By-law Number 184/75 Councillor Searle, seconded by Councillor Robertson, moves for leave to introduce a By-law of the Town of Pickering to number the homes and lots in Registered Plan M-lOO7 and M-1O17, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. - 29 - 6/75 By-law Number 185/75 Councillor Anderson, seconded by Councillor Spratley, moves for leave to introduce a By-law of the Town of Pickering to allow a uniform credit in respect to real property taxes to certain elderly residents, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. Council suggested that possibly a flyer could be included in the next tax mailing to advise the residents of the passing of this by-law. Another suggestion was that perhaps a list of senior citizens receiving the old age supplement assistance could be obtained from the appropriate governmental authority and these people could be advised directly of the availability of this credit. By-law Number 186/75 Councillor Kitchen, seconded by Councillor Robertson, moves for leave to introduce a By-law of the Town of Pickering being a restricted area by-law to implement the Official Plan of the Town of Pickering in Part Lot 22, Concession 1, Town of Pickering, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 187/75 Councillor Anderson, seconded by Councillor Spratley, moves for leave to introduce a By-law of the Town of Pickering to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lot 30, Plan 509, Town of Pickering (Paddock Developments Ltd.), and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. By-law Number 188/75 Councillor Kitchen, seconded by Councillor Anderson, moves for leave to introduce a By-law of the Town of Pickering to amend restricted area by-law 2511, as amended (Royal Canadian Legion), and that same be now read a first, second and third time, and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (V) - 30 - 6/75 OTHER BUSINESS 1. 2. 3. 4. Councillor Matheson inquired concerning the results of the flag design contest and was advised that the Recreation Department had extended the deadline to the competition for a further week to accommodate a number of late entries. It was suggested that in future when Council establishes a specific terminal date for a program that they should be advised if this date is to be altered. Councillor Spratley inquired as to whether or not Metropolitan Toronto had supplied the supportive material to their application for the Brock North Sanitary Landfill Site to the Ministry of the Environment. He was informed that they had been given until the end of February to make their submission. Councillor Robertson asked that appropriate steps be taken to enforce the no parking on boulevards in the Bay Ridges area to avoid damage to these areas during the time that the ground was soft in the spring months. Council was of the opinion that much greater emphasis should be placed on enforcing the parking by-law as it related to this particular problem. Councillor Kitchen noted that he had requested that action be taken concerning a car parked on the boulevard on Liverpool Road, and the car was still there, although the original request was made two weeks ago. Councillor Spratley felt that Council should register in the strongest terms possible its objection to the use of the Brock Road as the service corridor to the new airport. NEW VEHICLE - ~T. JOHN AMBULANCE BRIGADE That the Town of Pickering donate to the Pickering Division of the Ajax/Pickering 8t. John Þmbulance Brigade a sum not to exceed $4,500.00 towards the purchase of a vehicle to serve as a dressing station and that this amount be included in the 1975 budget. 3. KROSNO WATERCOURSE PROPOSAL That any decision on the Krosno Watercoursebe deferred until all ratepayers be ma¿e aware of the technical and financial aspect of the various proposals at a meeting with the Engineerinq Consultants, and that Mr. Ralph Bradley be Chairman of the meeting. 4. FIRE ACCESS ROUTES That a By-law be passed prohibiting the parking of motor vehicles in fire access routes to and from apartment buildings and other structures used for the accommodation of the public or for the gathering or assembling of people. 5. QUARANTINE FEES 6. That the Ontario Humane Society be requested to maintain the existing quarantine fees for animals until such time as the question can be considered by the Regional Animal Control Committee, as recommended by the Solicitor in his report of February 19th 1975. SIMON-HENRY/KAPTYN DEVELOPMENTS LIMITED That the request of John Kaptyn of Captain Developments Limited with respect to an extension of time for registration of the proposed Plan of Subdivision, Simon-Henry/Kaptyn Estates Limited, Part Lot 17, Range 3, Town of Pickering, until June 8th 1975, be granted; and that no further extension be granted under existing conditions. continued......2 - 2 - 7. ZONING REGULATIONS - BAYLY STREET That the Planning Department and the Solicitor prepare a By-law permitting retailing as an accessory use on the two properties on the north and south sides of Bayly street designated as Plan WR-82 Part 3, owned by Wagner & Sons Auto Body Limited, 1543-1555 Bayly Street, and Part of the south half of Lot 19, Concession 1, and P. 40R-1000 Part 2, owned by Palm Drive Developments Limited, 1640-1670 Bayly Street. 8. FIRST BAY RIDGES CUB AND SCOUT GROUP COW1ITTEE That a grant of $175.00 be paid to the OWASCO District council of the Boy Scouts of Canada to assist the Council in the cost of sending seven scouts from the Town of Pickering to the World Jamboree, and that Council endorse the efforts of the District Council in raising funds for this venture. 9a) !~OUNT ZION CO~.MUNITY CENTRE & 1975 RECREATION BUDGET That an additional amount of $1,100.00 he provided for the Mount Zion Community Centre addition to complete the work required for hydro and health approval, as recommended by the Director of Recreation and Transportation in his report to the Manager dated February lOth 1975, and that this amount be taken from the Recreation Peserve Fund, G/L # 4238. 9b) That the initial program, as outlined by the Director of Recreation and Transportation in his memorandum to the ~1anager of February lOth 1975, be adopted, but that the cost towards the orchestra be subsidized to one third of the cost i.e. $1,000.00 instead of the item of fences on Douglas Ravine~ which item is to be removed from the 1975 departmental budget estimates. 9c) That the reco~~endation of the Director of Recreation and Transportation to the Manager dated February 10th 1975 with respect to the development of creative playground equipment be adopted. 10. ACCOUNTS FOR APPROVAL That the accounts as presented by the Manager dated February 17th 1975 be approved. 11. ¡'-IRPORT That whereas the Federal Government has made the decision to proceed with the construction of a new airport, and whereas the vast majority of the proposed site is located within the Town of Pickering, and whereas virtually all of the physical structures will be located within t~e To~n of Pickering, And whereas the life style of many long time Pickering residents will be upset in the name of progress, and whereas much "blood, sweat and tears" has been put into the affected land by generations of "Pickering people" ~~o would at least leave a heritage through the name of their community, and whereas the proposed airport has been commonly referred to and known as lithe Pickering Airport" and/or lithe Airport in Pickering", be it therefore resolved that the Federal Government be requested to name the new airport to be located at Pickering "The Pickering International Airport II . continued......3 - J - l~. PALM DRIVE DEVELOPHENTS - EAYLY STREET & BROCK ROAD That Resolution # 17/75, Item # 16 of the Council meeting held on February 17th 1975 be extended to include the following clause:- 1. That the one foot reserve be lifted on condition that the ten foot road widening across the entire frontage of the property be dedicated to the Region of Durham. APPENDIX I - .. (DURHAM WOODS INDUSTRIAL SUBDIVISION) The Town of Pickering receive the Durham Woods Master Plan as submitted by Runnymede Development Corporation and consider same as input to the Secondary Planning process for Brock Industrial Distrïct. 1. 2. A Development Control By-law be approved over the total development. The owner enter into Development Agreements with the Town of Pickering and Region of Durham to ensure the provisions of this approval are implemented. 3. 4. fchedule B, Poads Plan requires the following: Dedication to the appropriate jurisdiction of: a) b) c) 1) 60' from centre line along Bayly Street, including corner roundings. 2) 50' from centre line along west side of Church Street north of Bayly including corner roundings. 3) 43' from centre line along west side of Church Street south of Bayly including corner roundings and jog elimination. 4 ) 50' from centre line along Station Road north of Bayly Street including corner roundings. 5) 43' from centre line along east side of Station Road south of Bayly Street including corner roundings. 6) 7) 43' from centre line of Dreyer Drive. the jog elimination on McKay Road extension 8) 38' from centre line of local streets A, F, Plummer street (Extension) and Kellino street extension. Dedication of 1 ft. reserve as outlined on Schedule Provision of Blocks D, v, R, f and T on Station Road and Church Street north of Bayly for purchase as road allowance to 60 ft. from centre line including corner roundings, if required. These blocks may not be used in calculation of yards or coverage. Schedule C Land Use a) The land use schedule be described by the following 1) Restricted Light & Prestige Industriål 2) Light Industrial 3) General Industrial (These descriptions are drawn from the District Plan) b) The above land uses be implemented through By-law 2511. By-law 2511 be implemented to provide for the development of Blocks F.G.J and K under the Ml Storage and Light Manufacturing Zone, and the development of Blocks A. B, C, D, E, H, I, L, M, N, 0, P and W under the M2 Industrial Zone. c) The subdivision of lots by Consent to sever the Blocks shall use the guideline that lot frontages should be approximately one-half the depth~ d) Business & Professional Offices and Commercial shall not be permitted in M1 or M2 zones until the completion of a Secondary Plan. e) The following provisions shall be included in the development agreement but do not require inclusion into a Zoning By-law Amendment: i) M1 and M2 Minimum front yard 50 ft. II rear yard 25 ft. II side yard 25 ft. Side yard on corner 50 ft. ii) Maximum building coverage 50%. iii) Parking facilities be provided at 1 space / 600 sq.ft. for industrial uses 1 space / 300 sq.ft. for accessory office use. f) The following provisions shall be included in the development agreements and do require a re-zoninq by-law amendment: i) Paved areas shall not exceed 50% of the required front yard. ii) M2S shall be re-zoned to the appropriate use Ml or M2. iii) The reduction in side and rear yard requirements when abutting a railway spur and no rail spur shall be located in the front yard. 5. Schedule D Architectural and Landscaping Controls a) Three levels of architectural control are i11istrated on Schedule 0 and shall be included in the development agreement as follows: - 3 - i) Levell The following standards shall apply to uses fronting and/or exposed to Bayly Street and Highway 401: Building Materials Permitted materials shall include: Brick Precast concrete Glass Prefinished metal siding with minimum coating equal to Stelco * 5000 shall be used for trim and decoration only and shall not consist of more than 30% of any wall. porcelain enamel, aluminum, steel or other metal panels with an architectural finish shall be used for trim and decoration only and shall not consist of more than 30% of any wall Prohibited materials shall include: Decorative architectural unit masonary and plain concrete block - *except for one expansion wall. * This item refers only to the north frontage of Bayly Street if the property does not face on both Bayly and Plummer Streets. Used or reclaimed materials Structural tile Stucco Plain concrete* and/or wood** * Materials such as plain or refinished concrete may be used subject to the approval of the Town of Pickering, when subject to treatment in an architectural manner, such treatment to include ribbed forms, jack hammering and sand blasting. ** Wood may be used as a decorative material for fascias, soffits, doors, frames and trim, subject to the approval of Town of Pickering. Any other material may be suggested but use is subject to Town of Pickering approval. Landscaping To complement the building materials used, landscaping shall be provided in such a manner as to enhance the visible frontages of uses along Highway 401 and Bayly Street. Landscaping plans illustrating planting and related landscape materials other than lawns, shall be submitted to Town of Pickering for approval before a~plication for building permits. A minimum standard of $1,500.00 per acre shall be applied for such landscaping. The woodlot outlined on Schedule D shall be preserved, lots shall be created and buildings sited so as to maintain the woodlot. ii) Level 2 The following standards shall apply to uses fronting along Church Street and Station Road: Building Materials Permitted materials shall include: - brick - precast concrete - glass prefinished metal siding with minimum coating equal to Stelco #5,000 - decorative architectural unit masonry _. <1 - - porcelain enamel, aluminium, steel or other Metal panels with an architectural finish. Any other material may be suggested butuse is subject to Town of Pickering Approval. A minimum standard of $1,500.00 per acre shall be applied for such landscaping. b) The Development Controls and Land Utilization statement as included below sha\l~be undertaken by Runnymede Development Corporatio~are acceptable to the Town of Pickering. Runnymede Development Corporation shall exercise the following controls related to approvals and land utilization, by registrations on title. 1) Approvals Erection of Buildings no building, structure, or any addition thereto shall be erected on the said lands unless written approval of the plans and specifications has been received from Runnymede Development Corporation, its successors, heirs and assigns. Use of Industrial Lands, Buildings or Structures no such lands, buildings or structures shall be used for any purposes other than manufacture, fabricating, processing, repair, assembly or storage of any products except as ancillary services, offices and caretaker's quarters subject to the approval of Runnymede Development Corporation, its successors, heirs and assigns. Preparation of Designs all plans and specifications be prepared qr reviewed by a Engineer, and shall bear his Criteria for Approval approval of plans and specifications shall be based on con- siderations such as operations and uses, adequacy of the site plan, adequacy of structural design, harmony of external building and landscaping design with neighbouring sites, effect of location and use of building on neighbouring sites; relation of topography, grade, and finished ground elevation of the site to that of neighbouring sites,and conformity of the plans and specifications generally to the advancement of a quality Industrial Park. Application for Approval application to Runnymede Development Corporation, its successors, heirs and assigns for approval shall include, but not necessarily be limited to, the following: - site plan and specifications indicating the dimensions and area of the land, the existing and proposed contours of the land, the location of buildings and structures (including distances from front, side and rear lot lines), the location of driveways, parking and loading areas, the location of a central refuse collection area, submitted for approval must registered Architect or stamp. - 0 -. rail s}.ur' "t l.;c:Ll.Ltic'~1 ~i()Gci(:ct areù;:c, :~LecD, shrubbery and gardens, fences, signs, exterior lighting, all proposed operations on or uses of the land, buildings and structures, and staging of development. building dra'tlÌngs and speci fications indicating floor plans, all area calculations, all elevations, description of exterior materials, finishes and colours, coloured perspective drawings from the street view, all operations and uses and staging of development. The word building or structure shall include, but without limiting the generality of the foregoing, any water tower, smoke stack! power transformer, pump house, roof structures, air-condition unit tank, underground facilities and services or any addition to/any building or structure. 2) Land Utilization Transfer of Lands The Grantee shall not re-sell any lands or any part thereof to any persons, firm or corporation without first offering to sell the said lands back to Runnymede Development Corporation, its successors, heirs and assigns, at the original purchase price; nor shall the grantee sub-lease any lands held by him on a leasehold basis. Notwithstanding the above, the grantee shall retain the right to transfer such lands to a direct subsidiary, company or corporation provided that the grantee holds a clear ownership or controlling majority interest in such subsidiary company or corporation. Schedule of Building Construction Runnymede Development Corporation, its successors, heirs and assigns, reserves the right to re-purchase lands sold to the Grantee or to cancel lease agreements if no buildings are erected, or commence to be erected within eighteen (18) months after date of closing. Such right to re-purchase land or to cancel lease agreements will be exercised within thirty (30) days after the expiration of the required building period. Runnymede Development Corporation, its successors, heirs and assigns, may re-purchase the lands from the Grantee at the original purchase price without interest. Site Improvements All site work including landscaping and paving, must be completed within six (6) months of the completion of building construction. Surplus Lands Runnymede Development Corporation Limited, its successors, heirs and assigns, shall at its option have the right to repurchase any lands or part thereof not used by the grantee, and which the grantee wishes to sell, lease or transfer, such option to be exercised within thirty (30) days of notice by the grantee to Runnymede Development Corporation, its successors, heirs and assigns, that the grantee wishes to sell, lease or transfer. Such re-purchase to be at the original purchase price, less real estate commissions or any accrued taxes. Re-Purchase of Lands Upon payment by Runnymede Development Corporation, its successors, heirs and assigns, of the balance of the price due upon such re-purchase of the lands, the Grantee will release and convey to Runnymede Development Corporation, its successors, heirs and assigns, alJ right, title and interest of the Grantee free and clear of all liens, charges or other encuIT~rances. - 7 - Public Access Areas not in the initial development stage shall have direct access to a developed public thoroughfare. 3) Performance Standards Obnoxious Uses The lands or any part thereof, any building or structure erected or placed thereon, shall not be used for any purpose and in any manner which shall be a nuisance to the occupants or owners of any neighbouring lands or buildings by reason of emissions from the lands, building or structure such as odours, gases, dust, smoke, noise, fumes, cinders, soot, waste, radiation or vibration, or be contrary to local, regional, provincial or federal legislation controlling pollution. Industrial Waste No effluent, liquid, or semi-solid industrial waste shall be discharged onto the surface or into sanitary sewers unless approval is obtained from the Ministry of the Environment, the Department of Public Health of Ontario and the Town of Pickering. c) The Development Agreement shall ensure Site Plan Approval by the Town of Pickering on all properties created, using the guidelines outlined in (a), (b) and (d) . d) Site Plan approval shall include: i) Location and type of all signs ii) All front and side yards to the rear face of the building shall be landscaped with lawns and planting areas, in addition to hard surface paving or driveways and parking areas. iii) Electrical substations shall not be located in the front yard or between the closest building wall and adjacent street on a corner lot. iv) No loading facilities shall be located in any required front yard. '. v) Interior truck loading facilities may be located to the rear of any required front yard on the front exposure of a building, subject to a minimum set- back of 25 feet from the building wall closest to the front lot line vi) The use of lands in Blocks C and A at Station Road ~d the C. N. R. shall be developed so as not to ~hibit the creation of a Station Road-fly over at the C.N.R. and 401. 6. Street Names to be approved by the Town of Pickering 7. 5% Dedication under the Planning Act shall be required, a portion of which shall be located in the industrial district. 8. The Development shall be fully serviced and subject to the Approvals of Town of Pickering and Region of Durham Councils.
