Mys1ik ADOPTION OF MINUTES Town Manager Deputy Clerk Moved by Councillor Cahill, seconded by Councillor Matheson that the minutes of the meeting of September 6th 1977, be adopted. CARRIED (II) DELEGATION Mr. Rick Hull was not present but he indicated that he wished to attend at a later date. (III) RESOLUTIONS REPORT OF THE EXECUTIVE COMMITTEE OF SEPTEMBER 6th 1977 See Appendix I Resolution 188/77 Moved by Councillor Fisher, seconded by Councillor Robertson that the recommendations contained in the Executive Committee Report of September 6th 1977, be adopted. CARRIED REPORT OF THE EXECUTIVE COMMITTEE OF SEPTEMBER 12th & 19th 1977 See Appendix II & III Resolution 189/77 Moved by Councillor Kitchen, seconded by Councillor Robertson that the recommendations contained in the Executive Committee Report of September 12th amd September 19th 1977, be adopted. CARRIED REPORT OF THE PLANNING COMMITTEE OF SEPTEMBER 13th 1977 See Appendix IV Resolution 190/77 Moved by Councillor Matheson, seconded by Councillor Fisher that the recommendations contained in the Planning Committee Report of September 13th 1977, be adopted. CARRIED - 130 - 24/77 (III) RESOLUTIONS (Continued) Resolution 191/77 Moved by Councillor Fisher, seconded by Councillor Robertson that By-law 671/77 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 18th day of July 1977; No further Official Plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 671/77 and which said By-law would not be in conformity, including the District Plan of the Town of Pickering District Planning Area, Region of Durham which was adopted by Council, February 17th 1975 and recommended to the Region of Durham for approval. CARRIED Resolution Moved by Councillor Robertson, seconded by Councillor Fisher that the tender of Pierreville Fire Trucks Limited in the amount of $79,990.00 for the supply of new Fire Truck be accepted. LOST Resolution 192/77 Moved by Councillor Cahill, seconded by Councillor Kitchen that the tender of King Seagrave Limited in the amount of $82,917.00 for the supply of new Fire Truck be accepted. CARRIED Resolution 193/77 Moved by Councillor Fisher, seconded by Councillor Robertson that the residents of Denmar Road, Town of Pickering, be granted permission to hold a Street Dance on Denmar Road on Saturday, October 1st 1977. CARRIED (IV) BY-LAWS Councillor Cahill, seconded by Councillor Matheson moved for leave to introduce By-laws of the Town of Pickering: By-Law Number 695/77 To authorize the execution of a Grant of Easement between the Town of Pickering and Her Majesty the Queen in right of Ontario as represented by The Minister of the Environment with respect to an easement over a portion of Plummer Street, more particularly described on Reference Plan 40R-3690 as Parts 7 & 8. - 131 - 24/77 (IV) BY-LAWS (Continued) By-Law Number 696/77 To authorize the Execution of an Option Agreement between the Corporation of the Town of Pickering and Her Majesty the Queen in right of Ontario as representèd by The Minister of the Environment with respect to an easement over a portion of the C.N.R. Spur Line located on Parts of Lots 17 and 18, Broken Front Range 3. By-Law Number 697/77 To authorize the execution of a Development Agreement between the Corporation of the Town of Pickering and Pickering Heights Joint Venture. Recorded Vote: Yea: Nay: Messrs. By-Law Number 698/77 To authorize the execution of a Development Agreement between the Corporation of the Town of Pickering and Michael Broz and Mira Penic with respect to Lot 71, Plan 350 (LD 136/77). By-Law Number 699/77 To amend By-law Number 266/75 limiting the number of automobile service stations and public garages. By-Law NumberlQO/77 To authorize the execution of an Offer to Purchase between the Town and Bramalea Limited. By-Law Number 701/77 To implement the Official Plan of the Township of Pickering District Planning Area, Region of Durham, in Part Lot 27, Range 3, Broken Front Concession, and Part Lots 27 and 28, Concession 1, Town of Pickering. By-Law Number 702/77 To implement the Official Plan of the Township (now Town) of Pickering District Planning Area, Region of Durham, in Part Lot 20, Concession 1, Town of Pickering, (Day Care Centre). By-Law Number 703/77 To amend By-law #55/74, prohibiting heavy traffic (6th Concession Road - Hamlet of Greenwood). By-Law Number 704/77 To authorize the execution of an agreement between the Corporation of the Town of Pickering and Jock Shields with respect to the demolition of certain buildings. - 132 - 24/77 (IV) BY-LAWS (Continued) THIRD READING Councillor Cahill, seconded by Councillor Matheson moved that the report of the Committee of the Whole on By-law Numbers 695/77 to 704/77 inclusive, be adopted, and that the said By-laws be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and that the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. By-Law Number 705/77 Councillor Cahill, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to appoint three members to the Court of Revision, and that the same now be read a first and second time, and the Council go into Committee of the Whole thereon. CARRIED MOTION Moved by Councillor Matheson, seconded by Councillor Cahill that Mrs. Elizabeth A. Shumovich be nominated for the Court of Revision. CARRIED MOTION Moved by Councillor Cahill, seconded by Councillor Matheson that Mr. Robert A. Gummow be nominated for the Court of Revision. CARRIED MOTION Moved by Councillor Matheson, seconded by Councillor Cahill that Mrs. Patricia D. Elson be nominated for the Court of Revision. CARRIED By-Law Number 105/77 - Third Reading The Committee of the Whole arises and reports the By-law as read: Councillor Cahill, seconded by Councillor Matheson moved that the report of the Committee of the Whole on By-law Number 705/77 to appoint three three members to the Court of Revision, and moved that the said By-law be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. - 133 - 24/77 (V) 1. OTHER BUSINESS October 11th 1977 It was noted that there will be no meeting on Tuesday, October 11th 1977 after the Thanksgiving weekend. 2. Denmar Road Street Dance Confer Resolution # 193/77 3. West Shore Gardens Staff was requested to check the progress of construction at West Shore Gardens. 4. Keen Kraft Meeting It was noted that the people interested in the lifting of the Holding By-law on Keen Kraft were notified and a meeting set up, three people showed up for the meeting. their problems were resolved with Mr. McKean. 5. Mr. N. Cafik - Minister of Multiculturism The Mayor indicated that our local M.P. Mr. N. Cafik has been promoted to the position of Minister of Multiculturism and the Deputy House Leader. The Council of the Town of Pickering wish him the best in his promotion. (VI) CONFIRMATION BY-LAW By-Law Number 706/77 Councillor Fisher, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 19th day of September 1977, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-Law read a first, second and third time and finally passed. WEST SHORE GARDENS SUBDIVISION - PLAN M-1l05 LETTER OF CREDIT That the Town Manager be authorized to reduce the Letter of Credit held by the Municipality on Plan M-1105, located on the east side of West Shore Boulevard south of Oklahoma Drive, to $10,000.00. REGION OF DURHAM - WASTE DISPOSAL BY-LAW That the proposed Regional Municipality of Durham's Waste Disposal By-law, submitted with the Commissioner of Works' letter of August 19th 1977, be received for information and filed. ROGERS' BARNS - MUSEUM That the report of the Director of Parks and Recreation dated August 25th 1977 with respect to the dismantling of the Rogers' barns be approved and that thenecèssary budgetary transfers be endorsed and that the Town Solicitor draft a suitable Agreement covering the work to be completed. RESOLUTION - TOWNSHIP OF DELHI That the resolution of the Corporation of the Township of Delhi contained in their letter of August 15th 1977 with respect to subsidies to municipalities ~hat provideoutfa11s in connection with drainage sys~ems be received and that they be encouraged to obtain the endorsement of their resolution through the auspices of the Association of Municipalities of Ontario, and that they be advised of the error in their legislative reference. RESOLUTION - REGIONAL MUNICIPALITY OF OTTAWA-CARLETON That the resolution of the Regional Municipality of Ottawa-Carleton, circulated on August 15th 1977, with respect to Pedestrian Crossovers not be endorsed and that they be advised that this matter is properly one to be dealt with by the Region of Durham. QUOTATION - LANDSCAPING - EAST SHORE COMMUNITY CENTRE AND LIBRARY That Mr. T. William Bedda11 be authorized to proceed with the work envisaged in his letter of August 16th 1977 to the Town Manager with respect to the East Shore community Centre and Bay Ridges Library and that the quoted cost of $3,040.25 be charged to the Capital Account for the East Shore community Centre and Bay Ridges Li&rary project. COURT OF REVISION That a by-law be passed appointing members of the Court of Revision to hear appeals against the present local improvement notices circulated in the Rosebank Area and the Southview Drive Area. HEAVY TRAFFIC - HAMLET OF GREENWOOD That a by-law be passed amending By-law Number 55/74, prohibiting heavy traffic on the 6th Concession Road, through the Hamlet of Greenwood. ACCOUNTS FOR APPROVAL That the Accounts dated August 31st 1977, in the amount of $894,276.89, as submitted by the Town Manager, be approved. EMERGENCY MEASURES That Councillor Cahill be appointed to liaisen on behalf of Council with Mr. F.S. Wotton of the Emergency Measures Organization. TRAFFIC LIGHTS - INDUSTRIAL ROAD - LIVERPOOL ROAD That the Region be requested to install traffic signals at the Industrial Road and Liverpool Road intersection in 1978. APPENDIX III REPORT OF THE EXECUTIVE COMMITTEE MEETING OF SEPTEMBER 19th 1977 1. LICENCE - SECOND HAND GOODS SHOP .. That a licence to operate a Second Hand Goods Shop be issued to Marlene Hannick, subject to the approval of the Police, Fire and Health Departments. 2. LAND SALES - BRANDS COURT That the Town Manager be authorized to negotiate with the owners of 1324 - 1334 Brands Court the possible transfer of a portion of the Municipal land with a view towards straightening the westerly boundary of G1engrove Park. 3. MODIFICATION TO MINISTER'S ZONING ORDER W.A. & N.F. LESLIE - PART LOT 33, CONCESSION 2 That M10/77 and M16/77, submitted by W.A. & N.F. Leslie on Part Lot 33, Concession 2, to modify the Minister's Zoning Order in order to pe~it the creation of two residential lots, with 120' frontage and 43,200 sq.ft. and 244.9' frontage and 87,840 sq. ft., be approved. 4. SIGN BY-LAW VIOLATION ThatSomaform Manufacturing Limited located at 910 Brock Road South be given 7 days notice to remove their sign located on the west side of Brock Road at its intersection with Quigley Street, and that in the event the sign is not removed, that the By-law Enforcement Officer be directed to take whatever action is required to have the sign removed. s.
