CARRIED - 32 - 7/76 (III) RESOLUTIONS (Continued) Resolution 43/76 Moved by Councillor Matheson, seconded by Councillor Searle that: WHEREAS the Public Transportation and Highway Improvement Act requires the submission of a statement of proposed Transit Operating ExRenditures to the Ministry of Transportation and Communications for approval; AND WHEREAS the normal Transit Operating Expenditures for the year 1976 are estimated at $272,050.00 with subsidies estimated at $136,025; AND WHEREAS the normal Transit Capital Expenditures are estimated at $59,000.00 with subsidies estimated at $44,250.00; THEREFORE the Council of the Corporation of the Town of Pickering a~ the estimated expenditures and subsidies and submits same to the Ministry of Transporation and Communications for approval. CARRIED Resolution 44/76 <. Moved by Councillor Spra~ley, seconded by Councillor Robertson that: WHEREAS the Public Transportation and Highway Improvement Act requires the submission of a statement of proposed expenditures for roads to the Ministry of Transportation and Communications for approval; AND WHEREAS the normal expenditures for the year 1976 for road construction and maintenance is estimated at $904,400.00 with subsidies estimated at $460,000.00; THEREFORE the Council of the Corporation of the Town of Pickering adopts the estimated expenditures and subsidies and submits same to the Ministry of Transportation and Communications for approval. CARRIED (IV) BY-LAWS By-Law Number 371/76 (Two Readings Only) Councillor Kitchen, seconded by Councillor Robertson moves for leave to introduce a By-law of the Town of Pickering to stop up, close and sell Sideline 16/17 in Range II, Broken Front Concession, and part of Range III, B.F.C. Road, (Squires Beach Road south of Montgomery Park Road) re: Duffins Creek Water Pollution Control Plant, and that same now be read a first and second time, and that Council go into Committee of the Whole thereon. CARRIED By-Law Number 372/76 (Two Readings Only) Councillor Robertson, seconded by Councillor Spratley moves for leave to introduce a By-law of the Town of Pickering to stop up, close and sell part of Sideline 16/17 in Range III, Broken Front Concession, and part of Range III, B.F.C. Road Lot 17 (Squires Beach Road north of Montgomery Park Road) re: Duffins Creek Water Pollution Control Plant, and that same now be read a first and second time, and that Council go into Committee of the Whole thereon. CARRIED - 33 - 7/76 (IV) BY-LAWS (Continued) By-Law Number 373/76 Councillor Searle, seconded by Councillor Anderson moves for leave to introduce a By-law of the Town of Pickering to amend Restriced Area By-law Number 3036 (Big M Drive-In Restaurant) (Part Lots 23,24 Plan 489, Lot 27, Plan 492) and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 374/76 Councillor Matheson, seconded by Councillor Anderson moves for leave to introduce a By-law of the Town of Pickering to dedicate a one foot reserve on Downland Drive and White's Road as a Public Highway on Part of Block BX, Plan M-IO17, adjacent to Lot 127, Plan M-I017 (Tudor Glen Homes - Lookout Point) and that same be now read a first, second and third time and that the same be now final~y passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (V) OTHER BUSINESS 1. Sheridan Square - Garages This item had been broached at a previous meeting and it was indicated that this is an O.H.A.P. Development and some of the garages were eliminated but not all. It was noted also that the original intent of the zoning by-law is that, each home have a garage; however, the site plan committee deals with deviations from the by-law. It was suggested that Site Plan Agreements be discussed at the Executive Committee level. 2. Newspaper Advertisement re: Encephalitis It was noted that this advertisement placed in a local news- paper by Mr. A. Smith was very misleading. First of all there are no Pickering Health Authorities, and the Durham Social Services has held meetings concerning this matter already in February. Meetings concerning the problem are continuing to be held. It was noted also that the danger is very restricted. It is only one type of mosquito the "eulex"which feeds on birds and which may transmit the disease to man. A spraying campaign throughout the Region of Durham, that would adequately remove all danger would be very expensive~ be better to advise people of measures that they can take within their own properties in order to eliminate the danger of this mosquito. It was further noted that representatives from the Ministry of the Environment and from the Region of Durham will be in attendance at the Executive Committee Meeting of March 22nd 1976, in order to respond to any inquiries. it would - 34 - 7/76 (VI) CONFIRMATION BY-LAW By-Law Number 375/76 Councillor Anderson, seconded by Councillor Searle moves for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 15th day of March 1976, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. " ...."'" -' ", . '0 _8 ~ MODIFICATION TO MINISTER'S ZONING ORDER That the Application M 1/76 by J. Wong to modify the Minister's zoning Order in respect to lands being Part of Lot 10, Concession 6, on the east side of Westney Road, north of the King's Highway No.7, to permit consent by the Region of Durham Land Division Committee to create two parcels of land each with 100' frontage and one acre in area be REFUSED on the grounds that the proposal as submitted is not in compliance with the Town approved Rural Area Development Policy nor Zoning By-law 3037 and that the erection of two residential dwellings will detrimentally affect the agricultural development in that area. 2. DRAFT PLAN OF CONDOMINIUM That Condominium Application 02-18CDM-76-004 in respect to the townhouse development at Block C, Plan M-998 be APPROVED, subject to the following condition: 1. A satisfactory Condominium Agreement being entered into with the Town of Pickering and the Regional Municipality of Durham, if required. 3. DRAFT PLAN OF SUBDIVISION That the Draft Plan of Subdivision 18T-75523 being Part Lot 15, Range 3 by Captain Developments Limited be DEFERRED on the grounds that the proposed development is considered premature until a Secondary Plan for the Brock Industrial District is approved. 4. CONDOMINIUM DEVELOPMENT - REGION OF DURHAM That Planning Report #10/76 be received and forwarded to the Region of Durham for information and that the Region be informed that the Planning Staff of the Town is pre- pared to discuss further any matters within the Study on Condominiums. 5. P.A.R.U. CAPITAL EQUIPMENT NEEDS That the budget priorities identified by the P.A.R.U. Organization in their letter of February 26th 1976 to the Administrator-Clerk be approved and that provisions be made in the 1977 Budget for the purchase of radar equipment at an estimated cost of $3,200.00, subject to concurrence by the Town of Ajax. 6. AIRPORT That the letter of the Minister of Finance dated February 20th 1976 with respect to a possible solution to the tax payment procedure presently followed within the Airport Site within the terms of the Municipal Grants Act be received for information. 7. HAMLIN PROPERTY - HAMLET OF WHITEVALE That the Administrator-Clerk be authorized to call a public tender for the sale of the former Hamlin property in the Hamlet of Whiteva1e, acquired by the Municipality through the Tax Registration Procedure. 8. BUDGET - TREASURY DEPARTMENT That the 1976 Budget for the Treasurer's Department in the net amount of $2l8,045.00 be approved. /...2 ~~ ... ,I - 2 - 9. 1976 BUDGET - LOCAL - GENERAL PURPOSE RATES That the report of the Treasurer-Collector dated February 20th 1976 with respect to the 1976 Budget and the General Purpose Mill Rates be adopted and that these amounts be incorporated into the 1976 Tax Levy By-law. 10. TAXICAB COMPLAINTS That the report of the Town Solicitor dated February 27th 1976 concerning the complaints received with respect to Taxicabs be received for information. 11. SCHOOL CROSSING GUARDS That the report of the Town Solicitor dated March 2nd 1976 with respect to School Crossing Guards be adopted, and that additional School Guards be placed at the , intersection of Fanshaw Place and Krosno Boulevard. 12. FLUORESCENT TUBES - MUNICIPAL BUILDING That the report of the Town Buyer dated March 2nd 1976 with respect to fluorescent tubes for the Municipal Building be received for information. 13. PROPOSED CAPITAL EXPENDITURE PROJECTS That the letter of Mr. W.H. Palmer, Chairman of the Ontario Municipal Board, dated February 16th 1976 with respect to proposed capital expenditure projects and submissions to the Ontario Municipal Board be received for information. 14. REGIONAL TENDER - GASOLINE AND DIESEL FUEL That the tender of Texaco Canada Limited for gasoline at .673Ç per gallon and diesel oil at .620Ç per gallon be be approved, as recommended by the Town Buyer in his memorandum of February 20th 1976. 15. COSTS ASSOCIATED WITH THE RELOCATION OF REGIONAL SERVICES IN CONJUNCTION WITH ROADWORK That the letter of February 18th 1976 from the Region of Durham with respect to the Regional Policy on costs associated with the relocation of Regional Services in conjunction with roadwork be received for information. 16. SOLID WASTE DISPOSAL RATE REVIEW That the letter from the Region of Durham dated February 18th 1976 with respect to Solid Waste Disposal Rates be received for information. 17. TOWN INSURANCE PORTFOLIO That the recommendations contained in the Administrator- Clerk's report of February 20th 1976 on the Town Insurance Portfolio be adopted. 18. ACCOUNTS FOR APPROVAL That the accounts dated February 27th 1976, to the amount of $1,959,081.97, as submitted by the Administrator-Clerk, be approved.
