Ashe, seconded by Councillor Mrs. J. L. McPherson that the minutes of Council of their meeting of October 18th, 1971, be adopted as presented. CARRIED DELEGATION Moved by Councillor V. Rudik, seconded by Councillor Mrs. J. L. McPherson, that Mr. Donald Williams be heard. Mr. Williams, substituting for Mr. Bill Spenceley, President of the Ontario Federation of Snowmobile Clubs, read a letter written by Mr. Spenceley on behalf of The Ontario Federation of Snowmobile Clubs. ONTARIO FEDERATION OF SNOWMOBILE CLUBS 1525 O'Connor Drive, Toronto 16, Ontario October 27,1971. Pickering Township Council, Township Offices, Pickering Township, Ontario. Reeve John Williams and Members of Council: It had been my sincere hope to address you personally tonight on the 'subject of snowmobiles in Pickering Township. However, a previous appointment for a meeting in TorOnto tonight, makes it impossible for me to attend. The Dunbarton Snowmobile Club has brought to my attention that consideration is to be given to amending the present by-law, . so as to ban snowmobiles from all township roads, or restrict the use of them to the "boulevards Ii . Qf . roads. At the outset, I wish to point out that I fully re~¡~Je the quandry municipal councils face in legislation për~ taining to snowmobiles. The Provincial Legislation leaves the mùnicipality optional, but .with broad prov~sions, without definition. As a member of Peterboròugb City Council for five yeàrs, I sympathize with you, having struggled with this same proDlem in Peterborough. I have had the opportunity to study your present snow- mobile by-law, which I understand was prepared in con- sultation with the Dunbarton Club. I find as it exists presently, both fair and equitable to all interests. It does not surprise me that the Dunbarton Club played so ac~ive a role.in its preparation. As recently as April of this year, I had the distinct pleasure of pre- sen~ing the club the President's Citation, as the out- standing snowmobile club in the province! ..........Continued - 2 - 32/11 Just over a week ago, delegates of our eighty member clubs, which represent close to twenty-five thousand snowmobilers, held a Fall Review Convention. A resolution was unanimously approved which will shortly be presented to Premier Willia)ll Davis, all members of his Cabinet and all members of the Ontario Legislature. This resolution calls for immediate standardization of municipal by-laws in respect to snowmobiles, throughout the province. Or, failing this, that the optional authority to pass such by-laws be combined with the provision of a carefully researched and prepared set of guidelines. There is little or no similarity among any of the by-laws now in existence in Ontario. Hence, a snowmobiler visiting another community may be breaking the law, by an action which is quite legal in his home municipality. Picture and compare the unfair confusion resulting if this situation existed in the use of motorcycles, bicycles or automobiles. At present, a legal action in one municipality, clearly violates the law in another. I am informed that the motivation for a proposed amend- ment to your present by-law, is a concern for the safety of snowmobilers. Who can dispute this admirable motive? However, I am similarly informed that there has never been a snowmobile fatality in Pickering Township and that further, only one relatively minor, personal injury was reported last season. Certainly, this is an outstand- ing record and one that deserves every effort to preserve. However, I must point out that either alternative amend- ment proposed, would in fact, endanger the snowmobiler! To restrict his movement along a boulevard, would in effect be banning him from use of any portion of the road. The boulevard is almost invariably impassable because of banks of snow from road clearing operations. Further, the boulevard is normally marked with holes, varying levels from lanes and the very real threat of decapitation from guy wires supporting hydro and tele- phone poles! While at least more honest an approach, a complete ban from roads would be.a form of enforced encouragement to trespass--over fields and through unknown yards with barb wire fences, rocks, stumps, trees, etc. Certainly, with the enviable safety record ~njoyed by Pickering Township, it would appear tragic to jeopardize it and the safety of snowmobilers through a misguided, albeit well intentioned amendment. A more positive approach to preserving a near unblemished safety record, would seem to be the encouragement of membership in a snowmobile club. The record of such clubs as the Dunbarton, Pickering and Ajax Clubs, speaks for itself. As to the Ontario Federation of Snowmobile Clubs, we are justifiably proud of the fact that since our inception in 1966, there has never been a snowmobile fatality within a member club. Snowmobiling is a fast growing recreation. Just seven years ago, in 1964, there were only 5000 snowmobiles in all of North America. This season will see a quarter of a million in Ontario. Ernie Taylor of the Ontario Safety League, estimates that as many as one million persons use a snowmobile to some degree through the winter. That's nearly one in every seven in this province! The snowmobiler asks no more, but certainly no less, than any other citizen. He is aware that there rs-a minority of irresponsible users and tfirough clubs, is making every effort to control the mavericks, deploring their actions perhaps even more than our severest critics, since his actions reflect upon all snowmobilers. ..........Continued (III) 1. (IV) 1. 2. 3. - 3 - 32/71 The Ontario Federation of Snowmobile Clubs has over the years, worked closely and harmoniously with the Ontario Department of Transport in bringing about snowmobile legislation, fair to all citizens, both user and non-user. We are confident, that the government will seriously consider our proposal to standardize municipal snowmobile by-laws as the option of the individual municipality to enact, or not to. I would urge this council to not take hasty action, prior to the submission of our resolution to the government and its due consideration. Respectfully, Wm. Toronto Mardi Gras Society, is planning a Mock Kidnapping, a Parade and Dance for November 20, 1971. The "victims'! of the Kidnapping will be the elected members of Council, and will be escorted from the Municipal Building at 3:30 p.m. in a Parade visiting the G.O. Transit Station, Liverpool Rd., Tatra Dr., Krosno Blvd., Morden Lane, Reytan Blvd., Drava St., Sandy Beach, Baseline, and Brock Road to the Township Arena. 4. 5. The Ontario Good Roads Association advises of its 78th Anniversary Convention to be held at the Royal York Hotel, Toronto, February 21, 22, 23, 1972, and requests resolutions and proposals of names for recognition of long service in the cause of Good Roads. The Oshawa-Ontario County District Health Unit advises that'::'1e staff of the X-Ray Clinic and Testing Centre will be conducting a Glaucoma testing clinic at the Rouge Hill Community Centre on November 15, 16, 25, and 26 from 9:30 a.m. to 12:00 noon and 1:00 p.m. to 4:30 p.m. each day. The Council expressed their views with respect to the hours and dates and location for the Glaucoma Testing Clinic suggesting that these were not the most convenient to the majority of the residents of the Township and that perhaps in future a location in close proximity to Bay Ridges should be given serious consideration. Also, since the clinics are scheduled on days and at hours during the day when most people are at work or school, certain evening hours and possibly a Saturday should be placed on the schedule. - 5 - 32/71 Instructions - The Clerk to write the Oshawa-Ontario County District Health Unit requesting changes in location scheduling of hours to convenience the bulk of residents. (VI) RESOLUTIONS Resolution #423/71 MOVED by Councillor R. Chatten, seconded by Councillor D. Kitchen, that the tender of Craftwood Construction in the amount of $287,322.70 be accepted for the Sheridan Mall services, subject to the Township Engineer's approval. CARRIED Resolution #424/71 MOVED by Councillor J. S. Scott, seconded by Councillor R. Chatten, that the Workmen's Compensation on the Township volunteer firemen be increased to $9,000.00, as recommended by the Standing Committee on Fire, October 13, 1971. CARRIED Resolution #425/71 MOVED by Councillor Mrs. J. L. McPherson, seconded by Councillor J. S. Scott, that the Borough of Scarborough be advised of the Centennial Ratepayers' request for a foot-path on Lawrence Avenue from Port Union Road to the West Rouge G. O. Train Station and for the paving of the same section and that whereas the Township have already arranged for the paving of the road and whereas a foot- path could not be justified in relation to other Township priorities that the Borough be informed that this Council will agree to the installation of a foot-path provided the Borough agrees to pay the cost of such installation, as recommended by the Standing Committee on Roads, October 19,1971. CARRIED Resolution #426/71 MOVED by Councillor Mrs. J. L. McPherson, seconded by Councillor J. S. Scott, that the Reeve and Clerk be authorized to sign the Ajax Agreement as amended and that it be forwarded to Ajax Council for execution (Water and Refuse Disposal), as recommended by the Standing Committee on Roads, October 19, 1971. CARRIED - 6 - 32/71 Resolution #427/71 MOVED by Councillor' Mrs. J. L. McPherson, seconded by Councillor J.. S. Scott, that the By-law authorizing the installation of Watermains in Pickering Beach be expanded to include Lake Crest Drive, a non-maintained road allowance, since the status of the road allowance should not prevent the installation of improvements initiated on Public Health grounds, and that the Clerk be instructed to take the necessary steps to give effect to this resolution, as recommended by the Standing Committee on Roads, October 19, 1971. CARRIED The Clerk advised that application to the Ontario Municipal Board for this Capital Project has already been submitted for their approval and that to withdraw this application will create considerable delays, and suggested that this added street be handled as a separate project. The Council suggested that the Ontario Municipal Board be informed of the recommended change and whether notification by registered mail to those property owners affected would be sufficient to include them in on the previous application. Clerk to investigate. Resolution #428/71 MOVED by Councillor Mrs. J. L. McPherson, seconded by Councillor J. S. Scott, that the Engineer be authorized to install a street light on Merriton Road at the Police Station entrance, as recommended by the Standing Committee on Roads, October 19, 1971. CARRIED Council request Mr. P. Poulsson, P. Eng. to investigate the reason for removal of the street light at Highway #2 and Fairport Road and to request that this light be replaced. Resolution #429/71 MOVED by Councillor Mrs. J. L. McPherson, seconded by Councillor J. S. Scott, that the Metro-Toronto Conservation Authority be requested to confirm their opposition to a Sewage Treatment Plant location in the Petticoat Creek watershed, as recommended by the Standing Committee on Roads, October 19, 1971. CARRIED Resolution #430/71 MOVED by Councillor Mrs. J. L. McPherson, seconded by Councillor J. S. Scott, that the Minister of the Department of the Environment be requested to appoint representation from Pickering Township to the Metropolitan Toronto-Regional York Policy Liaison Committee, as recommended by the Standing Committee on Roads, October 19, 1971. CARRIED - 7 - 32/71 Resolution #431/71 MOVED by Councillor V. Rudik, seconded by Deputy Reeve G. Ashe, that the Township of Pickering By-law #3939/71 a by-law for regulating, governing and prohibiting the operation of motorized snow vehicles within the Municipality be amended to permit the operation of snowmobiles in those areas where the use of Township roads are not prohibited, that By-law 3939/71 be amended to permit -- 1. The crossing of Township roads at approximate right angles. Permit the use by snowmobiles on the boulevard portion of the Township road allowances. 2. 3. Boulevard as defined in the by-law. As recommended by the Standing Committee of the Whole Council in Open Session, dated October 25, 1971. CARRIED Recorded Vote: Yes: Mrs. McPherson, Messrs. Ashe, that the Township of Pickering By-law #3939/71, a by-law for regulating, governing and prohbiting the operation of motorized snow vehicles within the Municipality be amended to include all that area South of Finch Ave. extending in the West from the Pickering- Scarborough Townline, Easterly to the West boundary of Pickering Village, thence Southerly to the MacDonald Cartier Freeway, along the Southerly boundary of the Freeway Easterly to the Pickering Township - Town of Whitby Townline, as recommended by the Standing Committee of the Whole Council in Open Session, October 25,1971. Ashe, that the Council adopt the report on Local Government subject to the minor amendment being made and present to the parties concerned, as recommended by the Standing Committee of the Whole Council in Open Session, October 25,1971. CARRIED Resolution #434/71 MOVED by Councillor V. Rudik, seconded by Councillor G. Ashe, that thereas it is in the best interests of the Municipality and its citizens to properly anticipate, plan and be prepared for the impending development explosion and, WHEREAS some current thinking encompasses the thoughts of a sewage disposal plant at the Petticoat Creek, contrary to the wishes of the Municipality and, . . . . . . . . . . Continued - 8 - 32/71 WHEREAS there are several development proposals anticipated or pending in the Moore Road - Oklahoma Drive area, THEREFORE be it resolved that the Planning Department be directed to proceed immediately with the development of the district plan for this area known as district plan number eleven. Kitchen, that the Marfield draft agreement be amended to provide that the frontage charges for existing facilities be based on 525 feet at $45.00 per foot for a total cost of $23,625.00 to the subdivider, as recommended by the Standing Committee of the Whole Council in Closed Session October 25,1971. CARRIED Resolution #436/71 MOVED by Councillor J. S. Scott, seconded by Councillor D. Kitchen, that the Council of the Township of Pickering accept the Agreement of Purchase and Sale from J. G. Ellwood for .946 acres of land more or less at a cost to the Township of $16,500.00) as recommended by the Standing Committee of the Whole Council in Closed Session, October 25,1971. CARRIED Resolution #437/71 MOVED by Councillor V. Rudik, seconded by Councillor G. Ashe that whereas the Pickering Township Old Timers' Hockey League is obtaining its Letters' Patent, and WHEREAS the proposed corporate entity will be using the word ¡¡Pickering" as part of its corporate name; BE IT THEREFORE RESOLVED that the Council of the Township of Pickering consent to the use of ¡'Pickering" as requested by the Companies Branch of the Department of Financial and Commercial Affairs. Scott, that whereas the Township is negotiating for the Rouge Hills Golf and Country Club House and acreage for parks and recreation purposes; AND m:EREAS the matter of obtaining the land is still under negotiation; ..........Continued - 9 - 32/71 AND WHEREAS the vacancy of the Rouge Hills Golf and Country Club could result in vandalism and to avoid unnecessary damage resulting in additional expense in bringing the building up to municipal standards~ BE IT THEREFORE RESOLVED that the Council agree to permit the occupancy of the Rouge llills Golf and Country Club on a lease purchase agreement basis until the purchase negotiations are finalized. Ashe, seconded by Councillor D. Kitchen, that the Personnel Manager be given authoriza- tion to lease a Zerox 4000 Copier for one month trial period. At the completion of this one month trial period a report is to be submitted to council by the Personnel Manager detailing the efficiency of the equip- ment and whether or not it would be warranted on a permanent basis, as recommended by the Standing Committee on Finance, October 27, 1971. CARRIED - 10 - 32/71 Resolution #442/71 MOVED by Deputy Reeve G. Ashe1 seconded by Councillor D. Kitchen, that 1. That Canadian Imperial Bank of Commerce be and it is hereby authorized and directed to pay all instruments purporting to be cheques, drafts or orders for the payment of money issued by the Corporation and purporting to bear facsimile signatures of any of the officers who from time to time are authorized to sign such instruments for and on behalf of the Corporation, 2.a) That all such instruments may be dealt with by the Bank to all intents and purposes and shall bind the Corporation as fully and effectually as if signed in the handwriting of and duly issued by such officers for and on behalf of the Corporation; b) That any cheque for an amount in excess of $500.00 must bear the initials of any two signing officers; That the Corporation shall provide the Bank with a certified copy of this Resolution and specimens of such facsimile signatures which may be acted upon by each branch of the Bank with which any dealings are had by the Corporation until notice to the contrary or of any change therein has been given in writing to the Manager or Acting Manager of such branch. Kitchen, that the Township acquire the Rouge Hill Golf Club building and up to 6.3 acres of land from the owner and ttis land would then form part of a park dedication when the lands are divided for future development, as recommended by the Standing Committee on Finance, October 27,1971. CARRIED Resolution #444/71 MOVED by Councillor V. Rudik, seconded by Deputy Reeve G. Ashe, that the Hydro to the Pickering Indoor Swimming Pool be diverted through the Dunbarton High School lines as originally recommended by design mechanical engineers to the project, and as recommended by Mr. Beddall's letter of October 27,1971. CARRIED - II - 32/71 (VII) BY-LAWS By-Law Number 4041/71 - Third Reading The Committee of the Whole arises and reports the By-Law as read. Councillor R. Chatten, seconded by Councillor D. Kitchen, moves that the report of the Committee of the vfuole on By-Law Number 4041/71} to authorize the construction of sanitary sewers and watermains on St. Martin's Drive as local improvements under the provisions of Sections 8 and 67 of The Local Improvement Act, R.S.O. 1960 and amendments thereto) be adopted, and that the said By-Law be now read a Third Time and PASSED, that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-Law Number 4069/71 Councillor V. Rudik, seconded by Deputy Reeve G. Ashe, moves for leave to introduce a By-law of the Township of Pickering to regulate, govern and prohibit the operation of motorized snow vehicles within the municipality, and that same now be read a first time. Councillor V. Rudik, seconded by Councillor D. Kitchen, moves that By-law Nunilier 4069/71 to regulate, ~overn and prohibit the operation of motorized snow vehicles within the municipality, be now read a second time, and that Council go into Conmittee of the Whole thereon. The Committee of the Whole arises and reports the By-law as read. Councillor V. Rudik, seconded by Councillor J. S. Scott, moves that the report of the Committee of the vfuole on By-law Number 4069/71 be adopted, and that the said By-law be now read a Third Time and PASSED, that the Reeve and Clerk sign the same, and the Seal of the Corporation be affixed thereto. Councillor Mrs. J. L. McPherson, seconded by Councillor D. Kitchen, moves that By-law Number 4071/71 to confirm the proceedings of the Council of the Corporation of the Township of Pickering at its meeting held on the 1st of November, 1971, be now read a second time, and that Council go into Committee of the Whole thereon. CARRIED (IX) NEW BUSINESS Councillor V. Rudik announced that he would not seek re-election in the forthcoming municipal election due primarily to the pressures of business created by greater responsibilities placed with him. He expressed his regrets in having to make this decision but at the same time indicated his pleasure of being associated with this Council and previous members.
