HomeMy WebLinkAboutMay 14, 1979 (Special) - 59 - 12/79 SPECIAL COUNCIL MEETING A Special Meeting of the Pickering Town Council was held on Monday, May 14th 1979 at 7:00 P.M. PRESENT: Mayor J. Anderson COUNCILLORS: L. Cahill D. Dickerson G. Fisher N. Geraghty D. Kitchen K. Matheson ALSO PRESENT: N.C. Marshall - Town Manager B. Taylor - Town Clerk C.M.T. Sheffield - Town Solicitor T. Howard - Municipal Law Enforcement Officer This Special Council Meeting was called to permit Mr. Philip Smith, the holder of Taxicab Driver's Licence #47, to show cause why he believes that his Licence should not be revoked. Mr. Smith stated that the Police raided his house and charged him with possession of narcotics. His Taxicab Driver's Licence was forcefully removed from him and returned to the Town because of this charge. Mr. C.M.T. Sheffield, as Counsel for the Town outlined the history of Mr. Smith's application for a Taxicab Driver's Licence. Detective Sergeant Hodgson, speaking with the permission of Mr. Smith, outlined the various charges with which Mr. Smith has been convicted of or are pending. Mr. Hodgson stated there were a total of seven offences, none of which were involved with Mr. Smith's job as a taxicab driver. Mr. Sheffield concluded his presentation by stating that the Province had delegated the right to licence taxicab drivers to municipalities and this carried with it the discretionary right as to whom may be issued a licence. He stated that Mr. Smith has been charged with a total of seven offences of which there have been convictions in the past four months. Based on the evidence heard at this meeting, Mr. Sheffield recommended that Council revoke Mr. Smith's Taxicab Driver's Licence. After discussion amongst Members of Council and questions to the witnesses, the following resolutions were presented: Resolution 60/79 Moved by Councillor Dickerson Seconded by Councillor Cahill That based on the evidence heard at this Special Council Meeting that Taxicab Driver Licence #47 issued to Mr. Philip Smith, be revoked. CARRIED - 60 - 12/79 Resolution 60/79 (Continued) Recorded Vote: Yea: Nay: Messrs. Cahill, Dickerson, Geraghty, Matheson and Anderson Messrs. Fisher and Kitchen Prior to the aforementioned motion being put to a vote, the following amendment was presented: Resolution 61/79 Moved by Councillor Fisher Seconded by Councillor Kitchen That Taxicab Driver's Licence #47 issued to Mr. Philip Smith be revoked upon his conviction of all outstanding charges.
