Rudik, that the m~nutes of the Council meeting held on October 1969, be adopted as presented. CARRIED I~_ DEPUTATIONS 1. Moved by Councillor D. Kitchen, seconded by Councillor A. King that Mr. P. N. Spencer be heard. Mr. Spencer, appearing on behalf of the Picketing Township Tennis Association inquired from the Council whether Counci! could provide lands for locating two tennis courts. He advised that their Association has about 50 members both young and old, with no public courts available. It was suggested that ~r. Spencer contact the local Parks Board and request them to budget for this project next year. Also, he was referred to the County School Board and to inquire into the possible use of the Dunbarton High School courts on week-ends as it would seem these are not used either on Saturda]~ Sundays or holidays. Instructions - Clerk to inquire from County School Board as the availability of these courts for public use. 2. Moved by Councillor J. Kruger, seconded by Deputy Reeve Chatten that Mr. S. Rumm of Consolidated Building be heard. Mr. Rumm, appeared on behalf of representatives for F.. & Contractors, purchasers of Lots ~2 and ~3, Plan M-lO6 who purchased the properties in question on the understanding that the Township would permit semi-detached dwellings. Mr. Rumm made reference to a repo~ which Council directed the Planning Depa~ment to prepare on the history of these lots and wondered whether he m~ght have a copy. However, Council rejected this request suggesting that Mr. Rumm provide evidence that would substantiate his claim that these lots were ever des~gaated as semis rather than single dwelling lots. Mr. Rumm requested a deferral of Council ts decision for three to four weeks to give him an oppox~unity to seek out the informa- tion he requires. Council members were of the opinion that no commitment was ever made by Council that these lots were to be semi-detached. Under the circumstances, Council granted the deferral. Mr. Rumm suggested a new proposal, providir~g for three single dwellings. They extend thanks to the Township for their interest and consideration in this~ regard. 2. The Department of Highways advises they have now received approval of their functional study of Highway 401 from ~arkham Road easterly to Oshawa West Limits, and all recommendations m~de by the Township Council concerning future interchange locations have been accepted and incorporated in the recommended design. On October 22, 1969, they are holding a meeting for the purpose of making a formal presentation of their functional plans to all municipalities involved, to give them an qpportunity to review the plans and indicate their approval and/or comments by ~ resolut ion. Clerk to verify time of day meeting to take place and to advise Council. (Meeting scheduled for 9:30 a.m, - Engineer will be attending and will report back to Council). 3. The Town of Ajax has indicated they are interested in discussing the proposal which the Township ia negotiating wi~h ~etro. Toronto concerning refuse disposal (sanitary landfill site),, and recommends that as much information as possible be developed at the engineering level before a meeting of the respective Councils is called to further discuss this proposal. ~ Copies to Council. See Resolution ~287/69. 4. Mr. G. Coupland of Altona Road advises that horses are being kept in a stable of the property adjacent to his, the stable being 150 feet from his house, and requests for reasons of health and devaluation of property that steps be taken to~. have these horses removed. Referred to the By-Law Enforcement Department. 5. The Ontario Humane Society forwards copies of a pamphlet put out by the Society concerning Bill 195 which is presently before the Ontario Legislature. Kruger, that this Council does hereby endorse the reco~_~endat, ion of the Pickering Township Planning Board on October 9th, 1969; and hereby directs that the application (A 13/69) to permit the outside display and storage of new and used cars in conjunction with a new and used car dealership and the existing auto body shop; on property known as the Northerly $35 feet of the Westerly 100 feet of the Easterly 500 feet of Lot 15, Range 3; be REFUSED on the grounds that such commercial operation is not considered compatible with the future industrial development of Bayly Street. Kitchen, that this Council does hereby endorse the recommendation of the Pickering Township Planning Board on October 9th, 1969;'and hereby directs that the application (A 12/69}, to permit the erection of a Christian Meeting Hall on a parcel of land having 20,0OO square feet in area (Lots 3 & $, Plan 392) be REFUSED on the grounds that the lot size is inadequate for the proposed use. King, that this Council does hereby endorse the recommendation of the Picketing Township Planning Board on October 9th, 1969; and ~ hereby directs that the application (A 17/69), to amend the ~' Zoning By-law 1978 by a specific exemption to permit the erection of an industrial building on a parcel of land (Lots 18, 19, part Lot 6; Plan 5) which does not front on a 66 foot public street; be REFUSED on the grounds that development of this site for thee proposed use is premature without an area road pattern and municipal services. CARRIED Resolution #276/69 MOVED by Deputy Reeve R. Chatten, seconded by Councillor R. Mason, that Council proceed with the expansion of the Bay Road Sewage Treatment Plant to the limit set by the O.W.R.C. in the year 1970 as provided for in the 5 year capital forecast, as recommended by the Standing Committee on Public Utilities, October 8, 1969. Mason, that the Engineer be authorized to obtain a written opinion from the Township's Solicitor in respect to the status of Greenwood Road as it affects the $. E. CARRIED - 8- 26/69 Resolution -#279/69 MOVED by Councillor J. Kruger, seconded by Councillor R. Mason, that whereas a by-law to build an indoor swimming pool at the Woodlands Centennial School site has already been given two readings hy this Council; AND WHEREAS the conditions governing construction and control of the indoor pool were previously agreed as betw,,een this Council and the old School Board of School Area ~2; AND P~HEREAS the forementioned School Board in Area #2 is no longer a legal entity, but its understandings and agreements -are being carried on by the County Board of Education wherever this is possible; AND ~HEREAS the Ontario County Board of Education agreed in principle to follow through with intentions of the agreement between Council and the Old T.S.A. #2 Board (reserving the right to further negotiate some of the minor terms in regard to daily operation of the pool and the sharing arrangement for related operating costs). AND ~HEREAS Council applied to the Ontario Municipal Board for approval to issue debentures AND WHEREAS the Ontario ~unicipal Board rejected the application on the grounds that Council could not issue debentures for construction of a building on land which it did not own; AND ~EREAS Council by Resolution #158/69 resolved; (a) to ask the School Board to consider issuing the debentures and that Council would re-imburse the Board for the annual principal and interest payments; (b) to seek legal opinion on the feasibility of the above; (c) that the School Board consider the possibility of constructing the pool at the Dunbarton High School for the same cost as originally projected for the Woodlands site; AND WHE~S pursuant to the above resolution the following facts were established; (a) the cost of the pool as a free standing addition to either Woodlands or Dunbarton would be approximately the same; (bi the $35,000.00 designated by Old T.S.A. #2 School Board for the pool addition to Woodlands may not be available if the project was switched to Dunbarton; (c) sketch plans already prepared may have to be rejected and a new architect employed if the pool was changed from one school to another; (d) the Municipal Act permits a ~ouncil to enter into an agree- ment with a School Board for the repayment of capital charges for a recreational facility. BE IT THEREFORE RESOLVED as follows; 1. That Council request the Ontario Cowry Board of Education to concur with the addition of a pool to the Woodlands Senior School; 2. That if the above approval is obtained, Council will request from the Ontario Municipal Board permission to instruct the architect, T. W. Bedall. to proceed with working drawings in accordance with PlotPlan Si and Floor Plan S2 as attached to the agreement dated November 18, 1968, between the Township of Picketing and the Public School Board of the Township School Area of Picketing Township Area #2; ·...... ·.. That upon determination of the actual costs of construction Council will pass a by-law settin~ out its intention to enter into an agreement with the Ontario County Board of Education for the repayment of principal and interest on debentures to be issued by the School Board for the above noted costs and that this by-law would then be submitted to the Ontario Municipal Board fo~ approval; $. That the Committee of Council and the County School Board set up for the purpose of constructing this pool, then be asked to finalize an agreement for the repayment of the : debenture costs and the daily operation of the pool. Kruger, that the Council of the Township of ~ickering approve the concept of the condominium development as presented by Consolidated Building and further recommend to the Minister of the Department of Municipal Affairs the approval of the plan in this location (Block J, Plan M-17) subject to Consolidated Building Corporation entering into a satisfactory agreement with the Township, as recommended by the Committee of the Whole Council, October 16, 1969. Kruger, that a committee of ome, from the Council level, be authorized to contact the Ajax Town Council, and further be authorized to form a committee to disc,~.ss joint use of municipal services; and further, that Reeve Williams be the Township representative in the preliminary work to the establishment of the joint committee, as recommended by the Standing Committee of the ~nole Council, October 15, 1969. CARRIED Resolution ~288/69 MOVED by Councillor R. Mason, seconded by Councillor J. Kruger, that the Township Council endorse the proposed establishment of a Manpower Centre in the Ajax-Picketing area; AND FURTHER, that the Industrial Commissioner be instructed to contact all industries within the Municipality of the Township of Picketing advising them of the locating of a proposed Manpower office and requesting that they submit to the Township effices their comments with respect to same, as recommended by the Standing Committee of the Whole Council, October 15, 1969. Kruger, that the question, on Fluoridation of Municipal ~ater be put to those people living in the Township water area created by Board Order ~P-2167-66 in the forthcoming Municipal Election, as recommended by_the Standing Committee of the W~ole Council, October 15, 1969. CARRIED - IL - 26/69 Resolution ~290/69 MOVED by Councillor A. King, seconded by Councillor R. Mason, that whereas the Council of the Township of Picketing has by By-law 1058 dated December 11, 1915, made application for borrow- ing for purposes of issuing debentures for tile, stone or timber drainage; AND WHEREAS the said By-law 1048 provided for a maximum of $10,000.00 for this purpose; AND WHEREAS the applications, completed and still in process, exceed this amount by $3,000.00; AND WHEREAS it is anticipated that further applications will be applied for: BE IT THEREFORE ENACTED by Council that By-law 1058 be repealed; and further, that the Clerk be instructed to prepare and process in accordance with the Tile Drainage Act an application to the Provincial Treasurer for authority to borrow for purposes of issuing debentures for tile drainage loans, a by-law not to exceed an amount of $100,000.00; AND FORTHER, that the Clerk publish the notice in the five local newspapers with general circulation in this Municipality, of the Council meeting at which said by-law will be passed. Rudik, that Eastern Stand~.rd Time, become effective in the Township of Picketing on October 26, 1969 at 2 a.m. and that same be advertised in the local papers. CARRIED Resolution #292/69 MOVED by Councillor V. Rudik, seconded by Deputy Reeve R. Chatten, that whereas Mr. Aubrey J. Carson and Mrs. Clara M, Carson have under date of October 8, 1969, applied to the Council of the Corporation of the Township of Picketing for a loan under the provisions of the Tile Drainage Act; AND WHEREAS By-Law Number 10/+8 of the Township of Pickering authorizes the Council to borrow upon the credit of the Corpora- tion such sum or sums not exceeding $10,000.00 to assist land owners with drainage projects; AND ~HEREAS the necessary funds will be raised by the issuance and sale of debentures to the Treasurer of Ontario and the said debentures are not a charge against the credit of the Corporation; BE IT THEREFORE ENACTED that the Clerk be authorized to apply to the Treasurer of On~r. ario for the purchase of debentures in the amount of $4,000. O0; THAT upon receipt of the approval of the Treasurer of Ontario to the purchase of these debentures, the Treasurer of the Township of Pickering is hereby aut2aorized to advance the said $4,000.00 to Mr. Aubrey J. Carson; AND THAT the necessary By-law be drafted in accordance with the provisions of the Tile Drainage Act to provide for the levying of an annual rate over and above all other rates on the property of the said Mr. Aubrey J.
