Anderson D. Kitchen K. Matheson A. Robertson B. Searle K. Spratley N.C. Marshall - J.P. Myslik Administrator-Clerk Deputy Clerk ADOPTION OF MINUTES (II) Moved by Councillor Spratley, seconded by Councillor Robertson that the minutes of the meeting of October 4th 1976 be adopted. CARRIED REPORTS (III) Ontario Humane Society Report f~r the month of September 1976 with comparison figures for the month of September 1975 See Appendix I DELEGATIONS Mr. George Martin of the Ham1èt of Greenwood wished to speak to Council regarding the concerns of the Greenwood Ratepayers' Association over the possible development that may take place within the Hamlet. A copy of the Director of Planning's memorandum of June 7th 1976 to Councillor Spratley is included for the information of Council. MOTION Moved by Councillor Spratley, seconded by Councillor Anderson that Mr. Martin be heard. CARRIED Mr. Martin expressed concern that Greenwood is zoned "V", Village, which allows industrial use. He suggested that By-law 3037 be amended to indicate residential zoning only for Greenwood. He requested that Council allow building permits to be issued only for residences and that demolition permits be monitored. It Was indicated that Greenwood is now under the Ministers Zoning Order and the municipality cannot do anything to change this immediately. It was suggested that the Ratepayers express their concerns in writing and submit them to Council. A zoning amendment procedure could then be implemented as soon as the Ministers Zoning Order is lifted. - 120 - 30/76 (IV) RESOLUTIONS REPORT OF THE EXECUTIVE COMMITTEE OF OCTOBER 4TH 1976 See Appendix II Resolution 159/76 Moved by Councillor Anderson, seconded by Councillor Spratley that the recommendations contained in the Executive Committee Report of October 4th 1976 be adopted. CARRIED REPORT OF THE EXECUTIVE COMMITTEE OF OCTOBER 12th 1976 See Appendix III Resolution 160/76 Moved by Councillor Kitchen, seconded by Councillor Matheson that the recommendations contained in the Executive Committee Report of October 12th 1976, item #1 and item #3 - #11, be adopted. CARRIED Resolution 161/76 - Item #2 Moved by Councillor Searle, seconded by Councillor Matheson that the Mayor and Clerk be authorized to execute a Subdivision Agreement between the Town and Jovial Investments Limited and E-Sol Development Limited in Block R, Plan M-19, as recommended by the Town Solicitor in his report dated October 6th 1976. CARRIED Recorded Vote Yea: Nay: Messrs. Ashe, Anderson, Matheson, Spratley, Searle. Messrs. Kitchen, Robertson. AMENDMENT Moved by Councillor Kitchen, seconded by Councillor Robertson that schedule "B" section "9" of the agreement be deleted. LOST Recorded Vote Yea: Nay: Messrs. Messrs. Kitchen, Robertson Ashe, Anderson, Matheson, Spratley, Searle Resolution 162/76 Moved by Councillor Matheson, seconded by Councillor Kitchen whereas Halloween falls on a Sunday this year, and WHEREAS there appears to be some confusion in the minds of parents as to when their children should be celebrating the Halloween festivities, and - 121 - 30/76 (IV) RESOLUTIONS (Continued) Resolution 162/76 (Cont.) WHEREAS in the interests of clarification it is deemed advisable to establish a date known to all for the purposes of celebrating Halloween this year. BE IT THEREFORE RESOLVED that those citizens of the Town of Pickering celebrating Halloween in the year 1976 be urged to do so on October 30th 1976. CARRIED Resolution 163/76 Moved by Councillor Robertson, seconded by Councillor Spratley that: 1) By-law 481/76 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 27th day of September 1976; 2) No further Official Plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 481/76 and which said By-law would not be in conformity, including the District Plan of the Town of Pickering District Planning Area, Region of Durham which was adopted by Council February 17th 1975 and recommended to the Region of Durham for approval; 3) That the objections received objecting to this By-law be considered invalid; 4) And further, that the objections be forwarded to the Ontario Municipal Board. CARRIED Resolution 164/76 Moved by Councillor Searle, seconded by Councillor Kitchen that the Boy Scouts of Canada, Owasco District Council, be granted permission to hold their annual Apple Days within the Town of Pickering on October 29th and 30th 1976. CARRIED Resolution 165/76 Moved by Councillor Spratley, seconded by Councillor Robertson that the tender of Pollard Roofing Limited be accepted in the amount of $11,621.00 for roof repairs for #5 Fire Hall, as recommended by the Town Buyer in his report dated October 7th 1976. CARRIED - 122 - 30/76 (V) BY-LAWS By-Law Number 489/76 Councillor Matheson, seconded by Councillor Searle moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Sub- division Agreement between the Corporation of the Town of Pickering and Jovial Investments Limited and E-Sol Development Limited (Block R, Plan M-19) and that same be now read a first, second and third time and that the same be finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-Law Number 490/76 Councillor Kitchen, seconded by Councillor Searle moved for leave to introduce a By-law of the Town of Pickering to adopt Amendment Number 28 of the Official Plan for the Town of Pickering Planning Area, Region of Durham (pentans Developments Limited) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-Law Number 491/76 Councillor Searle, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to amend Restricted Area By-law 2520, as amended, and to implement the Township of Pickering Official Plan in Block R, Plan M-19, Town of Pickering (Onrav Limited) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. - 123 - 30/76 (V) BY-LAWS (Continued) By-Law Number 492/76 Councillor Anderson, seconded by Councillor Spratley moved for leave to introduce a By-law of the Town of Pickering to designate certain highways within the Town of Pickering as "through Highways" and to amend By-law 353/76 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-Law N~ 493/76 Councillor Robertson, seconded by Councillor Spratley moved for leave to introduce a By-law of the Town of Pickering to designate certain highways or portions of highways within the Town of Pickering as "SCHOOL BUS LOADING ZONES" and to amend By-law 352/76 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-Law Nunber 494/76 Councillor Spratley, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to establish and maintain a reserve fund for the Public Works portion of lot levy fees collected on severances and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. Amendment Moved by Councillor Kitchen seconded by Councillor Robertson that the numbers in section (2) of the By-law 494/76 namely (2a),(2b), (2c) and the reference to Fairport Community be deleted and that the areas be called Bay Ridges, West Shore and Rosebank. OTHER BUSINESS Fairport Core Study meeting Concerns were expressed relative to the of Douglas Park and the Douglas Ravine. these items it should be noted that the is meant in terms of the development of and the enhancement of the ravine. development To clarify development the park Public Participation Meeting - December 15th 1976 There was concensus among the member of Council that the second meeting to be held on December 15th 1976, for the Fairport Core Study, be postponed to January 13th 1977. Durham Health Council - Nominations A letter from Councillor Matheson was received asking for nominations of citizens willing to sit on the Durham Health Council. These citizens should be either consumers or providers of health. It was noted that this is a voluntary position. The final dated for nominations is November 15th 1976. Council and Staff Canvas of Highrise Council members were reminded of the United Way Appeal Canvas of the highrise on Thursday, October 21st 1976 at 7:00 p.m. North Pickering Development - Clarification The Mayor wished to clarify a point that was made in a column written by Councillor Spratley. He indicated that the North Pickering Development was planned in consort with Pickering and also the Region of Durham staff. The development and financing of the North Pickering Project is being planned in such a way as not to be a burden to existing tax payers. - 125 - 30/76 (VII) CONFIRMATION BY-LAW By-Law Number 496/76 Councillor Searle, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meetings held on the 27th day of September and October 18th 1976 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. TENDER - T-31-76 - SAND FOR WINTER CONTROL That the tender of Harnden & King Construction Limited be accepted for the supply of Winter Sand in the amount of $1.59 per ton, subject to the approval of the Ministry of Transportation and Communications, as recommended by the Director of Public Works in his memorandum dated September 30th 1976. TAX ARREARS - AIRPORT AREA That the report of the Treasurer-Collector dated October 4th 1976 with respect to tax arrears within the Airport Area be received and that copies of it be forwarded to: The Minister of Finance The Minister of Public Works Mr. Norman Cafik, M.P. and that a letter be directed to the Federal Authorities requesting immediate payment of the outstanding arrears. BAY RIDGES COMMUNITY CENTRE - FINANCING That the report of the Treasurer-Collector dated October 4th 1976, dealing with the Bay Ridges Community Centre financing be approved and that: 1. The Lot Development Fee Reserve Fund make a financial contribution to the Bay Ridges Community Centre Capital Fund in the amount of $180,000.00 from the excess fund still remaining in the Reserve Fund after allowing for the annual net debenture charge require- ments. 2. The Region of Durham and the Ontario Municipal Board (E 751122) be advised that we will not be seeking debenture financing for this Capital project nor will we be showing any debt on our books. Freeman of Bramalea Limited, dated September 22nd, dealing with future sewage capacity be received and that the Bramalea Group be advised that they will be considered for future allocation of sewage capacity, consistent with the approval growth pattern, approved by Council through the Secondary Plan process. GREENWOOD COMMUNITY CENTRE - ROOF REPAIRS That the report of the Administrator-Clerk dated October 6th 1976 be adopted and that an over-expenditure in Account # 2718-2435 in the Parks and Community Centres Budget, in the amount of $2,075.00, be authorized in order that the necessary roof repairs can be carried out to the Greenwood Community Centre and that the quotation of Pollard Roofing Limited in this amount be adcepted. DISCHARGE OF FIREARMS BY-LAW That Mr. Glenn Julian's letter dated October 4th 1976 dealing with the banning of hunting within the Town of Pickering be received and that no change to the Town's Discharge of Firearms By-law 247/75 be made at this time, as recommended by the Administrator- Clerk in his report dated October 5th 1976. INTERSECTION - GLENANNA AND LIVERPOOL ROAD That the report of the Administrator-Clerk dated September 20th 1976 with respect to the intersection of G1enanna and Liverpool Road be received. ACCOUNTS FOR APPROVAL That the Accounts dated September 30th 1976 to the amount of $1,709,791.88, as submitted by the Administrator- Clerk be approved. FRINGE BENEFITS - FIRE CHIEF That the Mayor and Clerk be authorized to enter into a Supplementary Pension Plan agreement with O.M.E.R.S. for a 2% Type 2 Plan, covering the Fire Chief, as recommended by the Administrator-Clerk in his report of September 29th 1976.
