Anderson (incapacitated) (I) ADOPTION OF MINUTES Council Meeting of January 8th, 1979 ( I I) PRESENTATION To Heather Margerison and Brenda Marjoram for receiving the Duke of Edinburgh's Award, Bronze Certificate and Badge. (III) 1. DELEGATIONS Mrs. Elizabeth Shumovich, representing the Rosebank Ratepayers Association, was in attendance to support the Rosebank Neighbourhood Plan as presented. 2. Mr. John R. Williams, representing residents on the north side of Bayly Street, east of Toy Avenue, was in attendance to object to the des- ignation proposed by the Brock Industrial Area Community Plan on the properties of the residents he is representing and request that the subject properties be designated "Associated Industrial". 3. Mr. Bruce Freeman of Bramalea Limited requested that the second sentence of section 3(a) of the Rosebank Neighbourhood Plan be deleted. 2/79 - 12 - (IV) RESOLUTIONS Resolution 14/79- See Appendix I Moved by Councillor Fisher Seconded by Councillor Geraghty That the Executive Report of January 15th 1979, be adopted. CARRIED Resolution 15/79 Moved by Councillor Dickerson Seconded by Councillor Fisher That the request of the Region of Durham for exemption from the requirement for Plumbing Licences and Permits for Regional staff carrying out plumbing works within the Town of Pickering not be granted. CARRIED Resolution 16/79 Moved by Councillor Cahill Seconded by Councillor Fisher That the tender for street lights #T-37-78 be deferred pending a further report on the details of the tender sub- missions. CARRIED Resolution 17/79 Moved by Councillor Cahill Seconded by Councillor Geraghty That the accounts dated January 8th, 1979, in the amount of $134,473.95, as submitted by the Town Manager, be APPROVED CARRIED 2/79 - 13 - Resolution 18/79 Moved by Councillor Fisher Seconded by Councillor Cahill That pursuant to Section 5.2.3 of the Official Plan of the Regional Municipality of Durham, the Brock Industrial Area Development Plan is hereby adopted with the following amendments: 1. that a land designation change from "Light Indust- rial" to "Associated Industrial" starting from a point at the intersection of Bayly Street and Toy Avenue and continuing north approximately 250 feet to a lot line and those properties front- ing on the north side of Bayly Street between Toy Avenue on the west and the railway spur line on the east, be incorporated. 2. the amendments outlined in the memorandum of the Planning Director dated January 17, 1979. CARRIED Resolution 19/79 Moved by Councillor Cahill Seconded by Councillor Geraghty That pursuant to Section 5.2.3 of the Official Plan of the Regional Municipality of Durham, the Rosebank Neigh- bourhood Development Plan is hereby adopted, with the following amendments: 1. the amendments outlined in the memorandum of the Planning Director dated January 18, 1979. the second sentence of section 3(a) is hereby deleted. 2. CARRIED Resolution 20/79 Moved by Councillor Dickerson Seconded by Councillor Fisher That By-law 929/78 is in conformity with the Official Plan of the Region of Durham and in force at the time this By-law was passed, namely the 21st day of, December, 1978; And that no further Official Plan has been proposed by Council nor approved by the Ministry of Housing since passing of said -By-law 929/78 in which the said By-law would not be in conformity. CARRIED 2/79 - 14 - Resolution 21/79 Moved by Councillor Kitchen Seconded by Councillor Geraghty Whereas it is desirable to have the residents within the Town of Pickering all listed in the appropriate telephone directory under the name of Pickering, with dual listings for residents within the West Hill and Markham exchanges; and Whereas a spokesperson for Bell Canada has indicated that this is feasible; Now therefore be it resolved that Bell Canada be requested to implement this consideration under the name of Pickering as soon as possible; and that a copy of this request be forwarded to the Canadian Radio and Television Commission. By-law Number 923/78 Being a by-law to amend the Plan for the District Planning Area of the Town of Pickering by the addition thereto of The Community Plan for the Brock Industrial Area. By-law Number 940/79 Being a by-law to authorize the execution of a Subdivision Agreement between Jack Jacobsen Construction Limited and the Corporation of the Town of Pickering with respect to Part Lot 1, Bostwick's Plan, Pickering (Draft Plan 18T-77051) 2/79 - 15 - By-law Number 941/79 Being a Restricted Area By-law to amend Restricted Area By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part Lot 18, Range 3, Broken Front Concession, in the Town of Pickering. By-law Number 942/79 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, and to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part Lot 28, Concession 1, in the Town of Pickering. By-law Number 943/79 Being a by-law to authorize the execution of Grant of Ease- ment between the Corporation of the Town of Pickering and Her Majesty the Queen In Right of Ontario as represented by the Minister of the Environment with respect to Blocks A, AX and BX-l in Plan M-l06. By-law Number 944/79 Being a By-law to change the names of streets in Registered Plan M-l017. By-law Number 945/79 Being a by-law to amend By-law Number 266/79 limiting the number of service stations and public garages. By-law Number 946/79 Being a by-law to authorize the execution of a Transfer between the Corporation of the Town of Pickering and the Regional Municipality of Durham of Blocks P, Q and R, Plan M-l038 (1' reserves - Finch Avenue) By-law Number 947/79 Being a by-law to appoint Mr. George Nunes as a By-law Enforcement Officer for certain purposes (fire route regulat- ions - Sheridan Mall) By-law Number 948/79 Being a by-law to authorize the execution of an Agreement between the Corporation of the Town of Pickering and J.D.S. Investments Limited respecting the enforcement of fire route regulations at Sheridan Mall. 2/79 - 16 - THIRD READING Councillor Fisher, seconded by Councillor Cahill moved that the report of the Committee of the Whole on By-law Numbers 922/78, 923/78, 940/79, 941/79, 942/79, 943/79, 944/79, 945/79, 946/79, 947/79, 948/79 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. OTHER BUSINESS Councillor Dickerson stated that uncollectible taxes are referred to a collection agency and not automatically written off. 2. Councillor Cahill commented on the reports of the Department Heads for the month of December, 1979, with particular stress on: a) the tonnage of garbage has substantially increased b) the Treasurer be commended for reducing the amount of tax arrears. c) that procedures for the issuance of building permits be improved. d) the consultants for the Dunbarton, Highbush, Woodlands Secondary Plan be urged to give improved public presentations. 2/79 - 17 - 3. Councillor Kitchen felt that commercial establish- ments should be made aware that it is illegal to shovel snow onto the road. (VII) CONFIRMATION BY-LAW By-law Number 949/79 Councillor Cahill, seconded by Councillor Geraghty moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the January 22nd, 1979, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (VIII) ADJOURNMENT The meeting adjourned at the hour of 9:08 P.M..
