Myslik ADOPTION OF MINUTES Administrator-Clerk Deputy Clerk Moved by Councillor Cahill, seconded by Councillor Fisher that the minutes of the meeting of May 2nd 1977, be adopted. CARRIED (II) PRESENTATIONS Presentation of certificates for successful completion of Ministry of Transportation and Communication Courses to the following members of staff: Edward Holmberg Scott McKay Municipal Soils Technology Steve Forsey Municipal Inspection General Course # 77-32 Robert Starr Municipal Inspection General Course # 77-32 ( III) REPORTS See Appendix I Ontario Humane Society Report for the month of April 1977 with comparison figures for the month of April 1976. (IV) 1. DELEGATIONS Mr. Edwin J. Welch of Auto Truck Rustproofing (Pickering) Limited appeared in support of his application for a Garage Licence as noted under Item #1 of the Executive Committee Report of May 9th 1977. 2. Mr. Roger Gale, President of the Pickering Hockey Association appeared with respect to Item #4 of the Executive Committee Report of May 9th 1977. (V) RESOLUTIONS --, REPORT OF THE EXECUTIVE COMMITTEE OF MAY 9th 1977 --- --- See Appendix II Resolution 80/77 Moved by Councillor Kitchen, seconded by Councillor Fisher that the recommendations contained in the Executive Committee Report of May 9th 1977, Item #2, #5 - #ll/and #14 - #20, be adopted. CARRIED - 62 - 12/77 (V) RESOLU!~ONS (Continued) REPORT OF THE EX~pTIVE COMMITTEE OF MAY 9th 1977 (C9nt.) See Appendix II Item #1 GARAGE LICENSING BY-LAW- AUTO-TRUCK RUSTPROOFING (PICKERING) LIMITED Mr.Edwin J. Welch of Auto Truck Rustproofing (Pickering) Limited, spoke to the item. Mr. Welch indicated that he was willing to have the "H" Licence without the retailing of gas and oil. In the discussion it was pointed out that there is a conflict with the zoning by-law and the retailing of accessories. It was pointed to Mr. Welch that he can install the accessories within the framework of his "G" designation licence and that on June 14th 1977 the whole Brock Industrial Area will be considered when the study comes before Council. Mr. Welch agreed to continue with his "G" Garage Licence and to await the outcome of the Brock Industrial Area Study. Resolution 81/77 - Item #1 Moved by Councillor Anderson, seconded by Councillor Cahill that Item #1 of the Executive Committee Report of May 9th 1977 dealing with the Garage Licensing By- Law - Auto-Truck Rustproofing (Pickering) Limited, be tabled until after the Brock Industrial Area Study is considered. CARRIED Item #4 PICKERING PANTHER HOCKEY CLUB - DRESSING ROOM- DON BEER SPORTS ARENA -,- --- Mr. Roger Gale, President of the Pickering Hockey Association, addressed Council on the item of the modification of the Dressing Rooms. He indicated that the Executive of the Pickering Hockey Association concurred with the recommendation of the Executive of the Pickering Panthers. Resolution 83/77 - Item #4 Moved by Councillor Kitchen, seconded by Councillor Fisher that Item #4 of the Executive Committee Report of May 9th 1977, be adopted. CARRIED Resolution 84/77 - Item #12 Moved by Councillor Kitchen, seconded by Councillor Fisher that Item #12 of the Executive Committee Report of May 9th 1977, be adopted. CARRIED - 63 - 12/77 (v) RESOLUTIONS J~tinued) REPORT OF THE EXECUTIVE COMMITTEE OF MAY 9TH 1977 (Cont.) ----- Item #13 AMENDMENT TO SUBDIVISION AGREEMENT - LOOKOUT POINT After some discussion concerning the wording of the Agreement the following Motion was put. MOTION Moved by Councillor Anderson, seconded by Councillor Fisher that the Motion to Item #13 be put. CARRIED Resolution 85/77 - Item #13 Moved by Councillor Kitchen, seconded by Councillor Fisher that Item #13 of the Executive Committee Report of May 9th 1977, be adopted. Resolution 86/77 REPORT OF THE PLANNING COMMITTEE OF MAY 10TH 1977 --- See Appendix III Moved by Councillor Anderson, seconded by Councillor Fisher that the recommendations contained in the Planning Committee Report of May 10th 1977 be adopted. CARRIED Resolution 87/77 Moved by Councillor Fisher, seconded by Councillor Anderson that this Council authorizes the publication of a Public Notice regarding the destruction of weeds under the provision of the Weed Control Act of the Province of Ontario and directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be destroyed in such a manner as they may deem proper and that the expenses incurred by the said Weed Inspectors in the discharge of their duties shall be placed on the Collector's Roll of this municipality against the respective parcels concerned and that such amounts shall be collected in the same manner as taxes under The Municipal Act. CARRIED - 64 - 12/77 (V) RESOLUTIONS (Continued) -~ Resolution 88/77 Moved by Councillor Matheson, seconded by Councillor Cahill that the week of June 6th to June 10th 1977 be deG:lared "Hire a Student Week" in the Town of Pickering. CARRIED Resolution 89/77 Moved by Councillor Anderson, seconded by Councillor Fisher that whereas the By-law #589/77 the Council of the Corporation of the Town of Pickering authorized the execution of a Servicing Agreement between the Corporation of the Town of Pickering and the Regional Municipality of Durham with respect to the installation of services on a proposed road in the Brock Industrial Area (Part 5, Plan 40R-3l58); AND WHEREAS it may be desirable for the Regional Municipality of Durham to authorize the use of such services, for the purposes for which they are designed, by other persons or parties; NOW THEREFORE BE IT RESOLVED THAT: 1. The Regional Municipality of Durham is hereby given the consent of the Corporation of the Town of Pickering to the authorization of the use of the services referred to above by third parties for the purposes for which the services are designed. 2. Such use of any of the services shall not be deemed to be an acceptance of any of the services by the Regional Municipality of Durham, nor an assumption by the Region of any liability in connection therewith, nor a release of the Town from any of its obligations under the agreement referred to. CARRIED Resolution 90/77 Moved by Councillor Kitchen, seconded by Councillor Fisher that the Subdivision Agreement be reviewed with respect to the 60/40 residential/industrial ratio. CARRIED (VI) BY-LAWS By-Law Number 604/77 Councillor Matheson, seconded by Councillor Cahill moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of an Agreement between the Corporation of the Town of Pickering and The Government of Canada (Manpower & Immigration) with respect to the participation of the Municipality in a Canada Works Program, and that the same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. - 65 - 12/77 (VI) BY-LAWS (Con!inued) By-Law Number, 605/77 Councillor Kitchen, seconded by Councillor Cahill moved for leave to introduce a By-law of the Town of Pickering to amend By-law Number 266/75 limiting the number of automobile service stations and public garages, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. B¥-Law Number 606/77 Councillor Matheson, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Subdivision Agreement between the Corporation of the Town of Pickering and Dungarvan Investments Limited, Gillingham Investments Limited and Highcroft Investments Limited (Lots 13 - 17, 34 - 38, and Part Block B, Plan M-lO17, Draft Plan l8T-75053) and that same now be read a first and second time, and the Council go into Committee of the Whole thereon. MOTION Moved by Councillor Kitchen, seconded by Councillor Cahill that Sub-section C of Section 16 of Schedule B of the Lookoub Point South Subdivision Agreement be amended after the words "Commencing in 1981," to read: "the owner shall pay annually to the Town the sum of $47,000.00 until the required Industrial/Commercial buildings have been constructed as liquidated damages". Councillor Matheson, seconded by Councillor Anderson moved that the report of the Committee of the Whole on' By-law Number 606/77, and moved that the said By-law be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. - 66 - 12/77 (VI) BY-LAWS (Continuedl By-Law Numb~607/77 Councillor Matheson, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of an Amending Agreement to the Lookout Point Subdivision Agreement dated December 3rd 1973, between the Corporation of the Town of Pickering and Dungarvan Investments Limited, Gillingham Investments Limited and Highcroft Investments Limited carrying on business under the firm name and style of Lookout Point Developments (Plan M-IO17) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. Stroud with respect to certain lands in Lots 29 and 30, Range 3, Broken Front Concession (LD 60/77 & LD 61/77) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-Law Number 609/77 Councillor Kitchen, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to amend Restricted Area By-law #2511, as amended, and to implement the Township of Pickering Official Plan in Block B, Plan M-IO17, Town of Pickering, and that same be now read a first, second and third time and that same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. - 67 - 12/77 (VI) BY-LAWS-1f9.£!.inued) By-Law Number 610/77 Councillor Fisher, seconded by Councillor Kitchen moved for leave to introduce a By-law of the Town of Pickering to levy such rates against all of the assessed properties in the Town of pickering as will be required to cover the 1977 requisition from the Regional Municipality of Durham and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-Law Number 611/77 Councillor Fisher, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Development Agreement between the Corporation of the Town of Pickering and David Lee Jenkins with respect to Part Lot 35, Concession 1, (M 13/76) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-Law Number 612/77 Councillor Anderson, seconded by Councillor Fisher moved for leave to introduce a By-law of the Town of Pickering to amend By-law Number 265/75 regulating and licensing the operation of public garages, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. Drainage - Fairpor~~9ad_We2t-~ It was noted that a report will be forthcoming from the Director of Public Works concerning the drainage on the west-side of Fairport Road. Subdivision A~re~~ts =-60/~0 Ratio See Resolution 90/77 Parking - Wharf Street There is no parking on both sides of Wharf Street west of Liverpool Road. However, cars have been seen parked in that area. The Administrator-Clerk was requested to contact the Durham Regional Police concerning the enforcement of the By-law in that area. Sheridan MaIl Parkw~=-Earking It was noted that cars were parked on both sides of Sheridan Mall Parkway on the occasion of the Flea Market. This situation is to be checked concerning any hazards for the Police or the Fire Departmen t. Fire Marshall's Report The Fire Marshall's Report has not been received as yet Motorcycles - .~!?~ Road North It was noted that motorcycles are using areas of the Bramalea property in the Rosebank Road North area. Bramalea should be notified of these activities. Orangebrook I~dustria~Development There was a request of information to be given to the Council Members concerning the square footage of the Orangebrook Industrial Development. GARAGE LICENSING BY-LAW - AUTO-TRUCK RUSTPROOFING (PICKERING) LIMITED That the report of the Town Solicitor dated April 25th 1977 be adopted and that Auto-Truck Rustproofing (Pickering) Limited be advised that the Municipality cannot issue the licence designation requested in Mr. Welch's letter of April 19th 1977, as the property is not zoned for this purpose. AGREEMENT - GOVERNMENT OF CANADA - CANADA WORKS PROGRAM That the report of the Administrator-Clerk dated April 25th 1977 be approved and that a By-law be passed authorizing the Mayor and Clerk to execute an agreement with the Government of Canada authorizing the participation of the Municipality in a Canada Works Program. RESOLUTION - TOWNSHIPS OF SHACKLETON & MACHIN That the resolution of the Corporation of the Townships of Shackleton and Machin dealing with the non-medical use of drugs not be endorsed and that they be encouraged to obtain the endorsement of their resolution through the auspices of the Association of Municipalities of Ontario. GRANT - DURHAM FEDERATION OF AGRICULTURE That a grant in the amount of $300.00 be paid to the Durham Federation of Agriculture for the year 1977. SUBDIVISION AGREEMENT - LOOKOUT POINT SOUTH That a by-law be prepared authorizing the Mayor and Clerk to sign a Subdivision Agreement with Dungarvan Investments Limited, Gillingham Investments Limited and Highcroft Investments Limited covering a Plan of Subdivision, more particularly described as Lots 13 - 17, 34 - 38, and Part Block B, Plan M-1017, Town of Pickering. AMENDMENT TO SUBDIVISION AGREEMENT - LOOKOUT POINT That the report of the Town Solicitor dated May 4th 1977 dealing with an amendment to the Lookout Point Subdivision Agreement dated December 3rd 1973 be adopted and that the necessary by-law be prepared authorizing the Mayor and Clerk to sign the amending agreement. AGREEMENT - ERNEST L. STROUD That a By-law be prepared authorizing the Mayor and Clerk to execute an agreement between the Corporation of the Town of Pickering and Ernest L. Stroud pursuant to a condition attached to Land Division Committee decisions LD 60/77 and LD 61/77, with respect to certain lands in Lots 29 and 30, Range 3, Broken Front Concession. TENDER FOR FLOODLIGHTING - DUNMOORE TENNIS COURT That the tender of Gardner Industrial Electric Limited be accepted for the supply and installation of Floodlighting for One 4-Court Tennis Court, in the amount of $6,828.00, as recommended by the Town Buyer in his report of May 6th 1977. TENDER - FLOODLIGHTING - CLAREMONT LAWN BOWLING GREEN That the tender ofStaoey Electric Company Limited be accepted for the supply and installation of Floodlights at Claremont Lawm Bowling Green in the amount of $6,713.00 as recommended by the Town Buyer in his report of May 6th 1977. EXPROPRIATION OF MUNICIPAL PROPERTIES That Anthony R. May be retained to prepare appraisals on the following Municipal properties expropriated by the Federal Government for the proposed Airport: Old Municipal Building Old Municipal Garage Atha Community Centre A1tona Community Centre Brougham Community Centre at a cost not to exceed $9,000.00. LEGAL COUNSEL - TOWN CENTRE That the AdministratOr-Clerk be authorized to retain David B. Greenspan to continue as legal counsel to the Municipality in the development of the Town Centre. APPENDIX III May 11th, 1977 The Planning Committee respectfully submits and recommends as follows:- 1. MINISTER'S ZONING ORDER MODIFICATION APPLICATION MR. P. GILLESPIE PART LOT 9, CONCESSION 8 TOWN OF PICKERING M 8/77 THAT the application by P. Gillespie in respect to lands at Part Lot 9, Concession 8 to modify the Minister's Zoning Order be APPROVED, subject to the applicant entering into an agree- ment with the Town of Pickering which shall include, but not necessarily b~ limited to, the use of the unopened road allowance between Lots 8 and 9, Concession 8; AND THAT due to the special circumstances which obtain in this case, this action should not be considered:- 2. as establishing a new policy, does not repudiate any previously established policy, and should not be considered as establishing a precedent. BY-LAW AMENDMENT APPLICATION A 19/76 KEEN KRAFT MARINA LIMITED LOTS 1 TO 7 INCLUSIVE, PLAN 65 TOWN OF PICKERING THAT in order to expedite Mr. McKean's application Planning Staff be directed to seek to obtain a release from the Consultants undertaking the Frenchman's Bay Study after they have completed their preliminary evaluation; said item to be reported back to Planning Committee/Council within eight weeks. ;,. 3. Changes in "Red" as shown on the plan stamped approved this date. 2. The allocation of sewage treatment plant capacity and water capacity for the development. 3.
