Kearns - Co-ordinator of Council Services ABSENT: Councillor Pistritto - (on vacation) (I) ADOPTION OF MINUTES Regular Meeting of March 24, 1997. (II) DELEGATIONS 1. The following persons addressed the Committee with respect to speed humps on Rougemount Drive: a) Gino Hamparian, 1432 Rougemount Drive advised that the speed humps were placed to lower the volume of traffic using Rougemount Drive but the volumes were certain to and did change with the opening of Hwy. 401. He questioned the status of the evaluation and the feedback from the various services. b) Simon Hunter, 1436 Rougemount Drive stated that since the opening of Hwy. 401 the traffic volume problem has been resolved and this issue should be revisited. Steve Brake was contacted on numerous occasions last fall and the community were expecting to receive a call from him now that spring has arrived. The questionnaire distributed by the residents was for feedback only. The residents want their street fixed and are willing to talk about any alternatives. 27 (II) DELEGATIONS c) Peter Williams, 1463 Rougemount Drive stated that if flyers had been distributed to all residents of Rougemount Drive by the Town, difficulties between neighbours could have been avoided. He disputed the validity of the survey undertaken by the Town. The speed humps were placed to lower traffic volume and speed but have created negative comments by agencies such as ambulance, fire, school bus, police, etc. He requested that the speed humps be removed as soon as possible. d) Ryan Choi, 1435 Rougemount Drive stated that a number of divisions have occurred between neighbours on the street and Council is responsible. He questioned what other traffic calming measures were considered and why was a private contractor hired to install the speed humps when we have full time staff in our Public Works Department capable of doing the job. e) Julie Hunter, 1436 Rougemount Drive stated that she is unable to travel at 30 km over humps as her car hits bottom. The humps have created more problems than they have solved and should be removed. (III) MATTERS FOR CONSIDERATION 1. DRAFT PLAN OF SUBDIVISION 18T-96009 ZONING BY-LAW AMENDMENT APPLICATION A 22/96 WOODSMERE PROPERTIES LIMITED PART OF LOT 31, CONCESSION 1 (STROUDS LANE, WEST OF AUTUMN CRESCENT) In Planning Recommendation Report 7/97, the Director of Planning will provide recommendations regarding Zoning By-law Amendment Application A 22/96 submitted by Woodsmere Properties Limited to change setback and coverage provisions on lands being Part of Lot 31, Concession 1 and Draft Plan of Subdivision Application 18T-96009 submitted by Woodsmere Properties Limited to permit the creation of blocks of land to allow the development of 36 street townhouses on the subject lands. A Council position regarding these applications is sought prior to an Ontario Municipal Board Hearing scheduled for May 7, 1997. Referred to Council Meeting of April 21, 1997 Douglas Shier, 1794 Autumn Crescent, speaking on behalf of the residents on Autumn Crescent, advised that much discussion has taken place between the developer and Planning staff with great progress having been made. Referral to Council provides more time for further discussion with the developer. 2. ZONING BY-LAW AMENDMENT APPLICATION A 21/96 802226 ONTARIO LIMITED PART OF LOT 18, CONCESSION 1 (SOUTH SIDE OF QUARTZ STREET, EAST OF TOY AVENUE) In Planning Recommendation Report 5/97, it is recommended that the application submitted by 802226 Ontario Limited to rezone property on the south side of Quartz Street, east of Toy Avenue, to consolidate the zoning on the subject property with specific uses and performance standards be approved. Approved as amended See Recommendation #1 to delete food preparation plant, truck centre and warehouse from list of 28 permitted uses 29 Harold Elston, on behalf of Sonic Automobile Enterprises stated support of the thrust of Planning staffs recommendations. An ongoing problem remains with outdoor storage on this property and they are very much in support of prohibiting this continued use. Problems with rodents, dust, odour, trucks, traffic, etc. remain. This list of permitted uses should be limited due to the size of property and truck traffic. Alan Thoms, 1790 Bayly Street stated that his property abuts the property in question. He requested that trucking and warehouse use not be permitted and that a 12’ privacy fence be erected around the property. 3. ZONING BY-LAW AMENDMENT APPLICATION A 4/96 LOBLAWS ASSOCIATED PROPERTIES INC. PART OF LOT 23, CONCESSION 1 (THE SUPERCENTRE, 1970 LIVERPOOL ROAD) In Planning Recommendation Report 6/97, it is recommended that the application submitted by Loblaws Associated Properties Inc. to rezone lands at the Supercentre, 1790 Liverpool Road, to permit a reduction in the number of required parking spaces, and to permit outdoor storage associated with a garden centre located in the parking lot of the Supercentre for the months of April, May and June of each year be approved. Not Approved See Recommendation #2 Todd Brown, of Monteith, Zelinka, Priamo Ltd., retained by Loblaws stated that he understands there is an access issue, thought it had been resolved and are willing to discuss the matter. He requested Committee’s approval of the Zoning By-law Amendment. Joel Farber, representing Lexton Developments and Lucky Day Developments advised that the proposed Garden Centre would have a negative impact on traffic and parking and was contrary to the intent of previous agreements. If rights-of- way are not enforced, then their objection will be removed. 4. REGIONAL OFFICIAL PLAN AMENDMENT APPLICATIONS OPA 97-001/D AND OPA 97-002/D KOSE PROPERTIES INC. AND INVAR INDUSTRIAL (THICKSON ROAD AND VICTORIA STREET - WHITBY) In Planning Report 8/97, it is recommended that Council provide comments to the Region of Durham with respect to two applications to amend the Regional Official Plan submitted by Kose Properties Inc. and Invar Industrial respecting lands at Thickson Road and Victoria Street in Whitby. Approved See Recommendation #3 5. LEASE AGREEMENT WITH METROPOLITAN TORONTO FOR MUSEUM PARKING LOT In Legal Services Report L 51/97, it is recommended that the draft by-law to authorize the execution of an agreement with Metropolitan Toronto renewing the lease for the parking lot at the Museum be enacted. By-law forwarded to Council 30 6. RINAL ENTERPRISES INC. - SUBDIVISION AGREEMENT NORTHWEST CORNER OF PINEGROVE AVE. & WOODVIEW AVE. In Legal Services Report L 50/97, it is recommended that the draft by-law to authorize the execution of a Subdivision Agreement Rinal Enterprises Inc. respecting the development of Draft Plan 18T-92013 be enacted. By-law forwarded to Council 7. COMMERCIAL DEVCO INC. - CONDOMINIUM AGREEMENT NORTHEAST CORNER OF KINGSTON ROAD AND WALNUT LANE In Legal Services Report L 65/97, it is recommended that the draft by-law to authorize the execution of a Condominium Agreement with Commercial Devco Inc. respecting the development of Draft Plan 18CDM-96004 be enacted. By-law forwarded to Council 8. ROAD CLOSING AND SALE OF TOWN LANDS PART OF APPLEVIEW ROAD, PLAN 1051 In Legal Services Report L 16/97, it is recommended that the Town Solicitor be authorized to commence the process of stopping up, closing and selling part of Appleview Road to the abutting owner. Approved See Recommendation #4 9. REPEAL OF PART LOT CONTROL BY-LAWS In Legal Services Reports L 48/97 and L 49/97, it is recommended that by-laws be enacted to repeal Part Lot Control By-laws pertaining to lands on Lydia Crescent and Feldspar Court. By-law forwarded to Council 10. ROAD DEDICATIONS ON MOUNTAIN ASH DRIVE AND MCLEOD CRESCENT In Legal Services Report L 55/97, L 57/97 and L 64/97, it is recommended that by-laws to dedicate lands as a public highway which were conveyed to the Town on Mountain Ash Drive and McLeod Crescent for road purposes be enacted. By-law forwarded to Council 11. TEMPORARY CLOSING OF PORTIONS OF APPLEVIEW ROAD AND WOODVIEW AVENUE FOR CONSTRUCTION PURPOSES In Legal Services Report L 58/97 and L 63/97, it is recommended that portions of Appleview Road and Woodview Avenue be closed temporarily for construction purposes. By-law forwarded to Council 31 12. ADJUSTMENTS TO THE TAX ROLL In Treasurer’s Report 6/97, it is recommended that the tax roll be reduced to reflect various adjustments and corrections to the tax accounts. Approved See Recommendation #5 13. 1997 SUBSIDY ALLOCATION FOR CONVENTIONAL TRANSIT AND SPECIALIZED SERVICES In Treasurer’s Report 5/97, it is recommended that the Town petition the Ministry of Transportation for a 1997 subsidy allocation for conventional transit and specialized services. Approved See Recommendation #6 14. NOXIOUS WEEDS In Clerk’s Report CL 13/97, it is recommended that Council authorize the publication of a Notice regarding the destruction of noxious weeds and to direct the Regional Weed Inspectors to destroy noxious weeds. Approved See Recommendation #7 15. APPOINTMENT OF SPECIAL BY-LAW OFFICERS FOR 1735 AND 905 BAYLY STREET In Clerk’s Report CL 11/97, it is recommended that the draft by-law to appoint persons as special By-law Enforcement Officers to enforce the Parking By-law at 1735 and 905 Bayly Street be enacted. By-law forwarded to Council 16. PROCLAIM APRIL 28TH AS A DAY OF MOURNING In a letter from the Durham Regional Labour Council, it is requested that Mayor Arthurs proclaim April 28, 1997 as a Day of Mourning in recognition of workers killed, injured or disabled on the job. Approved See Recommendation #8 (IV) OTHER BUSINESS 1. Councillor Senis and Councillor Ryan introduced and discussed a Notice of Motion concerning Frenchman’s Bay. Approved See Recommendation #9 32 (IV) OTHER BUSINESS 2. Councillor Brenner requested a report from the General Manager on the various shutdown and mechanical failures that have occurred at the Pickering Nuclear Generating Station over the past six months. 3. Councillor Johnson congratulated all the participants in the very successful Ajax/Pickering Hospital TV Auction. 4. Councillor Johnson advised that a fundraising event would be taking placed this weekend for a 5 year old Pickering boy. Bay Ridges Hockey and N.H.L. Old Timers Hockey Teams would be participating. 5. Councillor Dickerson thanked Council for attending the kick-off launch and press conference which took place on Tuesday for the Second Chance Wildlife Sanctuary. (V) ADJOURNMENT The Meeting adjourned at 10:00 p.m. DATED __________________________ CLERK _________________________ TOWN OF PICKERING That the Executive Committee of the Town of Pickering having met on April 14, 1997, presents its sixth report to Council and recommends: 1. ZONING BY-LAW AMENDMENT APPLICATION A 21/96 802226 ONTARIO LIMITED PART OF LOT 18, CONCESSION 1 (SOUTH SIDE OF QUARTZ STREET, EAST OF TOY AVENUE) That Zoning By-law Amendment Application A 21/96 submitted by 802226 Ontario Limited on lands being Part of Lot 18, Concession 1, Town of Pickering, be APPROVED AS REVISED to consolidate the zoning on the subject property with specific uses and performance standards, subject to the conditions detailed in Appendix No. 1 to Recommendation Report No. 5/97, as amended in Section 2(ii) by deleting a food preparation plant, a truck centre and a warehouse as a permitted use, but that the proposed use of the property for outdoor storage, either exclusively, or in conjunction with any other use, be REFUSED. 2. ZONING BY-LAW AMENDMENT APPLICATION A 4/96 LOBLAWS ASSOCIATED PROPERTIES INC. PART OF LOT 23, CONCESSION 1 (THE SUPERCENTRE, 1970 LIVERPOOL ROAD) That Zoning By-law Amendment Application A 4/96, submitted by Loblaws Associated Properties Inc., on the subject property, known as Part of Lot 23, Concession 1, Town of Pickering, be NOT APPROVED. 3. REGIONAL OFFICIAL PLAN AMENDMENT APPLICATIONS OPA 97-001/D AND OPA 97-002/D KOSE PROPERTIES INC. AND INVAR INDUSTRIAL (THICKSON ROAD AND VICTORIA STREET - WHITBY) That Planning Report No. 8/97 be forwarded to Regional Council as the Town’s comments on OPA 97-001/D and OPA 97-002/D, and that the Region be advised of the following specific comments: (a) Allowing retail warehouses in Employment Areas with floor areas as low as 465 square metres may jeopardize the planned function of Central Areas; therefore, the Town opposes the widespread development of retail warehouses with floor areas significantly less than 2,000 square metres within Employment Areas; (b) The concentration of retailing envisioned by the various proposals at Thickson Road and Victoria Street in Whitby will perform many of the retailing functions planned for Central Areas and Special Purpose Commercial Areas; therefore, this competition should be evaluated in considering the proposals; and, further, if the proposals are determined acceptable, a Central Area, or other appropriate designation and policies, instead of an exception to the “Employment Area” policies, should be applied to the whole area; and (c) The Region should support a modification to Amendment No. 28 to the Durham Regional Official Plan to clarify that in permitting retail warehouses in Employment Areas, the local official plan and zoning by- law should specify whether supermarkets and department stores are permitted, and if so, the extent of floor areas which may be devoted to such uses. 2 3 4. ROAD CLOSING AND SALE OF TOWN LANDS PART OF APPLEVIEW ROAD, PLAN 1051 That the Town Solicitor be authorized to commence the process of stopping up, closing and selling part of Appleview Road to the abutting owner as set out in Legal Services Report L 16/97. 5. ADJUSTMENT TO THE TAX ROLL That the tax roll be reduced to reflect the adjustments and corrections to the tax account in Appendix A of Treasurer’s Report 6/97 and summarized as follows: Realty Taxes $ 26,756.04 Penalty & Interest 0.00 TOTAL $ 26,756.04 6. 1997 SUBSIDY ALLOCATION FOR CONVENTIONAL TRANSIT AND SPECIALIZED SERVICES That the Council of the Town of Pickering petition the Ministry of Transportation for 1997 subsidy allocations as follows: Capital Operating Conventional Transit $1,677,990 $1,024,294 Specialized Services $ 38,750 $ 249,864 7. NOXIOUS WEEDS That the Council of the Corporation of the Town of Pickering authorizes the publication of a Public Notice regarding the destruction of weeds under the provision of the Weed Control Act, R.S.O. 1990, Chapter W.5 of the Province of Ontario and directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be destroyed in such a manner as they may deem proper; and That the expenses incurred by the said Weed Inspectors in the discharge of their duties shall be placed on the Collector’s Roll of the Town of Pickering against the respective parcels concerned and that such amounts shall be collected in the same manner in taxes under the Municipal Act. 8. PROCLAIM APRIL 28TH AS A DAY OF MOURNING That Mayor Arthurs be authorized to proclaim April 28, 1997 as a Day of Mourning in recognition of workers killed, injured or disabled on the job. 4 9. MTRCA AND TOWN OF PICKERING TO BECOME PARTNERS TO REQUEST FINANCIAL ASSISTANCE FROM THE GREAT LAKES 2000 FUND WHEREAS there has been an enormous amount of siltation occurring in Frenchman’s Bay as a result of development to the north and around the creeks that drain into the Bay; and WHEREAS Frenchman’s Bay is an ecologically sensitive resource that has been damaged over the years as a result of sediment flowing into the Bay and filling in areas where important vegetation grows and damaging natural habitat where fish spawn and birds and ducks nest; and WHEREAS a plan must be put in place to reduce and control siltation and pollution in Frenchman’s Bay to ensure that this important natural resource is protected for future generations; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Pickering shall become a partner with the Metropolitan Toronto and Region Conservation Authority to request financial assistance from the Great Lakes 2000 Fund to help in projects to control siltation and pollution in Frenchman’s Bay; and THAT a copy be forwarded to the MTRCA for their consideration.
