(II) RESOLUTIONS Resolution #44~85 - See Appendix #1 Moved by Councillor Mitchell Seconded by Councillor Robertson That the Executive Committee Report dated June 10, 1985, be adopted. CARRIED Recorded Vote on Item #1: Yes: Councillors Cahill, Mitchell, Robertson and Mayor Anderson No: Councillors Arthurs and Kitchen Absent: Councillor Stoner 16/85 57 Resolution #45/85 - See Appendix #2 Moved by Councillor Cahill Seconded by Councillor Mitchell That the Planning Committee Report, date June 4, 1985, be approved with the following amendments: Items *1 and #2 were amended by deleting section 2b) CARRIED Resolution #46/85 Moved by Councillor Cahill Seconded by Councillor Robertson That Tender T-14-85, submitted by Hank Deenen Landscaping Ltd. in the amount of $155,144.25 for the development of the Esplanade Park project, Phase II, be accepted; and that the over-expenditure of $14,802.00 be approved by Council in order that Phase II of the Esplanade Park project can be completed; and that this amount be charged to Reserve Fund - Community Facilities (4225) CARRIED Recorded Vote: Yes: Councillors Arthurs, Cahill, Kitchen, Mitchell and Robertson No: Mayor Anderson Absent: Councillor Stoner Resolution #47/85 Moved by Councillor Arthurs Seconded by Councillor Robertson That Resolution #23/85, #8 which reads as follows: That $375,000 be transferred from the General Fund to the Capital Fund to cover the unfinanced balance in the Capital account for the construction of the Recreation Complex; and that the General Fund contribution be partly covered by the excess 1984 Surplus of $176,000; and partly covered by any 1985 Surplus or, in the alternative, by a 1985 contribution from the Capital Works Program Reserve Fund if the 1985 Surplus does not cover the remaining $199,000; and that any Provincial Community Centres Grants relating to the initial construction of the Recreation Complex that are received in 1985 or future years be retained by the General Fund as repaid Surplus; be rescinded. Councillor Robertson seconded by Councillor Arthurs moved for leave to introduce a By-law of the Town of Pickering: By-law Number 2044/85 Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, Part Lots 7 and 8, Concession 5, in the Town of Pickering. (A 34/81) (18T-84043) THIRD READING Councillor Cahill, seconded by Councillor Mitchell moved that the report of the Committee of the Whole on By-law Number 2044/85 be adopted, and that the said By-law be now read a Third Time and PASSED, and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 2. Councillor Robertson seconded by Councillor Arthurs moved for leave to introduce a By-law of the Town of Pickering: By-law Number 2045/85 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part Lot 20, Concession 1 (Part 9, Plan 40R-2181) in the Town of Pickering. (A 5/85) 16/85 59 (IV) BY-LAWS Councillor Cahill seconded by Councillor Mitchell moved for leave to introduce By-laws of the Town of Pickering: By-law Number 2046/85 Being a by-law to authorize the execution of a Release of Section 5 of Schedule A of the Subdivision Agreement between J.F. Coughlan Construction Co. Limited and the Corporation of the Town of Pickering respecting Plan 40M-1304. By-law Number 2047/85 Being a by-law to authorize the execution of a Subidivison Agreement between J.D.S. Investments Limited and The Corporation of the Town of Pickering respecting part of Lot 2, Bostwick's Plan (part Lot 24, Concession 1), Pickering (Draft Plan 18T-79036) THIRD READING Councillor Mitchell, seconded by Councillor Cahill moved that the report of the Committee of the Whole on By-law Numbers 2046/85 and 2047/85 be adopted and that the said By-laws be now read a Third Time and PASSED, and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (V) OTHER BUSINESS 1. Councillor Cahill inquired into the status of the fencing requirements on Fawndale Road. 2. Councillor Mitchell inquired into the status of the hole created by Bell Canada on Oklahoma Drive. 3. Councillor Kitchen requested a report on the removal of trees on Liverpool Road, south of Wharf Street when sidewalks were installed. 4. Councillor Kitchen asked that when a final decision has been made regarding the GO-ALRT expansion, that a report on the feasibility of obtaining and expanding the north GO parking lot be prepared. 5. Councillor Kitchen requested that the Transit Committee discuss the feasibility of having out-of-town senior citizens paying reduced local fares. 6. Councillor Arthurs asked for a report on the necessity of having Valley Farm Road widened to 6 lanes. 16/85 60 (V) OTHER BUSINESS - (continued) 7. The following matters were discussed prior to the regular meeting: a) A request from J.D.S. Investments with respect to a Flea Market licence at the Trade Centre. Resolution #49/85 Moved by Councillor Kitchen Seconded by Councillor Arthurs That the request of J.D.S. Investments Ltd. dated June 11, 1985 to have the requirement of a Flea Market licence at the Trade Centre waived, be denied. CARRIED b) A letter from the Ministry of Transportation and Communications regarding the sale of land. Resolution #50/85 Moved by Councillor Robertson Seconded by Councillor Mitchell That the Ministry of Transportation and Communications be advised that the Town of PIckering is not prepared to acquire lands at the northwest corner of Highway 401 and Liverpool Road. CARRIED (VI) CONFIRMATION BY-LAW By-law Number 2048/85 Councillor Arthurs, seconded by Councillor Mitchell moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on June 17, 1985, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. APPENDIX # 1 TOWN OF PICKERING The Executive Committee of the Town of Pickering having met on June 10, 1985 presents its eleventh meeting to the Council of the Town of Pickering and recommends: 1. ZONING AMENDMENT SUBMITTED BY COOLWATER FARMS LIMITED ON THE EAST SIDE OF LIVERPOOL ROAD, NORTH OF LAKE ONTARIO FILE NUMBER - B 2310 - A l4/85 That Zoning By-law Amendment Application A 14/85 submitted by Coolwater Farms Limited, on behalf of the owner, The Regional Municipality of Durham, to rezone the subject lands being Part Lot 22, Broken Front Concession Range 3, Town of Pickering to an appropriate zoning to permit the establishment of an aquaculture centre be APPROVED, subject to the following condition: 1. That prior to third reading of an implementing by-law the owner enter into an appropriate site/development agreement with and to the satisfaction of the Town which shall include, but not necessarily by limited to, a provision respecting the submission and approval of an appropriate site plan. 2. TERMS OF REFERENCE FOR MUNICIPAL HOUSING STATEMENT UPDATE STUDY FILE NUMBER - B 2300 ;¡ That Town Council advise the Council of the Regional Municipality of Durham and the Ministry of Municipal Affairs and Housing as follows: That it endorses the Terms of Reference for the Munici- pal Housing Statement Update Study, and respectfully re- quests the Minister of Municipal Affairs and Housing to provide the Town with financial assistance for the study under the Municipal Housing Statement Program. 3. TENDER FOR SURFACE TREATMENT FILE NUMBER - C 4300 That Tender T-16-85 submitted by Evans Contracting Limited for the supply of surface treatment in the amount of $55,405.00 be approved. 4. GRANT TO CONTROL ONTARIO DISASTER RELIEF FUND FILE NUMBER - C 2163 That a grant in the amount of $l,OOO.OO be made to the Central Ontario Disaster Relief Fund; and that this amount be charged to Account 2195 - Grants to Organizations and Individuals. 5. - 2 - STREET DANCE ON NORFOLK SQUARE FILE NUMBER - F 2600 That the request to conduct a street dance on Norfolk Square on Friday, June 21, 1985 between the hours of 7:00 p.m. and 1:00 a.m. be granted. 6. ACCOUNTS FOR APPROVAL FILE NUMBER - C 2310 That the accounts in the amount of $1,566,389.43 for the period ending May 31, 1985, as submitted by the Town Manager, be approved. 7. PERSONNEL FILE NUMBER - A 4000 The Director of Public Works be authorized to hire one temporary Building Inspector for the balance of 1985 and consideration of the position being rendered permanent in 1986 should current construction volumes be sustained. 8. BEERFEST IN KINSMEN PARK FILE NUMBER - F 2600 } That the request from the Pickering Softball Association to conduct a Beerfest in Kinsmen Park on Saturday, July 6, 1985 in conjunction with the South Pickering Men's Slow Pitch Tournament be approved subject to local Health and Police authorities and the úiquor Licence Board of Ontario. 9. INVENTORY OF INDUSTRIAL LAND FILE NUMBER - C 1000 That the 10.337 acres of Industrial Land be expensed during 1985 through the Capital Fund, or, in other words, purchased outright by the Town for $382,240; and that the Capital Fund expenditure be covered by a 1985 contribution of $382,240 from the Reserve Fund for Community Facilities Development; and that the proceeds from the eventual sale of the 10.337 acres of Industrial Lanp be credited back to the Reserve Fund for Community Facilities Development. ¡ APPENDIX # 2 TOWN OF PICKERING The Planning Committee of the Town of Pickering having met on June 4, 1985 presents its second meeting to the Council of the Town of Pickering and recommends: 1. ZONING AMENDMENT APPLICATION SUBMITTED BY C. HASSANALI ON THE EAST SIDE OF VALLEY FARM ROAD, SOUTH OF FINCH AVENUE FILE ~UMBER - B 2310 - A 12/85 That Zoning By-law Amendment Application A 12/85 submitted by Mr. C. DeGraauw, on behalf of the owner, C. Hassanali, to rezone the subject lands being Part Lot 20, Concession 1, Town of Pickering, from "A" - Agricultural to an appropriate zoning to permit severance of the subject property into two lots with minimum frontage of 13.5 metres be APPROVED subject to the following conditions: 1.
