Kearns - Coordinator of Council Services (I) ADOPTION OF MINUTES Regular Meeting of March 23, 1997 (II) PRESENTATION Mr. Doug Overy of Child Find Ontario presented a green ribbon to Mayor Arthurs to kick off the campaign for Child Find’s “Green Ribbon of Hope Month” and “National Missing Children’s Day” in Pickering. 26 (III) MATTERS FOR CONSIDERATION 1. ZONING BY-LAW AMENDMENT APPLICATION A 2/98 LONDON MALL LTD. (1201262 ONTARIO INC.) SOUTH PART OF LOT 15, RANGE 3, B.F.C. (NORTHSIDE OF FUTURE EASTERLY TERMINUS OF CLEMENTS ROAD FILE NUMBER - B 2310 - A 2/98 In Planning Recommendation Report 10/98, it is recommended that Zoning By-law Amendment Application A 2/98, submitted by London Mall Ltd. (1201262 Ontario Inc.), on lands being the south part of Lot 15, Range 3, B.F.C., be APPROVED IN PRINCIPLE, subject to the conditions included in Appendix I attached to Recommendation Report No. 10/98. Approved See Recommendation #1 Michael Goldberg, Planning Consultant representing Runnymede Developments advised that his client owns 104 acres adjacent to the subject property. The portion of land north of Clements and east of Squires Beach Road has been developed as a business park development rather than commercial and this application would be more appropriate in the later. The requested zoning is not identified in the present by-law and he requested that the application be refused but that the applicant be assisted in finding a more appropriate location. Sagar Aggarwal, applicant stated that this development would benefit both the municipality and the residents. He advised that the closest outlet of this type of business is Port Hope to the east and Mississauga to the west. 2. ZONING BY-LAW AMENDMENT APPLICATION A 3/94 F. CAMPITELLI IN TRUST PART OF LOT 20, CONCESSION 1 (NORTHEAST CORNER OF VALLEY FARM ROAD AND PICKERING PARKWAY FILE NUMBER B 2310 - A 3/94(R) In Planning Recommendation Report 11/98, it is recommended that Zoning By-law Amendment Application A 3/94(R), submitted by Campitelli, Trustee, on lands being Part of Lot 20, Concession 1, to amend the existing zoning to permit the development of a multi-unit residential condominium and retail and personal service uses, be APPROVED IN PRINCIPLE, subject to the conditions included in Appendix I attached to Recommendation Report No. 11/98. Tabled Michael Rice, representing the Campitelli family advised that he had no specific comments but was available to answer any questions. He did commend the Planning staff and requested approval of the application. Terry White, Marshcourt Drive asked Council to defer comments on this application until a decision had been made by the OMB on an application made by this applicant in Ajax. 27 3. CONSOLIDATED FIRE COMMUNICATIONS RESOURCE CENTRE (FIRE DISPATCH) PICKERING, AJAX, WHITBY, UXBRIDGE, BROCK AND SCUGOG RECOMMENDATION ON CONSULTANT HIRING TO UNDERTAKE JOINT STUDY FILE NUMBER - F 2420 In the General Manager’s Report GM 03/98, it is recommended that the hiring of a consultant to undertake a joint study on consolidation of Fire Communications Resource Centre (Fire Dispatch) for Pickering, Ajax, Whitby, Uxbridge, Brock and Scugog, be approved. Approved See Recommendation #2 4. MANAGEMENT OF RESERVES AND RESERVE FUNDS FILE NUMBER - C 5000 In the Director of Finance’s Report TR 13/98, it is recommended that this report be received for information. Approved See Recommendation #3 5. 1997 PRE-AUDIT BALANCES OF RESERVES AND RESERVE FUNDS FILE NUMBER - C 5000 In the Director of Finance’s Report TR 14/98, it is recommended that this report be received for information. Approved See Recommendation #4 6. STATEMENT OF THE TREASURER RESPECTING REMUNERATION AND EXPENSE PAYMENTS TO MEMBERS OF COUNCIL AND COUNCIL APPOINTEES FILE NUMBER - C 5000 In the Director of Finance’s Report TR 15/98, it is recommended that the Statement of the Treasurer for the year 1997 be received for information. Approved See Recommendation #5 7. REPEAL VARIOUS PART LOT CONTROL BY-LAWS FILE NUMBER - B 2310 In Legal Services Report L 31/98, it is recommended that various draft by- laws to repeal part lot control by-laws, be forwarded to Council for enactment. By-law forwarded to Council 28 8. ROAD DEDICATION BLOCKS 55, PLAN 40M-1866 (MOUNTAIN ASH DRIVE) FILE NUMBER - E 4000 In Legal Services Report L 36/98, it is recommended that a draft by-law to dedicate Block 55, Plan 40M-1866 (Mountain Ash Drive) as public highway, be forwarded to Council for enactment. By-law forwarded to Council 9. ROAD DEDICATION BLOCKS 207 AND 208, PLAN 40M-1896 (ROSEBANK ROAD) FILE NUMBER - E 4000 In Legal Services Report L 45/98, it is recommended that a draft by-law to dedicate Blocks 207 and 208, Plan 40M-1896 (Rosebank Road) as public By-law forwarded to Council 10. SUBDIVISION AMENDING AGREEMENT LOTS 46 TO 54, PLAN 40M-1811 FILE NUMBER - E 4000 In Legal Services Report L 46/98, it is recommended that a draft by-law to authorize the execution of a Subdivision Amending Agreement between the Town and Dixie Woods Estates Limited (the now registered and beneficial owner of the subject lots) to provide for the development of four additional dwelling units within the project, be forwarded to Council for enactment. By-law forwarded to Council 11. NOXIOUS WEEDS FILE NUMBER - A 2260 In Clerk’s Report CL 14/98, it is recommended that the publication of a Public Notice regarding the destruction of weeds under the provision of the Weed Control act be authorized. Approved See Recommendation #6 12. APPOINTMENT OF BY-LAW ENFORCEMENT OFFICER TO ENFORCE PARKING BY-LAW AT 1467 WHITES ROAD NORTH (SARAH MCDONALD’S PLACE) IN PICKERING FILE NUMBER - D 2220 In Clerk’s Report CL 15/98, it is recommended that a draft by-law to appoint one person to enforce the Parking By-law at 1467 Whites Road North (Sarah McDonald’s Place), be forwarded to Council for enactment. TRANSFER OF EASEMENTS TO BELL CANADA SHRONE VIEW HOLDINGS INC. PART BLOCK 20, PLAN 40M-1887 FILE NUMBER - D 3310 In Legal Services Report L 47/98, it is recommended that a draft by-law to authorize the execution of a Transfer to Bell Canada of an easement over Part of Block 20, Plan 40M-1887 be forwarded to Council for enactment, and to authorize Bell Canada to enter onto the subject lands in order to install the required services while the legal documentation is being processed. Approved See Recommendation #8 By-law forwarded to Council (III) OTHER BUSINESS 1. Councillor Brenner commented on the rail fire which took place on the weekend from Whitby to Scarborough. He questioned if there is a mechanism available to charge back the cost of fighting this fire to the appropriate body. 2. Councillor Dickerson advised that the Provincial and Federal Governments have agreed to reimburse all municipalities who assisted in the ice storm this winter. 3. Councillor Johnson advised that an item regarding household hazardous waste disposal would be placed on next weeks agenda. 4. Councillor Johnson commented on the meeting of himself, the General Manager and the Fire Chief regarding the recruitment of volunteer firefighters. An information package will be prepared for distribution. 5. Councillor Johnson advised that the Bay Ridges Hockey Tournament was a great success. 6. Councillor Holland advised that a Notice of Motion would be coming forward next week concerning Can-Sort Recycling Ltd. 30 7. The following matters were discussed prior to the regular meeting: a. The Town Solicitor commented on the request by Tridel Developments for a reduction in parkland dedications. b. The Director of Finance commented on his report concerning Reserves and Reserve Funds and the 1997 Pre- Audit Balances of Reserves and Reserve Funds Report. c. The General Manager advised that the Fire Dispatch Agreement is being dealt with by Whitby and was previously dealt with by Ajax. He also advised that positive comments have been received from the Region. d. The General Manager advised that the funeral of Firefighter Bill Jerden was held today. ZONING BY-LAW AMENDMENT APPLICATION A 2/98 LONDON MALL LTD. (1201262 ONTARIO INC.) SOUTH PART OF LOT 15, RANGE 3, B.F.C. (NORTHSIDE OF FUTURE EASTERLY TERMINUS OF CLEMENTS ROAD FILE NUMBER - B 2310 - A 2/98 That Zoning By-law Amendment Application A 2/98, submitted by London Mall Ltd. (1201262 Ontario Inc.), on lands being the South Part of Lot 15, Range 3, B.F.C., Town of Pickering, to amend the existing zoning to permit the development of a “General Fuel Stop” primarily for the use of the trucking industry be APPROVED IN PRINCIPLE, subject to the conditions included in Appendix I attached to Recommendation Report No. 10-98. 2. CONSOLIDATED FIRE COMMUNICATIONS RESOURCE CENTRE (FIRE DISPATCH) PICKERING, AJAX, WHITBY, UXBRIDGE, BROCK AND SCUGOG RECOMMENDATION ON CONSULTANT HIRING TO UNDERTAKE JOINT STUDY FILE NUMBER - F 2420 1. That Council receive Report to Council GM 03-98 and concur with hiring Oldham Engineers Inc. to undertake a study on establishing a consolidated fire communications resource centre (fire dispatch) for Pickering, Ajax, Whitby, Uxbridge, Brock and Scugog. 2. That Council authorize a pre-budget expenditure as set out in Report to Council GM 03-98 to cover the Town’s share of the cost of the study, providing both the Town of Ajax and the Town of Whitby agree to an equal funding contribution; and that the Townships of Uxbridge, Brock, and Scugog be encouraged to participate in and contribute to the cost of the study. 3. That the Mayor and Clerk be authorized to execute any necessary documents resulting from the above recommendations. 4. That a copy of this Report be forwarded to the Towns of Ajax and Whitby, and the Townships of Uxbridge, Brock and Scugog. 3. STATEMENT OF THE TREASURER RESPECTING REMUNERATION AND EXPENSE PAYMENTS TO MEMBERS OF COUNCIL AND COUNCIL APPOINTEES FILE NUMBER - C 5000 That the Statement of the Treasurer respecting remuneration and expense payments to Members of Council and Council appointees for the year 1997 be received for information, as outlined in TR Report 15/98. 6. NOXIOUS WEEDS FILE NUMBER - A 2260 That the Council of the Corporation of the Town of Pickering authorizes the publication of a Public Notice regarding the destruction of weeds under the provision of the Weed Control Act, R.S.O. 1990 Chapter W.5 of the Province of Ontario and directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be destroyed in such a manner as they may deem proper; and that the expenses incurred by the said Weed Inspectors in the discharge of their duties shall be placed on the Collector’s Roll of the Town of Pickering against the respective parcels concerned and that such amounts shall be collected in the same manner as taxes under the Municipal Act. 7. “M.E.
