Taylor Town Manager Town Clerk (I) ADOPTION OF MINUTES Meetings of May 7th 1979 and May 14th, 1979 ( I I) RESOLUTIONS Resolution 62/79 See Appendix 1 Moved by Councillor Geraghty Seconded by Councillor Fisher The the Executive Committee Report of May 14th, 1979, be adopted. CARRIED Resolution 63/79 Moved by Councillor Kitchen Seconded by Councillor Dickerson That Whereas the Government of the Province of Ontario has encouraged residential growth east of Metropolitan Toronto, including the Town of Pickering; and - 62 - 13/79 Resolution 63/79 - continued Whereas the various Ministries including the Ministry of Education have been well aware of the impending development of the Town of Pickering because of the lengthy planning process; and Whereas because of the above the population in South Pickering has grown dramatically and will continue to do so; and Whereas school facilities in the vicinity of new subdivisions are completely inadequate to serve the needs of our new residents; THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING go on record as being in complete support of the efforts of the Durham Board of Education and the parents of Pickering, to secure additional Education facilities at the earliest possible moment and that this resolution be circulated to: The Minister of Education The Hon. Bette Stephenson, The Minister of Housing The Hon. Claude Bennett, The Minister of Economics and Intergovernmental Affairs, The Hon. Thomas Wells, The Durham Board of Education; and the Home and School Association of Vaughan Willard Public School; and G. Ashe, M.P.P. CARRIED (III) BY-LAWS Councillor Cahill, seconded by Councillor Fisher moved for leave to introduce By-laws of the Town of Pickering: By-law Number 988/79 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, on Part of Lot 22, Concession 1, in the Town of Pickering. - 63 - 13/79 (III) BY-LAWS - continued By-law Number 989/79 Being a by-law to authorize the execution of a lease Agreement between the Corporation of the Town of Pickering and Blades Summer Hockey School Inc. respecting the use of certain facilities at the Don Beer Arena and certain other recreational facilities. By-law Number 990/79 Being a By-law to authorize the execution of a Site Plan Agreement between the Corporation of the Town of Pickering and The Hurlstone Development Corporation with respect to Part Lot 18, Range 3, B.F.C., Pickering (Part 2, Plan 40R-3303) By-law Number 991/79 Being a By-law to authorize the execution of a Site Plan Agreement etween the Corporation of the Town of Pickering and Orangebrook Developments Limited and Ballycroy Investments Limited respecting Part Lot 18, Range 3, Broken Front Concess- ion, Pickering (Part 1, Plan 40R-1986) (LD 215/78) By-law Number 992/79 Being a by-law to authorize the execution of a Site Plan Agreement between the Corporation of the Town of Pickering and Orangebrook Developments Limited and Ballycroy Investments Limited respecting Part Lot 18, Range 3, Broken Front Con- cession, Pickering (Part 1, Plan 40R-4166) (LD 216/78) By-law Number 993/79 Being a by-law to authorize the execution of a Site Plan Agreement between the Corporation of the Town of Pickering and Orangebrook Developments Limited and Ballycroy Investments Limited respecting Part Lot 18, Range 3, Broken Front Con- cession, Pickering (Part 2, Plan 40R-4666)(LD 217/78) By-law Number 994/79 Being a by-law to authorize the execution of Site Plan Agreement between the Corporation of the Town of Pickering and Orangebrook Developments Limited and Ballycroy Investments Limited respecting Part Lot 18, Range 3, Broken Front Con- cession, Pickering (Part 1, Plan 40R-4666) (LD 218/78) By-law Number 995/79 Being a by-law to authorize the execution of a Site Plan Agreement between the Corporation of the Town of Pickering and Orangebrook Developments Limited and Ballycroy Investments Limited respecting Part Lot 18, Range 3, Broken Front Con- cession, Pickering (Part 1, Plan 40R-4526) (LD 219/78) By-law Number 996/79 A By-law of The Corporation of the Town of Pickering to levy such rates against all of the assessed properties in the Town of Pickering as will be required to cover the such rates against all of the assessed properties in the Town of Pickering as will be required to cover the 1979 requisitions from the Durham Board of Education and the Durham Roman Catholic Separate School Board. 13/79 - 64 - THIRD READING Councillor Cahill, seconded by Councillor Fisher moved that the report of the Committee of the Whole on By-law Numbers 988/79, 989/79, 990/79, 991/79, 992/79, 993/79, 994/79, 995/79 and 996/79 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. By-law Number 997/79 Being a By-law to provide for the rules of order of the Council and its Committees. DEFERRED (IV) 1. OTHER BUSINESS Councillor Fisher stated that the Police are not enforcing the "discharge of firearms" by-law and after some discussion, the following motion was introduced: Resolution 64/79 Moved by Councillor Geraghty Seconded by Councillor Fisher That by-law 247/75 (discharge of firearms) be amended to extend the area prohibiting the discharge of firearms to include the North Pickering Hiking Trail. CARRIED 2. Councillor Dickerson stated that he received a reply from the Region in response to Councillor Kitchen's inquiry regarding the lighting of the Liverpool Road pumping station. - 65 - 13/79 (IV) OTHER BUSINESS - continued 3. Councillor Kitchen requested staff to investigate parking problems which occur on the south end of Liverpool Road on weekends. Councillor Cahill individually censured Councillor Dickerson for conducting public meetings with respect to emergencies arising from the Pickering Nuclear Generating Station in contravention of Council's resolution appointing Councillor Kitchen to investigate this matter. 4. (V) CONFIRMATION BY-LAW By-law Number 998/79 Councillor Fisher, seconded by Councillor Dickerson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the May 22nd 1979, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (VI) ADJOURNMENT The meeting adjourned at the hour of 7:55 P.M.. DISCHARGE OF FIREARMS FILE NUMBER - A 2310.101 That the recommendation to amend By-law 247/75 to prohibit the discharge of firearms south of Highway #7 be not approved. 2. AIRPORT TAX ACCOUNTS FILE NUMBER - C 5380 FILE NUMBER - B 3500 That the report of the Treasurer-Collector dated March 22, 1979 dealing with Airport Tax Accounts, Unpaid Penalty and Interest, be received; and that the Town Manager be directed to inform Mr. P.A. Pensa, Regional Manager, Property Sales, Government ~f Canada, with a copy to the Hon. N. Cafik, that the payment of $6,168.51, being the unpaid penalty and interest on various airport tax accounts, is requested. ,4- ') ~-' r' ,.; APPENDIX II - 2 - 8/79 TOWN OF PICKERING The Executive Committee having met April 23rd, 1979, presents its seventh report to the Council of the Town of Pickering and recommends: ,4> 1 . BROUGHAM COMMUNITY CENTRE AND PARK FILE NUMBER F 2100 " '-':: That the Brougham Community be given until May 31st 1979 to demonstrate to the Town of Pickering that they are capable of: 1. Providing regular inspection and maintenance of the Brougham Community Hall; 2. Demonstrate, to the satisfaction of the Parks and Recreation Department that a meaning- ful program for the use of the Brougham Hall has been developed and will be ade- quately supervised; 3. Provide the names of persons who agree to accept the responsibility for both the Hall and program supervision; and In the event such assurances are not forth- coming, that the Municipality not renew the lease with the Federal Government on the Brougham Hall or the Brougham Community Park. FIREFIGHTING SERVICE IN THE RURAL AREA FILE NUMBER F 2420 i That the report of the Town Manager dated April 2nd 1979 with respect to the Firefighting Service in the Rural Area be received for information. . ~ .. .. 3. ENERGY CONSERVATION FILE NUMBER A 2310.6A That the Town of Pickering participate on a voluntary basis in the development of an energy conservation programme with the assistance of community resource groups and the Joint Steering Committee on Energy Conservation; and that Mr. Earle Pilkey be appointed as the Energy Co-ordinator. TENDER FOR RESURFACING AND COLORCOATING OF FOUR TENNIS COURTS FILE NUMBER C 4300 That tender T-13-79 submitted by Barber Tennis Courts Limited for the resurfacing and color- coating of four tennis courts in the amount of $9,800.00, be accepted. .; -: 5. DRAFT PLAN OF SUBDIVISION OF EAGLEBROOK INVESTMENTS LIMITED AND BALLYCROY INVESTMENTS LIMITED AT THE NORTHWEST CORNER OF OKLAHOMA AND EYER DRIVES FILE NUMBER B 4100 - 18T-77080 Whereas the Corporation of the Town of Pickering entered into a Subdivision Agreement, dated June 15th, 1978, with Eagle Brook Investments Limited and Ballycroy Investments Limited respecting the proposed subdivision of Lot 26 and Block C, Plan M-1007, and that part of Lot 28, Range 3, Broken Front Concession, designated as Part 1 on Plan 40R-2026 (Draft Plan 18T-77080); and .;. Whereas, clause (b) of section 36 of the said Agreement provides that the Town may, at its option of one month's notice to the owner, declare the said Agreement to be null and void in the event the plan of subdivision is not registered on or before May 1st, 1979; and W~'ereas, it is deemed expedient to indicate, a~ the request of the owner that no such action shall be taken by the Town until after October 31st, 1979; NOW THEREFORE, BE IT RESOLVED THAT: IF 1. The Corporation of the Town of Pickering shall not exercise its option under clause (b) of sect'ion 36 of the Subdivision Agreement dated June 5th, 1978, between it and Eagle Brook Investments Limited/Ballycroy Investments Limited, until after October 31st, 1979, and then only in compliance with the provisions of the said clause. 2. Section 1, above shall not be deemed to require the Corporation to exercise the said option after October 31st, 1979. . APPENDIX II - 4 - 8/79 7. SUBDIVISION OF PICKERING HEI GHTs-:JOlNT-VENTURE ON SHEPPARD AVENUE FILE NUMBER B 4100 ,'; That the request dated March 19th, 1979 from Fred Schaeffer and Associates Limited on behalf of Pickering Heights Joint Venture for a second reduction in the amount of the performance and maintenance of works security required for the development (east of White's Road) of the Pickering Heights Joint Venture Pickering Project, be approved; and that the amount of the reduction be $40,000.00 (i.e. from $100,935.00 to $60,935.00). - 8. WEED CONTROL FILE NUMBER A 2260.-19 That the Council of the Town of Pickering authorizes the publication of a Public Notice, regarding the destruction of weeds under the provision of the Weed Control Act of the Province of Ontario; and directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be destroyed in such a manner as they may deem proper; and that the expenses incurred by the said Weed Inspectors in the discharge of their duties shall be placed on the Collector's Roll of this munici- pality against the respective parcels concerned; and that such amounts shall be collected in the same manner as taxes under The Municipal Act. j -,,'" 9. ACCOUNTS FOR APPROVAL FILE NUMBER C 2310 That the accounts in the amount of $1,402,426.68 for the period ending April 17, 1979, as submitted by the Town Manager, be approved. .4 . 11. PART-TIME FIREFIGHTERS FILE NUMBER A 4300 That the Town Manager be authorized to increase the hourly rates of the Volunteer Firefighters and adjust the fringe benefit package, consistent with his report of April 9th 1979. 12. MUNICIPAL OPERATIONS FILE NUMBER E 5130.03 That the Town Manager be authorized to negotiate a lease agreement with J.D.S. Investments Limited for the use of a portion of the Pickering Corporate Centre on the southeast corner of Liverpool Road and Sheridan Mall Parkway by the Corporation of the Town of Pickering. 13. MUNICIPAL OPERATIONS FILE NUMBER E 5130.03 ... That the Administrative Departments of the Corporation of the Town of Pickering, namely Clerks, Legal, Manager's, Treasury and the Offices of the Mayor' and Council be relocated in the Pickering Corporate Centre. ONTARIO HYDRO EMERGENCY CONTINGENCIES FILE NUMBER F 2710.07 That the Town Manager arrange a meeting with officials of Ontario Hydro to discuss emergency contingencies in the event of a problem at the Pickering Nuclear Generating Station; and that Councillor Kitchen be appointed as Council's representative at any such meeting.
