Ashe, seconded by Councillor Mrs. J. L. McPherson that the minutes of the Council Meetings held on March 16 and 23, 1970, be adopted as presented. CARRIED DEPUTATIONS Moved by Councillor V. Rudik, seconded by Councillor Mrs. J. L. McPherson that Mr. J. Satnik of Fairport Road ,North be heard. Mr. Satnik appeared before Council to request Council to recon- sider his application to the Committee of Adjustment to divide his holdings into three separate parcels of land. His applica- tion was refused on the grounds that the drainage course which runs diagonally through the front of his lands made it undesirable for subdivision, resulting in a portion of his land being recommended for greenbelt zoning. He contends that the drainage was diverted from the ditch through his property some years ago by the former Roads Superintendent. He has 6 acres of land on which are located two homes. It is his wish to separate these homes on individual lots and provide a third lot for sale as a residential building lot. He further contends that sufficient high land is available for the third house. The Council felt that due to the lack of information that the matter should be referred to the Public Utilities Committee for consideration. 1. 2. Review the report of the Committee of Adjustment. Review the Engineer's report. (Copies of both the above reports to be supplied to each member of Council.) Site visit be made to the property. 3. Moved by Councillor Rudik, seconded by Deputy Reeve Ashe, that Mr. N. W. R. Boyes of Manning, Bruce, MacDonald and MacIntosh, S.licitors for Kuno Stockelbach, be heard. Mr. Boyes appeared before Council to request an amendment to the February second Council minutes on the grounds that tAey did hot contain the tru$ in~rpretatiQn of the request made by Mr. Beyes on behalf of his client, Mr. K. E. &toçkelbaçh. Mr. Boyes f~her requested Council to confirm that his client's applicat:i.on for a rezoning to lift the nHn zone had been refused. The Council contended that the application was not refused but rather certain conditions were required to make it valid, and pointed out that if Mr. Stockelbach deeded to the Township the 10 ft. of his land along the west side of Liverpool Road ~or future road widening (free and clear) the application would be granted. Until this one condition is met, Council could not agree to approving, the application. It was pointed out that~. Stockelbach has the alternative of appealing the decision to the Ontario Municipal Board. - z. - 8/70 1. 2. 3. lIV 1. 2. SPONDENCE The Victorian Order of Nurses, South Ontario County Branch, in submitting a review of the nursing service provided in Pickering Township in 1969, requests Council to renew the agreement for Homemakers and Nurses Service Act for 1970. Copies to Council. The Metropolitan Toronto and Region Conservation Authority advises representatives will meet with the ratepayers re Project C.A.-60, Frenchman's Bay, on April 9. Meeting is to be at the Rosebank School, 8 p.m. The meeting of the 9th has been cancelled due to the scheduled meeting the same night with the Hon. D. McKeough. An alternate date has been set for Aprill7 at 8:00 p.m. at the Rosebank School. The Council made reference to the forthcoming meeting with the Hon. Darcy McKeough at the Woodland Centennial School and Regional Government. They expressed concern with the direction the O.A.P.A.D.S. Study was gQing in t~t the study was not taking into consideration the alternatives available to the Township of Pickering. The Council felt that they should consider a meeting to re-assess the Township's position and to make an analysis of the viable alternatives, bringing these to the attention of the study group. The matter was left for further consideration until after the meeting with the Hon. D. McKeough on April 9, 1970. The Ontario Department of Health advises steps were taken to bring the O.W.R.C. and Ontario C&unty Health Unit together to assess the Pickering Beach area quality of well water situation objectively. They agreed there was no cause for general alarm at this time; individual hOd1ð<>"uer& are being advised by the Health Unit where corrective action is recommended. Further, the Health Unit will conduct a continuing survey in consultation with the Provincial Department of Health and the Ontario Water Resources Commission. Copies to Council. The Cammittee of Adjustment is withholding applications - they wish direction from Council as to whether these should be handled in the normal manner. The Council entered into considerable discussion on the future development of Pickering Beach and concluded after a variety of opinions that Council had no option but to grant the applications, leaving it up to the Committee of Adjustment to use its best judgement in dealing with each individual application. The Committee of Adjustment should proceed under the normal procedure and work closely with the Ontario County Health Unit. INFORMATION Mr. H. Wank, P. Eng. forwards carbon copy of letter addressed to His Worship Mayor D. G. Newman of Whitby Township, express- ing his appreciation for the able manner in which he chaired the Seminar Meeting Program held at Eastdale Collegiate in Oshawa on March 14. He did suggest that panel discussions may have helped participants to fill out the questionnairs. See Resolution #128/70. The Township of Scott forwards a copy of their resolution with- drawing their Assessment Appeal which was lodged with the Ontario Municipal Board. See Resolution #129/70. Clerk to arrange for a meeting with the Hon. D. McKeough. Mr. J. Faulkner, Planning Director, advises re the Richard L. Hearne Generating Station and Sulphur Dioxide pollution. See Resolution #130/70. f The Department of Municipal Affairs forwards reminder to Municipalities to file their 1969 Municipal Financial Statements before the March 31 deadline. The Department will consider penalizing for late filing. Mrs. Ruby Fenton, President, Pickering Township Progressive Conservation Association, advises that the Hon. Darcy McKeough will be speaking, along with a panel, on regional government in the Woodlands Centennial School on April 9 at g:OO p.m. Copies to Council. Mr. James A. Taylor advises he has received an appointment for the hearing of Restricted Area By-law 3692 (Stavro). The hearing is set for April 21, 1970, 10 a.m. at the Township Municipal Building. Mr. James A. Taylor, Township Solicitor, forwards a copy of the Decision of the Ontario Municipal Beard re Township of Uxbridge Restricted Area By-Law 1517. The Board did not approve those parts of the Official Plan and Zoning By-law relating to the areas of objection concerning gravel pits. The Township of Uxbridge Solicitor has indicated they would amend their Zoning By-law to accommodate the Pickering Township pit. Clerk to request that Mr. J. A. Taylor be present on Tuesday, April 7 at 8 p.m. to provide his views on Provincial versus Municipal control over gravel pits. The Department of Transport advises re the spraying against mosquitoes in the Frenchman's Bay area, that they require a written request from the Township to permit a waiver of Air Regulations allowing aircraft to be flo~m at altitudes less than normally permitted. See Resolution #131/70. The Planning Director forwards copy of letter sent to the Department of Municipal Affairs requesting that the Township be advised or their action with respect to the reports on Land Use Implications - D.H.O. Proposals for Highway 1401. Copies to Council. The Site Development Panel advises it is not in a position to resolve the problems with respect to Scott Laboratories, Part Lot 19, Range 3, and has referred the matter back to Council for resolution. 1. McPherson, that whereas by Resolution if181/69 the Council of the Township of Pickering entered a notice of intent to appeal the County of Ontario's By-law 2721 dated June 27,1969, a by-law to equalize the assessment of real property of the several towns, villages and townships in the County of Ontario; AND WHEREAS upon further consideration of the Township's position, with respect to cost to the ratepayers in seeking a reduction to the equalized assessment, the Council concluded that the Township withdraw its appeal; BE IT THEREFORE RESOLVED that the Council of the Township of Pickering hereby withdraws its appeal to the Ontario County By-law 272l dated June 27,1969; AND THAT the Township of Scott be advised of this Council's decision. Kitchen, that whereas sulphur dioxide pollution of the air is extremely harmful to plant and animal life; and WHEREAS the Ontario Hydro causes some 80,000 tons of sulphur dioxide to enter the air annually; and WHEREAS the Ontario Hydro's proposed 700' smoke stack will discharge the sulphur dioxide at an altitude which will not affect the residents of Metropolitan Toronto, but due to weather conditions, will descend mainly to the east of Metropolitan Toronto and may have a harmful effect on lakeshore municipalities in the Counties of Ontario, Durham, Northumberland, etc. BE IT THEREFORE RESOLVED as follows: 2) That the Township of Pickering lodge a strong formal objection with the Ontario Hydro regarding the Richard L. Hearne Generating Station and sulphur dioxide pollution resulting therefrom; That copies of this resolution be sent to all municipalities within 20 miles of Lake Ontario, east from Metropolit~ Toronto, up to and including Hastings County. 1) ..........Cont'd. - 6 - 8/70 3) That a monitoring system for sulphur dioxide be established without delay at the Rosebank Reservoir in conjunction with the Air Management Branch of the Department of Energy and Resources. CARRIED Resolution #131/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor R. Chatten, that whereas the ratepayers of the West Shore have requested that the Frenchman's Bay area be sprayed against mosquitoes; AND WHEREAS the operation involves the use of aircraft being flown at altitudes less than normally permitted under Section 529 of The Air Regulations; AND WHEREAS the Department of Transport requires a request from the Township of Pickering recognizing the inherent hazard in departure in safety regulations; BE IT THEREFORE RESOLVED that Council request the Department of Transport to grant the necessary waiver of the Air Regulations to permit spraying against mosquitoes in Frenchman's Bay subject to the Council agreeing to having the spraying performed. Kruger, that the Council of the Township of Pickering approve of the proposal as submitted by Drive-In Bazaars Limited to operate an Open Air Farmers' Market on the site of the Odeon Drive-In Theatre subject to: 1) Satisfactory financial arrangements being made (similar to the agreement reached with Vaughan Township). 2) Contract be for one year. 3) Drainage easements be provided through the Odeon properties to accommodate drainage from adjacent land. Kruger, that whereas the Councils of the Town of Ajax and the Township of Pickering have agreed to establish a Social Planning Council for this area; AND WHEREAS the Councils of the Town of Ajax and the Township of Pickering have agreed to share in the expenses of such Council to the extent of $15,009.00 to be apportioned -- $6,000.00 to t~e Town of Ajax, ~6,OOO.OO to the Township of Pickering and $3,000.00 to the County of Ontario; AND WHEREAS it is anticipated that the Social Planning Council wi¡l require additional staffing and accommodation in future years resulting in increased expenditures; BE IT THEREFORE RESOLVED that the Municipalities of the Town of Ajax and the Township of Pickering enter into an agreement setting out the terms of reference.
