Fisher (I) RESOLUTION Resolution 224/77 Moved by Councillor Matheson, seconded by Councillor Robertson that whereas Council has by Resolution Number 96/76 dated June 28th 1976 approved in principle the location of the Main Central Area of the Town of Pickering; and WHEREAS Council deems it important to foster a concentration of public uses and activities in the Main Central Area imorder to enhance its role as the Town Centre for Pickering; WHEREAS Council wishes to locate in the designated Main Central Area all those public uses and activities over the location of which Council is empowered to exercise control. THEREFORE BE IT RESOLVED THAT Council approves the location within the Main Central Area of all those portions of the proposed Recreation Complex including the cultural and sports activities and functions which are normally intended to be undertaken with enclosed facilities such as an arena, curling rink, tennis courts, theatre, crafts and practice rooms, indoor swimming pool, bowling alley, concert hall, fitness rooms, etc. (but excluding the activities and functions which are normally intended to be undertaken on outdoor facilities such as outdoor tracks and playing fields). CARRIED Resolution 225/77 Moved by Councillor Cahill, seconded by Councillor Matheson that whereas the Council of the Corporation of the Town of Pickering made objection on October 2nd 1972, to the Minister of Treasury, Economics and Intergovernmental Affairs concerning a proposal by the Borough of Scarborough to provide for a Regional Shopping Centre designation which would permit up to 800,000 square feet of gross leasable floor space on a site generally located at or near the intersection of provincial highways 401 and 2, and Port Union Road (Official Plan Amendment No. 304); - 154 - 30/77 (I) RESOLUTIONS (Cont.) Resolution 225/77 (Cont). AND WHEREAS the said Council made representations concerning the above mentioned objection to the Ontario Municipal Board at a hearing held January 6th 1975 for that purpose; AND WHEREAS the said Board, in its decision dated March 20th 1975, and amended April 24th 1975, rejected the proposal of the Borough, stating, in part, "the designation on the Rouge Community Secondary Plan for the subject site shall be changed from regional commercial centre to community commercial centre", thereby permitting up to 60,000 gross leasable floor space only.; AND WHEREAS the Divisional Court of the Supreme Court of Ontario, in its decision dated December 4th 1975, upheld the Board in its rejection of the proposal; AND WHEREAS Her Honour the Lieutenant Governor, by Order-in-Council dated February 18th 1976, con- firmed the decision of the Board; AND WHEREAS the proposed Official Plan for the Regional Municipality of Durham, adopted by the Council of that Regional Municipality on July 14th 1976 and presently awaiting the approval of the Minister of Housing, provides for a Pickering Main Central Area on a site generally located at or near the inter- sections of Liverpool Road and provincial highways 401 and 2, which 'Area may have up to 1,500,000 square feet of gross leasable floor space together with recreational, municipal, residential and other uses (including the presently existing Sheridan MalI); AND WHEREAS an Urban Design Study and District Plan for the Pickering Main Central Area have been prepared and were received by the Council of the Town of Pickering on November 21st 1977, and which provide for up to 1,500,000 square feet of gross leasable floor space together with recreational, municipal, residential and other uses (including the presently existing Sheridan Mall); AND WHEREAS by letter dated November 16th 1977, and received November 28th 1977 the Corporation of the Town of Pickering has been advised by the Planning Board of the Borough of Scarborough thatthat Board is in receipt of an application to amend the Official Plan of the Borough to permit a shopping centre providing for 300,000, t0500c,00O square feet of retail space on the site which was the subject of Official Plan Amendment No. 304; AND WHEREAS the creation of a shopping centre of over 60,000 square feet in the Borough of Scarborough close to its boundary with the Town of Pickering will adversely affect the creation of the Pickering Main Central Area; THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING respectfully objects to the proposed amendment to the Official Plan of the Borough of Scarborough for the propertý'loça:ted_iß.:1:he quadrant between provinciål highway 2, Tallpines Boulevard (Centennial Road), Sheppard Avenue and Durnford Road (Part Borough Lot 2, Concession II, Rouge Community), - 155 - 30/77 (I) RESOLUTIONS (Cont.) Resolution 225/77 (Cont.) AND FURTHER respectfully requests that it be advised in advance of all public hearings to be held with respect to this matter. CARRIED ( II) BY-LAWS Councillor Robertson, seconded by Councillor Geraghty moved for leave to introduce By-laws of the Town of Pickering: By-Law Number 727/77 By-law to authorize the execution of a Release between the Corporation of the Town of Pickering and K. & F. Haug. Recorded Vote: Yea: Messrs. Geraghty, Anderson, Kitchen, Matheson, Robertson, Cahill. By-Law Number 728/77 By-law to amend By-law Number 142/74 (taxicab) Recorded Vote: Yea: Nay: Messrs. Messrs. Geraghty, Anderson, Kitchen, Robertson. Matheson and Cahill. THIRD READING Councillor Robertson, seconded by Councillor Geraghty moved that the report of the Committee of the Whole on By-law Numbers 727/77 and 728/77, be adopted, and that the said By-laws be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and that the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. ( III) -CONFIRMA~ION-BY-LAW By-Law Number 729/77 Councillor Robertson, seconded by Councillor Geraghty moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 28th day of November 1977, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
