price be subject to a delivery date which should not be greater than three weeks, as recommended by the Standing Committee on Parks and Recreation, August 31, 1970. CARRIED Resolution #339/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor D. Kitchen, that the two entrances at the arena be paved immediately (up to the Westerly limits of building) and that suitable crushed stone be put on the Parking Lot area, as recommended by the Standing Committee on Parks and Recraa'tion, August 31, 1970. CARRIED Resolution #340/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor D. Kitchen, that the rates for the Arena be accepted as they stand for the winter season and that the rates be reviewed at April 1st, 1971. Kitchen, that subject to suitable agreement with the School Board as to costs involved, Mr. Bass shall initiate the hiring of Ed Grant as $25.00 a night to develop recreational programs at Dunbarton High School, as recommended by the Standing Committee on Parks and Recreation, August 31, 1970. CARRIED Resolution #343/70 MOVED by Councillor Mrs. J. McPherson, seconded by Councillor D. Kitchen, that McKee Doors drop the restocking charge and install the required door openers and the suggested safety bars and controls as per our specifications for ~2,119.30, in the New Fire Hall, and that the Township shall not be held responsible for any previous verbal or written commitment. CARRIED Resolution #344/70 MOVED by Councillor J. Kruger, seconded by Councillor D. Kitchen, that the Personnel Manager be authorized to purchase one Gestetner 466 Electric Continumatic Inking Maching at a cost of $1,266.30 and one Gestetner ES390 Electronic Scanning Machine at a cost of $l,235.72, as recommended by the Committee of the Whole Council in Personnel, September 10, 1970. E. ~ttinger be adjusted effective September the 1st in accordance with the instructions of the. Committee of the Whole during their meeting of September 10, 1970. CARRIED Resolution #346/70 MOVED by Councillor R. Chatten, seconded by Councillor Mrs. J. L. McPherson, that a 10 foot widening be purchased across the 110 foot frontage of the property of Mrs.V.Parlette in accordance with the Option to Purchase dated August 31, 1970, signed by Mrs, V. Parlette and the Township Engineer as Trustee on behalf of the Township, as recommended by the Standing Committee on Public Utilities, September 2, 1970. McPherson, that an item be included in the 1971 Capital Forecast to cover the cost of constructing a sanitary sewer from Liverpool Road easterly on Bayly to the west boundary of the Hydro Electric Power Comm1~ion, as recommended by the Standing ~ommittee on Public Utilities, September 2, 1970. Chat ten, that whereas the needs for a recreational facility as outlined in a report presented to Council in Committee of the Whole by Mr. Paul Hariton cannot be challenged, the Council resolves as follows: A. Approve in principal of the provision of funds for the construction of a Teen Club House on a site to be approved by Council. B. That the budget figure of $30,000.00 be provided for the year 1970 ~o be requisitioned from the Township Dump account and controlled by the TOwnship Parks and Recreation Department. Ashe, that the Bay Ridge~ L~ Sports Association be permitted to sell Hallowe'en'çandies within the Township of Pickering on Saturday, October 24, 1970, between the hours of 9 ~_m. and 6 p.m. CARRIED Resolution #354/70 MOVED by Qouncillor D. Kitchen, seconded by Councillor J. Kruger, that the refreshment Vehicle By-law, being a by-law to license, regulate and govern vehicles from which refreshments are sold for consumption by the public, as amended be approved, as recommended by the Standing Committee on By-law, September 9, 1970. CARRIED Resolution #355/70 MOVED by Councillor D. Kitchen, seconded by Councillor J. Kruger, that the Dog Licensing By-law, as amended, be approved~ as recommended by the Standing Comaittee on By-law, öeptember 9, 1970. CARRIED 7 Motions - TABLED 1. Township to institute proceedings for a Court injunction against Mr. H. Burton. Moved by Councillor Rudik, seconded by DepQty Reeve G. Ashé that the action proposed by Council for a Court injunction against Mr. H. Btlrton be tabled, and further, that Mr. Burton submit to Council evidence of carrying on the business of selling machinery prior to the passing of the Township zoning by-laws. CARRIED 2. Moved by Councillor Kruger, seconded by Councillor Rudik, that the motion directing the Clerk to prepare a by-law for the construction of a swimming pool on the arena site be tabled until such time as additional information is acquired as to availability of an alternate site and soil tests are made on the proposed sites. CARRIED jVII) BY-LAWS By-Law Number 3870/70 - Third Reading The Committee of the Whole arises and reports the By-law as read. Councillor R. Chatten, seconded by Councillor V. Rduik, moves that the report of the Committee of the Whole on By~w Number 3870/70 to authorize the construction of watermains in the Altona local improvement area as local improvements of Section II and 67 of The Local Improvement Act, be adopted, and that the said By-law be now read a Third Time and PASSED, that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-Law Number 3871/70 - Third Reading The Committee of the Whole arises and reports the By-law as reQd. Councillor R. Chatten, seconded by Councillor V. Chatten, moves that By-law Number 3880/70 to authorize the execution of an Agreément of Purchase and Sale be now read a second time, and that Council go into Committee of the Whole thereon. Councillor V. Rudik, seconded by Councillor J. Kruger, moves that By-law Number 3881/70 to confirm the proceedings of the September 21st 1970 Council meeting be now read a second time, and that Council go into Committee of the Whole thereon.
