Anderson COUNCILLORS: Cahill Dickerson Fisher Kitchen Natheson Stoner ALSO PRESENT: N. C. Marshall - Town Nanager Bruce Taylor - Town Clerk (1) ADOPTION OF MINUTES Regular Meeting of July 7, 1980. Special Meeting of July 7, 1980. Special Meeting of July 22,1980 ( I I) PRESENTATION To Nr. Harry Cook, on behalf of the Dunbarton-Pickering Kiwanis Club, for their donation of the handicapped transit vehicle. (III) RESOLUTIONS Resolution #95/80 Moved by Councillor Cahill Seconded by Councillor Fisher That the Minister of Housing be requested to modify Part 1 of the Pickering District Plan by the addition of a new section, Section, 5B1(b), following Section SB1(a), which will read: >" ~_.-_. 19/80 - 100 - Resolution #95/80 - continued B1(b) A new Local Central Area shall be permitted east of Brock Road in the Town Centre Community. This Local Central Area may contain up to approximately 6,968 square metres of gross retail and personal service floor space provided that approximately 4,181 square metres of this floor space is develop- ed as a major food store. Development of this Local Central Area shall occur in accordance with detailed policies established in a Develop- ment Plan approved by the Council of the Town of Pickering. CARRIED Resolution #96/80 Moved by Councillor Fisher Seconded by Councillor Kitchen That the report of the Director of Planning dated August 22, 1980 with respect to the Metropolitan Toronto and Region Conservation Authority Watershed Plan be adopted and that a copy be forwarded to the Authority to serve as the Munici- pality's official position concerning the Watershed Plan. CARRIED Resolution #97/80 Noved by Councillor Dickerson Seconded by Councillor Fisher That By-law 1158/80 is in conformity with the Official Plan of the Region of Durham and in force at the time this by-law was passed, namely the 7th day of July, 1980; and that no further Official Plan has been proposed by Council nor approved by the Ministry of Housing since passing of said By-law 1158/80 in which the said By-law would not be in conformity. CARRIED - 101 - 19/80 Resolution #98/80 Moved by Councillor Stoner Seconded by Councillor Fisher That the reports of the Treasurer-Collector dated July 25, 1980 and July 28, 1980 with respect to the funding of the pay-out of sick leave credits be endorsed and; that $245,000 be transferred to the Revenue Fund from G/L 4227 Sick Leave Credits (General Government) Reserve Fund. That $20,000 be transferred to the Revenue Fund from G/L 4226 Sick Leave Credits (Sanitation) Reserve Fund. That the unfunded balance of $52,687 of the July 18, 1980 General Government payout be recorded as an authorized over-expenditure of the Revenue Fund for the year 1980; and that the unfunded balance of $3,657 of the July 18, 1980 Sanitation Special Area payout be recorded as an author- ized over-expenditure of the Sanitation Special Area for the year 1980. CARRIED Resolution #99/80 Moved by Councillor Dickerson Seconded by Councillor Stoner That the report of the Treasurer-Collector dated July 18, 1980 stating the financial position of the Town as at June 30, 1980, be received for information. CARRIED Resolution #100/80 Moved by Councillor Cahill Seconded by Councillor Fisher That the request of The Royal Canadian Legion (Ontario #606) Branch to conduct a "Final Celebration" on September 14, 1980, at the Bay Ridges Branch, be approved subject to the approval of the Liquor Licence Board of Ontario. CARRIED 19/80 - 102 - (IV) BY-LAWS Councillor Dickerson, seconded by Councillor Matheson moved for leave to introduce By-laws of the Town of Pickering: By-law Number 1165/80 - Second Reading Being a By-law pursuant to The Line Fences Act, 1979, to provide that the Town Treasurer may pay to an entitled owner an amount certified, or a portion thereof. TABLED By-law Number 1166/80 Being a By-law to authorize the execution of a Demolition Agreement between the Corporation of the Town of Pickering and Hans J. Weber and Elisabeth K. Weber respecting Lots 111 and 112 according to Plan Number 283 registered in the Registry Office for Durham as described in Instrument No. D71562. Councillor Cahill declared a conflict of interest with respect to By-law 1166/80 By-law Number 1167/80 Being a By-law to amend By-law 1125/80, authorizing the execution of a subdivision agreement between the Corporation of the Town of Pickering and Heldor Development Corporation Limited respecting Part Lot 22, Concession 2, Pickering (Part Draft Plan 18T-79049). THIRD READING Councillor Dickerson, seconded by Councillor Matheson moved that the report of the Committee of the Whole on By-law Numbers 1166/80, 1167/80 be adopted, with the following amendment: By-law 1167/80 was amended in Section 1 by adding a Clause (f) to read as follows: "the north side of Finch Avenue and that all attempts be made to preserve the existing trees". and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. 19/80 - 103 - (V) OTHER BUSINESS 1. Councillor Stoner commended the owners of the Sheridan Mall for providing easy access for handi- capped persons. 2. Councillor Dickerson reported that Ontario Hydro is prepared to participate in the costs of a traffic signal at Sandy Beach Road and Bayly Street and with Council's concurrence, he will pursue this matter further with the Regional Council. 3. Councillor Cahill requested, and received the concurrence of Council, that the following motion be considered: Resolution #101/80 Moved by Councillor Cahill Seconded by Councillor Natheson That the request of the Westshore Fast Pitch League to conduct a Beerfest in Dunmoore Park on Saturday, September 13, 1980 be approved subject to the approval of the Liquor Licence Board of Ontario. CARRIED 4. The following matters were discussed prior to to the regular meeting: (a) There will be a Planning Committee Meeting on Monday September 29, 1980. (b) All Council and Committee Meetings will be cancelled on October 27th, November 3rd and November 10th, 1980 because of the municipal elections. (c) The interior road in the plan of subdivision by Realchief Developments on the east side of Rosebank Road is to be named McLeod Crescent. (d) Bramalea Limited has requested the Ministry of Housing to refer the Kingston Road-Highway #401 Corridor Plan to the Ontario Municipal Board. (e) Council discussed the renewal of an option regarding property in the Brock Industrial Area. 19/80 - 104 - (VI) CONFIRMATION BY-LAW By-law Number 1168/80 Councillor Dickerson, seconded by Councillor Natheson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on September 2, 1980, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
