Myslik Deputy Clerk - (I) CONCESSION THREE RECONSTRUCTION Resolution 45/76 Moved by Councillor Robertson, seconded by Councillor Matheson that WHEREAS the Corporation of the Town of Pickering desires to undertake the extension of the road access to the Metropolitan Toronto Sanitary Sites; AND WHEREAS the Corporation agrees to carry out the work in accordance with the requirements of the Public Transportation and Highway Improvement Act; AND WHEREAS the Corporation requests approval of said work and the consent of the Minister of Transportàtion and Communications to include the total expenditure made or such portion of that amount as may be considered proper in the statement submitted for subsidy under the said Act; BE IT THEREFORE RESOLVED that this work, estimated at $560,700.00 of which Metropolitan Toronto contribution will be $252,700.00, be authorized by the Council of the Town ,of Pickering. CARRIED Resoltion 48/76 - Item #3 HYDRO PARK - SANDY BEACH ROAD Moved by Councillor Spratley, seconded by Councillor Robertson that Council confirm the commitments made by the Mayor with respect to the assumption of the Sandy Beach Road Park, presently operated by the Metropolitan Toronto and Region Conservation Authority, and that provision be made in the 1977 budget for the inclusion of this park within the Town's park system. CARRIED Resolution 50/76 - Item #7 ONTARIO MUNICIPAL RECREATION ASSOCIATION Moved by Councillor Spratley, seconded by Councillor Anderson that Councillor Searle be authorized to attend the Ontario Municipal Recreation Association Annual Congerence in Sault Ste. Marie on May 26th to May 29th 1976. AMENDMENT Moved by Councillor Anderson, seconded by Councillor Robertson that any, other member of Council may participate in the Ontario Municipal Recreation Association Annual Conference. CARRIED AS AMENDED Resolution 51/76 - Item #10 Moved by Councillor Seale, seconded by Councillor Anderson that a by-law be prepared authorizing the Mayor and Clerk to enter into a Licence Agreement with the owner covering the encroachment of a building on the road allowance, as illustrated in the Ministry of Housing.North Pickering Project drawing Number 6350-214. ' CARRIED - 39 - 10/76 (III) RESOLUTIONS (Continued) Resolution 52/76 Moved by Councillor Anderson, seconded by Councillor Robertson that the following Department Head Reports for the month of March 1976 be adopted: Administrator-Clerk's Department Planning Department Treasury Department Legal Department Fire Department Public Works Department Recreation and Transportation Department CARRIED Resolution 53/76 - See Appendix 4 Moved by Councillor Matheson, seconded by Councillor Robertson that whereas Section 636a of the Municipal Act as enacted by Statutes of Ontario, 1973, c.124 transfers the responsibility for the hearing of the applications for cancellation, reduction or refund of taxes to the Council of the Municipality; AND WHEREAS notices in writing of applications have been received by the Clerk of the Municipality for the cancellation, reduction, and refund of taxes for various reasons; AND WHEREAS upon investigation and receipt of reasonable explanations all claims have been substantiated; BE IT THEREFORE RESOLVED that the Council of the Town of Pickering accept, the following list of applications and authorize the adjustment of taxes to be made accordingly. CARRIED Resolution 54/76 Moved by Councillor Robertson, seconded by Councillor Anderson WHEREAS the Public Tranportation and Highway Improvement Act requires the submission of a statement of proposed Transit Operating Expenditures to the Ministry of Transportation and Communications for approval; that; AND WHEREAS the additional Transit Capital Expenditures are estimated at $216,000.00 with subsidies estimated at $162,000.00; THEREFORE the Council of the Corporation of the Town of Pickering adopts the estimated expenditures and subsidies and submits same to the Ministry of Tranportation and Communications for approval. CARRIED Resolution 55/76 (1 ) Moved by Councillor Spratley, seconded by Councillor Anderson that By-law 373/76 is in conformity wi,th the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 15th day of March 1976; (2 ) No further Official Plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 373/76 and which said By-law would not be in conformity, including the District Plan of the Town of Pickering District Planning Area, Region of Durham which was adopted by Council February 17th 1975 and recommended to the Region of Durham for approval. CARRIED - 40 - 10/76 (III) RESOLUTIONS (Continued) Resolution 56/76 Moved by Councillor Searle, seconded by Councillor Matheson that the I.B.I. Group be instructed to prepare for Staff, two Alternative Design Schemes for the District Centre Study Area based on the Brock Road site as the major focal point. CARRIED (IV) BY-LAWS By-Law Number 378/76 Councillor Searle, seconded by Councillor Kitchen moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of an agreement dated February 26th 1976 between the Corporation of the Town of Pickering and Bramalea Consolidated Developments Limited respecting certain compliance with an agreement dated April 27th 1959 between the Corporation of the Township of Pickering and Crusader Development Corporation Limited, and that same be now read a first, second and thi~d time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-law to authorize the purchase of aerial fire vehicle and By-law to authorize the borrowing of money for the purpose of purchasing aerial fire vehicle. It was noted that $25,000.00 for the purchase of the aerial fire vehicle could be taken from one of the reserve funds and that the remaining $100,000.00 be debentured over a period of five years. MOTION Moved by Councillor Robertson, seconded by Councillor Spratley that By-laws number 2 and 3 of the meeting of April 12th 1976 be returned to staff and re-worded according to the intention of the Council. CARRIED By-Law Number 379/76 Councillor Matheson, seconded by Councillor Spratley moved for leave to introduce a By-law of the Town of Pickering to authorize speed limits: on highways under the jurisdiction of the Town of Pickering and to amend By-law Number 264/76, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. - 41 - 10/76 (IV) BY-LAWS (Continued) By-law Number 380/76 Councillor Searle, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Licence Agreement between the Corporation of the Town of Pickering and Consumers' Gas Company to permit them to establish a Ground Anode Bed and to repeal By-law Number 311/75 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 381/76 Councillor Anderson, seconded by Councillor Spratley moved for leave to introduce a By-law of the Town of Pickering to dedicate a one foot reserve on Shadybrook Drive as a Public Highway, Block E, Plan M-I057 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 382/76 Councillor Spratley, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to clarify the intention of the Council of the Corporation of the Town of Pickering in By-law Number 308/75 (Being a By-law to exempt certain parts of Plan M-1025 from part lot control) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 383/76 Councillor Robertson, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of an agreement between Ontario Housing Corporation and the Town of Pickering with respect to the financing of the provision of 36 Senior Citizens Units (Lot 20, and Block N, Plan M-998) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. - 42 - 10/76 (IV) BY-LAWS (Continued) By-law Number 384/76 Councillor Kitchen, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to prohibit "TURNS" at certain intersections or portions of highway within the Town of Pickering and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 385/76 Councillor Spratley, seconded by Councillor Anderson moved for leave to introduce a By-law of the Town of Pickering to regulate the collection and removal by the Corporation of ashes, garbage and other refuse and to repeal By-law Number 3817/70 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the. By-law Number 386/76 Councillor Anderson, seconded by Councillor Spratley moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of an agreement between the Corporation of the Town of Pickering and Monarch Marking System Limited with respect to the sale and purchase of Parts 4 and 5, Plan 40R-2638, Town of Pickering and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 389/76 - TWO READINGS ONLY (V) Councillor Robertson, seconded by Councillor Kitchen moved for leave to introduce a By-law of the Town of Pickering to amend restriced area by-law number 2511, as amended (Frenchman's Bay) and that same now be read a first and second time and that Council go into Committee of the Whole thereon. Traffic Lights - G1enanna and Highway #2 The question was raised as to when the traffic lights at the intersection of Glenanna and Highway #2 were to be installed. The Mayor is going to follow this up within the next 48 hours. Springfest at Sheridan Mall It was noted that the Springfest is to be held at Sheridan Mall and the Council and Public have been invited to this occasion. Municipal Liaison Committee Meeting The Mayor announced that he attended a Municipal Liaison Committee Meeting held April 12th 1976 at St. Lawrence Hall in Toronto. This was a Tri-level Municipal Meeting; however not many conclusions were arrived at. The Mayor also indicated that there is to be a Municipal/Provincial Liaison Committee Meeting to be held on April 13th 1976. provincial Paper - North Pickering It was indicated that Mr. Darcy McKeough tabled a paper pertaining to North Pickering when he presented the Ontario Budget. LOUIS ENCEPHALITIS That the report of the Durham Regional Medical Officer of Health with respect to St. Louis Encephalitis, submitted with his letter of March 8th 1976, be received for information and 1. That the Municipality embark upon a public education programme encouraging the citizens to eliminate any potential breeding areafor mosquitoes through the elimination of debris or material that might encourage the formulation of breeding areas. 2. That the Municipal staff take similar action during the first week of May with respect to Town-owned lands and in particular passive ravine areas. 3. The Municipality enter into negotiations with the Borough of Scarborough regarding the Borough's Encephalitis Spraying Programme in the Rouge Valley so that both sides of the valley will be sprayed. BRAMALEA DEVELOPMENTS LIMITED - AGREEMENT BETWEEN THE FORMER TOWNSHIP OF PICKERING AND CRUSADER DEVELOPMENTS LTD. That a By-law be prepared authorizing the Mayor and Clerk to sign an agreement dated the 26th day of February 1976 between the Town and Bramalea Consolidated Developments Limited, acknowledging the compliance by this Firm of the terms of an earlier agreement between the former Township of Pickering and Crusader Development Corporation Limited dated April 27th 1959 with respect to the provision of the construction of industrial space relative to the development of Block Y, Plan M-16. HYDRO PARK - SANDY BEACH ROAD That Council confirm the commitments made by the Mayor with respect to the assumption of the Sandy Beach Road Park, presently operated by the Metropolitan Toronto and Region Conservation Authority, and that provision be made in the 1977 budget for the inclusion of this park within the Town's park system. RUNNYMEDE DEVELOPMENT CORPORATION LIMITED - LETTER OF CREDIT That the Administrator-Clerk be authorized to grant a further reduction in the Letter of Credit held by the Municipality for the installation of services in the Runnymede Subdivision, Registered Plans M-I037, M-I038 and M-1039, from the present $2,650,000.00 to $2,285,000.00, as recommended by the Director of Public Works in his report of March 12th 1976. TENDER - STATION WAGON - FIRE DEPARTMENT That the tender of Jim Davidson Motors Limited be accepted for the supply of Station Wagon for the Fire Department, in the amount of $5,180.00, as recommended by the Town Buyer in his report of March 1976. 16th 6. J. 7. 8. 9. 10. 11. - 2 - APPENDIX 2 OUTDOOR ICE RINKS That the report of the Director of Recreation and Transportation dated March 11th 1976 with respect to the usage of outdoor skating rinks in the Town of Pickering be received for information and that the department continue to monitor the situation with a view towards a firm recommendation prior to the 1976/77 season concerning the advisability of closing down those rinks that are not extensively used. DEVELOPMENT AGREEMENTS - FEES That the following fees be charged for the preparation of agreements between the Town of Pickering and developers: 1. Condominium Agreements $150.00 2. Subdivision Agreements $600.00 JACK JACOBSEN CONSTRUCTION LIMITED - ONE FOOT RESERVE - BLOCK liE", PLAN M-I057 That a By-law be prepared removing the one foot reserve requested by Jack Jacobsen Construction Limited as follows: 1. Block "E", Plan M-I057 AND FURTHER that any reference plans required for the proper identification of the one foot reserve in question be prepared at the expense of Jack Jacobsen Construction Limited. DISPOSAL OF HOUSE BY PUBLIC AUCTION - REGION OF DURHAM SOUTH EAST CORNER OF FINCH AVENUE AND VALLEY FARM ROAD That the Region of Durham be advised that the Town of Pickering does not wish to acquire the Regional property, more particularly described as Part 9, Plan 40R-2181 and offered to the Municipality in Mr. C.W. Lundy's letter of March 9th 1976. RESOLUTION - CORPORATION OF THE TOWN OF HAWKESBURY That the resolution of the Town of Hawkesbury with respect to the costs of representatives who sit on the Board of Directors of the Association of Municipalities of Ontario not be endorsed. ACCOUNTS FOR APPROVAL That the Accounts dated March 15th 1976, to the amount of $1,493,657.36, as submitted by the Administrator- Clerk be approved. 12. 13. :1 " - 3 - APPENDIX 2 FIREFIGHTERS - MEMORANDUM OF SETTLEMENT That the Memorandum of Settlement negotiated between the Corporation and the Town of Pickering Professional Firefighters' Association, Local 1632, dated March 19th 1976, be accepted and approved. APPENDIX # 3 REPORT OF THE EXECUTIVE COMMITTEE OF APRIL 5th 1976 1. ~ MODIFICATION TO MINISTER'S ZONING ORDER M 5/76 - Mrs. Eileen White Part Lot 17, Concession 3 That the application by Mrs. E. White to modify the Minister's Zoning Order in respect to lands being part Lot 17, Concession 3, on the south side of the intersection of the Fourth Concession Road and Sideline 16, to permit the reconstruction of a residence with 315 feet frontage and 1.87 acres 10 t area be APPROVED, subject to the following conditions: \ 1. That a Site Plan Agreement be entered into between the applicant and the Town prior to final approval being granted which should include particulars in respect to the siting and appearance of the new dwelling. A satisfactory Agreement be also required to ensure the proper removal of the existing dwelling.
