This Special Meeting was called to consider By-law 1644/83 to authorize the execution of a Lease between Shane Coburn Walter Thorne and the Town respecting the operation of the Pickering'Dt"íving Range~~ . " ',., PRESENT: Mayor J.E. Anderson COUNCILLORS: Arthurs Cahill Kitchen Mitchell Robertson Stoner ALSO PRESENT: N. C. Marshall - Town Manager B. Taylor - Town Clerk ( 1 ) 1. DELEGATIONS 2. Mr. Doug Dickerson, representing Mr. Joe Nesci, stated that Mr. Nesci's house could be vulnerable to damage if an inexperienced golfer was at the tee. Mr. Nesci is concerned about danger to his family and visitors and damage to his property. Mr. Shane Coburn, representing the Pickering Driving Range, stated that he and his partner have done everything possible to make the area safe for Mr. Nesci. Barricades can be put between the tees and a nylon barrier could be erected at the north end of the tees. Mr. Coburn stated that if screens are required, he will not hesitate to erect them. Mr. Coburn stated that there will be days when he would like to keep the lights on beyond 11:00 P.M. in order to gather the golf balls. 10/83 - 46 - ( II ) BY-LAWS Councillor Cahill, seconded by Councillor Robertson moved for leave to introduce By-laws of the Town of Pickering: By-law Number 1649/83 Being a by-law to authorize the execution of a Lease between Shane Coburn, Walter Thorne and the Corporation of the Town of Pickering respecting Part Lot 19, Concession 3, Pickering, (part Parts 37 and 40, Plan 40R-6934) THIRD READING Councillor Cahill, seconded by Councillor Robertson moved that the report of the Committee of the Whole on By-law Number 1649/83 be adopted with the following amendments: Section 4(c) of Schedule "A" to By-law 1649/83 was amended to allow illumination until 12:00 midnight. Schedule "A" to By-law 1649/83 was further amended to pro- vide for a safety screen at the north end of the tees and for barricades between those tees that are parallel to Brock Road. Schedule "A" to By-law 1649/83 was further amended to in- corporate Items 1, 2, and 3 outlined in Mr. Thorne's letter dated April 2, 1983. and that the said By-law be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. Anderson - (Attending opening of Provincial Legislature) (I) ADOPTION OF MINUTES Meeting of April 5, 1983 (II) 1. DELEGATIONS Mr. Joe Nesci, Brock Road, addressed Council to express his concern about the proposed driving range to be located south of his property. He has investigated other driving ranges and determined that there is a chance of balls landing on his property thus causing a risk to his children. He felt there should be some type of fencing or screening to protect his property from errant golf balls and that a closing time for the driving range be established. 2. Mr. Thomas Newman, Paddock Road, addressed Council to speak in opposition to the application to amend the Minister's Zoning Order submitted by the Greenwood Mushroom Farm Limited. The present operation causes odours and an increased operation will only increase the amount of odour. The entrance to the mushroom farm is dangerous and for this reason traffic should not be increased. The structures on the property of the mushroom farm do not look like agricultural build- ings and it would help if trees were planted to hide these buildings. Mr. Newman stated that no person living in the vicinity of the mushroom farm supported - 41 - 9/83 (II) DELEGATIONS - continued this application for expansion. When the first appli- cation for expansion was made in 1980, the Ministry of the Environment made very negative comments. Mr. Newman noted that the letter from the Ministry of Agriculture is addressed to Councillor Stoner and not the Town of Pickering and the author of the letter states that his comments are not official policy. 3. Mr. Bruno Harilaid, Paddock Road, agreed with the remarks made by Mr. Newman and stated that as the mushroom farm expanded, so did the noise and traffic. Mr. Snobelen does not have sufficient land to carry on an expanded operation and he knew this before he purchased the property. Paddock Road is more of a residential area than a farming area since there are no parcels of land larger than twenty acres. Mr. Hari- laid stated that the entrance to the mushroom farm is dangerous and landscaping is needed. (III) RESOLUTIONS Resolution #38/83 Moved by Councillor Stoner Seconded by Councillor Kitchen That application Ml/83, submitted by Greenwood Mushroom Farm Limited, to amend Minister's Zoning Order No.1 on lands being Part of Lot 13, Concession 6 to permit construation of an 805 metre addition to the existing growing building and a 585 square equipment and material storage building on a lot with 115.6 metres frontage and lot area of 5.97 hectares be APPROVED, sub- ject to the following conditions: 1. That the applicant enter into a site plan agreement to provide for adequate landscaping to alleviate the visual and odour problems. 2. That prior to approval of this application by Council, the Ministry of Agriculture and staff shall report on what steps can be taken to alleviate odours from a mushroom farm. THIRD READING Councillor Cahill, seconded by Councillor Mitchell moved that the report of the Committee of the Whole on By-law Numbers 1650/83, 1651/83, 1652/83, 1653/83, 1654/83, 1655/83, and 1657/83 be adopted with the following amendments: By-law Number 1649/83 was deferred for one week pending information on the type of protection the tenant will provide for the property owner to the north. By-law Number 1656/83 was deferred pending a study pursuant to the criteria established for pedestrian crossovers of this and other intersections. and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. 9/83 - 44 - (V) 1. OTHER BUSINESS 2. Councillor Arthurs requested staff to establish operational guidelines for driving ranges to include such matters as lighting, fencing and hours of operation. Councillor Stoner requested a clarification on the time limits allowed for lighting of tennis courts and what measures can be taken to alleviate vandalism of the lighting timers. 3. Councillor Kitchen presented a cheque in the amount of $500.00 on behalf of the Royal Canadian Legion, Branch 606 and asked that the Director of Parks and Recreation acknowledge this donation and state how this money will be used in the Recreation Complex. 4. Councillor Kitchen requested a report on the cost of extending the sidewalk on the north side of Glenanna Road from its present terminus easter- ly to Liverpool Road. 5. Councillor Mitchell asked that the Ministry of Transportation and Communications be requested to extend the green light signal for traffic on Rougemount Drive at its intersection with Kingston Road. 6. The following matters were discussed prior to the regular meeting: a) The Town Manager reported on a proposal to lease an offset duplication from Gestetner Limited. b) The Town Manager reported that Mrs. Knapp in Claremont will be digging around her property to determine the source of water leaking into her basement and the Plumbing Inspector will be asked to be present when this job is being undertaken. c) Council directed staff to negotiate a lease with Mr. Arntz on Brock Road as indicated in the confidential memorandum of the Town Solicitor dated April 14, 1983. 9/83 - 45 - (VI) CONFIRMATION BY-LAW By-law Ntl~be.r_"1658/83 Councillor Cahill, seconded by Councillor Stoner moved for leave to introduce a By'-lawof' the" Town of PitRering to confirm the proceedih~sOf the'Còùíïcil of the,Corpòration of the Town ofPickeringâtT'Ls'fuë'e'ting held~ònthe April- , 18, 1983, and that same be now reàd a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
