Willis - Planning Director (I) PRESENTATIONS Members of Council made presentations of crests to the members of the following: l) Canadian Albacore Class "B" Champions 2) Canadian War Canoe Junior Champions 3)All Ontario Midget "B" Girls' Softball Champions 4)All Ontario Pee Wee Girls' Softball Champions 5)Lakeshore League Girls' Novice Softball Champions. (II) ADOPTION OF MINUTES Moved by Deputy Reeve G. Ashe, seconded by Councillor J. Anderson, that the minutes of the Council Meeting of October 9, 1973, be adopted. (III) DELEGATIONS CARRIED 1. It was moved by Deputy Reeve G. Ashe that Mr. Rodney Smith be heard. Mr. Smith made representations on behalf of Mr. S. Eker asking Council to turn down the Planning Board's recommendation with respect to Mr. Eker's proposal for a townhouse development (see Resolution #267/73) 2. It was moved by Councillor D. Kitchen that Mr. R.O. Bambrough be heard. Mr. Bambrough asked that Council defer its decision on his application to amend the Official Plan, in Part Lot 28, Concession 3. (see Motions) (IV) RESOLUTIONS Resolution #267/73 MOVED by Deputy Reeve G. Ashe, seconded by Councillor D. Kitchen that the application by S. Eker to amend by-law 3038 to permit a townhouse development (Lot 80, Plan 509) be refused, as recommended by the Planning Board, September 20, 1973. CARRIED - 2 - 29/73 Resolution #268/73 MOVED by Deputy Reeve G. Ashe, seconded by Councillor J. Anderson, that the Council of the Township of Picketing do hereby certify, (1) That By-law 4~02/73 is in conformity with the Official Plan of the Township of Picketing approved and in force at the time said By-law was passed, namely the 3rd day of July, 1973. (2) No further Official Plan has been proposed by Council nor approved by the Ministry of Treasury, Economics and Intergovernmental Affairs since the passing of said By-law 4~02/73 and which said By-law would not be in conformity, including the overall revision adopted by Council, January 18, 1971, and Official Plan Amendment #20 adopted by Council July 3, 1973, and both being before the Minister of Treasury, Economics and Intergovernmental Affairs. And further, that the objections received objecting to this By-law be considered invalid. CARRIED Resolution #269/73 MOVED by Councillor D. Kitchen, seconded by Councillor B. Searle, that the Corporation of the Township of Picketing request the Ministry of Environment to hold full environmental hearings with respect to the pro- posed expansion of the Picketing Nuclear Power Station. Resolution #270/73 CARRIED MOVED by Councillor B. Searle, seconded by Councillor J.. Anderson, that the Council of the Corporation of the Township of Picketing give its endorsement and support to a proposed Local Initiatives Program project to establish a recycling depot in the Township of Picketing, as recommended by the Executive Committee, October 16, 1973. CARRIED Resolution #271/73 MOVED by Councillor K. Matheson, seconded by Councillor D. Kitchen, that Council: (1) declare the week of November 5th-llth inclusive as Remembrance Week in Picketing Township; (2) permit the Remembrance flag to be displayed on the Township flag pole for Remembrance Week;. (3) authorize the purchase of wreath #17 as per Royal Canadian Legion catalogue, in the amount of $20.00; (4) appoint Reeve J.R. Williams as its representative to place the wreath at the cenotaph in the Village of Picketing; (5) grant the Legion permission to sell poppies on Township streets on the 8th, 9th g 10th of November, 1973, as recommended by the Executive Committee, October 16, 1973. CARRIED Resolution #272/73 MOVED by Deputy Reeve G. Ashe, seconded by Councillor J. Anderson, that whereas a request has been received from the Ajax Jaycees fop Council support of a project being carried out by the Jaycees for the raising of money fop the Ajax, Picketing, Whitby Association for Retarded Children, Adult Services Workshop. - 3 - 29/73 Resolution 272/73 (Continued) Now therefore be it resolved that the Council of the Corporation of the Township of Picketing hereby declares the week conunencing Novenzber 26 and ending December 1, 1973 as "ARC INDUSTRIES WEEK~' and further give its permission to the Ajax Jaycees to hold a tag day in the Township of Picketing on December 1, 1973. CARRIED Resolution #273/73 MOVED by Councillor J. Anderson, seconded by Councillor D. Kitchen, that the monies in the amount of $326,000 that were withdrawn against the original letters of credit of Golden Boy Investments Limited be returned to the Canadian Imperial Bank of Conuneree, and that in their place, we accept new letters of credit from the new owners of Brock Developments Limited after we are satisfied that these new letters are properly prepared and adequately protect the Township, as reconunended by the Executive Conunittee (Closed Session) October 16, 1973. CARRIED Resolution #274/73 MOVED by Councillor D. Kitchen, seconded by Councillor J. Anderson, that whereas the enabling provincial legislation to permit municipalities in the Province of Ontario to pass by-laws prohibiting or regulating signs or other advertising devices and the posting of notices is found in the Municipal Act, Revised Statutes of Ontario 1970, Chapter 284 and in particular in Section 354(1) 126 and 128; whereas such enabling legislation does not permit municipalities to (a) enter upon private property to administer and enforce a by-law enacted pursuant to the afore- mentioned authority; (b) require a person to obtain a permit prior to the erection, alteration, relocation or placing of a sign, and the charging of a fee in relation to obtaining such permit; (e) enforce a by-law, enacted pursuant to the aforementioned authority, with respect to signs that were unlawful on the day the by-law was passed, until the expiry of 5 years from the date of the passage of the subject by-law, thereby giving lawful non-conforming status to signs which may have been erected unlawfully pursuant to a by-law preceeding The one now in force; (d) require that the owner of the land on which a sign is situated comply with the by-law or remove a non-conforming sign, if such sign was erected after the passage of a by-law enacted pursuant to the subject enabling legislation; (e) direct or require by by-law that a person comply with the prohibitions and/or regula- tions in the by-law, thereby depriving the municipality from using, as a part of the enforcement process, the powers set out in Part XXI, Section 469 of the Municipal Act. and whereas Municipalities regulating signs have traditionally (a) entered upon private property to administer and enforce their by-law; - 4 - 29/73 Resolution $274/73 (Continued) (b) required a person to obtain a permit prior to the erection, alteration, relocation or placing of a sign, and have required the payment of fees in relation to such permit; and whereas the remaining powers enumerated and not provided ape required to equitably, effectively and logically enforce a by-law regulating signs, parti- cularly with respect to those myriad of external signs that are transient, protable or short term in nature; be it therefore resolved that the Ontario government be requested to amend the presently existing legislation in the Municipal Act to give Municipalities the power to do those things heretofore described which they are not presently empowered to do. CARRIED Resolution #275/73 MOVED by Councillor K. Matheson, seconded by Councillor B. Searle, that the tender of Elirpa Construction ~ Materials Limited in the amount of $3.30 per foot for the installation of curbs and gutters on Sheppard Avenue be accepted, subject to the approval of the Ministry of Transportation and Communications. CARRIED Resolution #278/73 MOVED by Councillor B. Searle, seconded by Councillor K. Matheson, that Council make an application to the Scarborough Public Utilities Commission and the Municipality of Metropolitan Toronto on behalf of Mr. F. Massara for a domestic water connection to the Scarborough watermain subject to Mr. Massara agreeing to the registration of an Agreement against the title of his property wherein he agrees to sign any Local Improvements petition for watermain across his frontage that might be canvassed and not to oppose any initiated local improvements for a watermain across his frontage. Further, that Mr. Massara agrees to pay all costs that may be incurred in connection with such application. Motion CARRIED A motion that the application by Bambrough and Wood to amend the Official Plan to permit the development of lands at Lot 28, Concession 3, for residential purposes be REFUSED, as recommended by the Planning Board, September 20, 1973. Deferred. (V) BY-LAWS By-Law Number ~29/73 Councillor B. Searle, seconded by Councillor K. Matheson, moves for leave to introduce a By-law of the Township of Picketing to authorize the execution of a Release by the Corporation of the Township of Picketing and that same now be read a first time. - 5 - 29/73 By-Law Numbem g429/73 (Continued) Councillom B. Seamle, seconded by Councillom D. Kitchen, moves that By-law Number gb29/73 to authomize the execution of a Release by the Corporation of the Township of Pickerin§ be now mead a second time, and that Council go into Con~nittee of the Whole thereon. The Committee of the Whole arises and mepomts the By-law as read. Councillor B. Searle, seconded by Councillor J. Andemson, moves that the report of the Committee of the Whole on By-law Number 4629/73 be adopted, and that the said By-law be now read a Thimd Time and PASSED, that the Reeve and Clerk sign the same, and the Seal of The Corpomation be affixed thereto. Matheson, moves for leave to introduce a By-law of the Township of Pickerin§ to authorize the execution of an Agreement between Frank T. Ross ~ Sons (1962) Limited and the Corpomation of the Township of PiekePin~ and that same now be read a first time. Deputy Reeve G. Ashe, seconded by Councillor B. Searle, moves that By-law Numbem ~430/73 to authomize the execution of an Agmeement between Frank T. Ross ~ Sons (1962) Limited and the Corporation of the Township of Pickeming be now mead a second time, and that Council go into Committee of the Whole thereon. Ashe, moves for leave to introduce a By-law of the Township of Picketing to implement the Official Plan of the Township of Picketing in Parts of Lots 26, 27 and 28, Range III, Township of Picketing, and that same now be read a fimst time. Searle, moves for leave to introduce a By-Law of the Township of Pickering to confirm the pro- ceedings of the Council of the Corporation of the Township of Picketing at its meeting held on the 22nd day of October, 1973, and that same now be read a first time. Ashe, moves that By-law Number ~33/73 to confirm the proceedings of the Council of the Corporation of the Township of Pickering at its meeting held on the 22nd day of October, 1973 be now read a second time, and that Council go into Committee of the Whole thereon.
