Kruger, and carried unanimously, the minutes of the Council meeting of February 2, 1970, were adopted. J!!) - DEPUTATIOt@ 1. Moved by Councillor Rudik, seconded by Councillor Kruger that Mr. Chris Seens~ President of and representing the Youth Organization for Retarded Children, be heard. Mr. Seens appeared before Council to request their participation in the sponsoring of the Organization's closing banqu~t_~o be held on March 26., -,.' "\ ,.";, " nYouth Organization for Retarded Children" is a rel@.t-iyely new but thriving youth organization whose purpose is (If,~tõ encou~age and to facilitate the establishment of youth groups throughout the Province, ,;, (2) to make some positive headway in the area of public education, (3) to increase the quality of youth volunteer work by developing an active means of exchanging ideas, and (4) to provide teamwork between youth groups and local associations, especially to ensure that activities complement each other rather than conflict. His own group directs activities to work with the mentally retarded in the Pickering, Whitby and Ajax areas. In requesting Council's support of the closing banquet, he explained that this was an annual convention which is held to expound the ideas and principals of the Organization throughout the Province. The local group was hosting the convention and anticipated a catering cost of approximately $900.00 for the banquet in question. Mr. Seens asked that Council consider assuming one-third of the cost of this dinner. See Resolution #60/70. Moved by Councillor Kruger, seconded by Councillor Rudik, that Mr. R. Mason be heard. 2. Mr. Mason, a resident of Pickering Beach, appeared before Council to speak on a recently published O.W.R.C. report dealing with the pöllution of the wells in the Pickering Beach area. He emphasized the serious nature of the plight of the area and pointed to the conclusions of the O.W.R.C. report in which it stated ~at serious consideration should be given to provide the P1~J(éring Beach a.r~,with water and sewage services in the immediat~\future. ': '.. '1 l\ .. /," '/,.,' It was pointed out to Mr. Mas6n that the nature of the terrain in the area is such that the instalation of sewers would be totally ._' .. -." - 2 - 4/70 uneconomical. While admitting that the instalation of water to the area would aggravate the sewage problem, Council agreed that they had a moral obligation to the residents in the area. It was suggested that the entire question be referred to the next p.U.C. meeting for consideration of the problem. At this meeting, they sho~ld also encompass the plight of the residents of Wqodview Avenue North and the Squire's Beach area. IJ;!!l-QQRRESPQNDENCE 1. 2. 3. 4. The Squire's Beach and Community Ratepayers' Association expresses concern regarding any dredging operations that may arise from the proposed Marina at Duffins Creek and request comments from Council. Letter read in open Council. Referred to the Road Committée. Council noted that this entire question had been referred to the Department of Mines and Resources who had indicated that the matter would be checked on receipt of a formal application for a license covering the dredging operation. Council wondered whether the Department was aware of what happened in the late 50's following a similar operation and suggested that the Clerk contact them and consider the item in light of previous experience. , The Squire~ Beach and Community Ratepayers' Association req~ests improvement be made to the ditching in this area. Letter read in open Council. Referred to the Road Committee. The Squires Beach and Community Ratepayers' Association requests stop signs be placed at Squire's Beach Road and Montgomery Park Road to resolve the traffic problem in this area. Letter read in open Council. Referred to the Road Committee. It was suggested that representatives from the area appear at the next Road Committee to discuss the above problems. The Ontario Water Resources Commission, upon completion of a survey of the wells in the Pickering Beach area, forwards their report recommending that consideration be given to provide water and sewage services in this area. iIYI-- INFORMATION Referred to the Public Utilities Committee. 1. 2. ~ 3. 4. Council expressed concern over the fact that the Architect was unable to get a firm commitment from the contractor dealing with the completion date of the facility and the final cost of the suggested additions to the contract. The matter was referred to the Parks and Recreation Director with the instructions that he get some answers soon. Mrs. Bean of Lakecrest Drive requests consideration for snow- plowing of public non-assumed road in Pickering Beach area. Referred to the Road Committee. Residents of East Rouge and West Shore re snowmobiles, wish to be advised in order to make representation on this matter, should a by-law be considered. Rudik, that the Township of Pickering agrees to permit a three- day deer shoot on November 2, 3, and 4, 1970, and that the hunters be permitted to hunt with shot-guns only -- no dogs. Kruger, that this Council does hereby endorse the recommendation of the Pickering Township Planning Board on February 5,1970; and,hereby directs that the application (A 23/69) to amend the zoning ,of the subject property, known as: The northerly l38.37' of the $outherl~ 3l04.99' of the easterly 283.76' of the westerly 300.9l' of Lot 35, Concession 8; by a specific exemption to permit the er~ction of a residence with l,300 sq. ft. to 1,500 sq. ft. of gross floor area, whereas the by-law requires a minimum of 2,000 sq. f~. habita~e floor area; be REFUSED on the grounds that it is con- sidered a convenience only, not in keeping with the development of the surrounding area, it will not assist the financial difficulties of the Municipality, and is therefore not a benefit to the Municipality. Rudik, that whereas the municipal governments of Ontario have enjoyed authority under the Ontario Municipal Act and The Planning Act to plan, zone and regulate land uses for the orderly development of their communities, the resolution of conflicting interests, the protection of existing uses, and their ratepayers' quiet enjoyment of their properties; AND WHEREAS The Ontario Municipal Act and The Planning Act have proven effective instruments for these proper pursuits; AND \VHEREAS The Department of Municipal Affairs, The Minister of Municipal Affairs and the Ontario Municipal Board have provided equi~able and effective channels for the resolution of conflicts among land users which -e-oul.d not--,~, resolved..-.a~municipal level; AND WHEREAS the concentration of population, developing municipalities and urban growth in this Province mainly coincide with the geological pattern of sand, gravel and other aggregates deposi:ts, whi ch ,are of increasing value and importance in con- struction and industry; AND WHEREAS the enjoyment of homes and municipal amenities, &he pursuits of business and industry, the conduct of farming, and the safe and healthy lives of citizens are disturbed, hindered and endangered where the operation of pits and quarries is con- ducted in inappropriate locations or in too close proximity to other land uses; ~' AND WHEREAS the operation of pits and quarries without proper planning and adequate safeguards and definitive programs for the rehabilitation of excavations, creates real and potential conditions for disturbance and pollution of ground waters, erosion of agricultural lands, and the serious disruption of residential amenities, recreational facilities, and the depletion of neighbouring land values; AND WHEREAS, notwithstanding these conditions, the aggregate producers and other operators of pits and quarries in Ontario have persuaded the Mineral Resources Committee to the Minister of Mines to recommend to the Minister, and through him to the Government of Ontario, drastic and fundamental changes in constitutional powers in the Province; \ J AND WHEREAS, in accordance with the requests and recommendations of these aggregate producers, the Minister of Mines has publicly stated his intention to seek such changes; AND WHEREAS, in particular, the said Mineral Resources Committee to the Minister of Mines have recommended in Appendix 1 of their Report of September 1969 "Amendments to the Planning and Municipa Act", particularly to: ..~ þ': ..... ,,/ " " ... 5 - ". 4/70 iq 1) Repeal clausèa 118 and 119 of subsectiOlLJIl:Óf Section 379 of the Municipal Act which gives municipalities the power to pass by-laws regulating and in some specific instances the power to prohibit, the operation of pits and quarries. .(2) Repeal clause 6 of subsection (1) of Section 30 of the Planning Act. This clause permits municipalities to pass by-laws prohibiting the establishment of pits and quarries within the municipality or within any defined areas thereof. vI and have proposed Amendments to Section 30 of the Planning Act which would allow the Minister of Mines to review the zoning of pits and quarries. BE IT THEREFORE dESOLVED, 1. That this Council of the Municipality of th',Town~hip of Pickering is unanimously opposed to such changes 1n The Municipal Act and The Planning Act as are recommended by the Mineral Resources Committee to the Minister of Mines because such changes are unwarranted, pre-emptive and would create a fundamental and intolerable precedent for the erosion of municipal ?uthority and planning powers now guaranteed to municipal governments by The Municipal Act and The Planning Act; That this Council is further unanimously opposed to such changes in The Municipal Act and Planning Act because t9~ would transfer from the Minister of Municipal Affairs a~çi':' his Department to the Minister of Mines and his Department, powers and authority which should remain with the Department established in the interests of municipalities rather tþan be transferred to a Department established in the inter~sts of one particular segment of the economy; 2. 3. That the Clerk of the Municipality of the Township of Pickering be instructed to forward a copy of this resolution to the Honourable John Robarts, Prime Minister of Ontario, to the leaders of the two opposition parties in the Legislative Assembly, Robert F. Nixon (Brant) and Donald C. MacDonald (York South), and to the local members of the Legislative Assembly, Matthew B. Dymond (Ontario) and William Newman (Ontario South), and that a copy of the resolution endorsed be sent to the Township of Uxbridge, CARRIED Resolution #64/70 MOVED by Deputy Reeve G.Ashe, seconded by Councillor Mrs. J.
