LOST Recorded Vote: Yes: Councillor Cahill No: Councillors Arthurs, Kitchen, Mitchell, Robertson, Stoner and Mayor Anderson Resolution #104/82 Moved by Councillor Kitchen Seconded by Councillor Cahill Whereas, the Assessment Act, R.S.O. 1980, chapter 31, section 63(3), as amended, provides in part for the implementation of a process of assessment equalization where significant inequalities exist; and Whereas, it is apparent that such inequalities may exist in the existing assessments of properties within the Town of Pickering; and Whereas, it is deemed advisable to request a study to deter- mine if such inequalities actually exist and to demonstrate their magnitude prior to determining whether or not this Council shoùld request the Minister of Revenue to implement the assessment equalization process referred to; NOW THEREFORE, BE IT RESOLVED THAT: 1. The Town Clerk, on behalf of the Corporation of the Town of Pickering is hereby authorized and directed to request the Minister of Revenue to prepare a study of the various classes of property, i.e. residential and farm and commercial and industrial, to determine if assessment in- equalities exist and if so, to demonstrate their magnitude, and to present such study to this Council to enable it to determine whether or - 103 - 31/82 .-.- -"...~._--_...-.--_.- not to request the Minister of Revenue to imple- ment the assessment equalization process provided in section 63(3) of The Assessment Act. By-law Number 1595/82 To amend By-law Number 264/75 respecting the speed limit on Concession 3 Road from its west limit to Altona Road. By-law Number 1596/82 Being a By-law to authorize the execution of an Agreement between the Corporation of the Town of Pickering and G.D.S. Disposal to provide for the collection, removal and dis- posal of garbage from 1210 Radom Street, Pickering. By-law Number 1597/82 Being a by-law prescribing the form of Demolition Agreement which may be required to be entered into in the process of the issuance of building permits, and authorizing the execution thereof. By-law Number 1607/82 Being a By-law to authorize the execution of a transfer conveying Block C, Plan M-20, Pickering to The Regional Municipality of Durham (reserve, West Shore Boulevard/Bayly Street) THIRD READING Councillor Cahill, seconded by Councillor Stoner moved that the report of the Committee of the Whole on By-law Number 1594/82, 1595/82, 1596/82, 1597/82, 1598/82, 1599/82, 1600/82, 1601/82, 1602/82, 1603/82, 1604/82, 1605/82 and 1606/82 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. (IV) CONFIRMATION BY-LAW By-law Number #1608/82 Councillor Robertson, seconded by Councillor Stoner moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the December 20, 1982, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. SALE OF LAND IN AMBERLEA TO SEPARATE SCHOOL BOARD FILE NUMBER - D 3360 . ~- That the Town Manager be authorized to enter into negotiations with the Durham Region Roman Catholic Separate School Board with a view to selling a portion of Block C, Plan M-1057 for purposes of a separate school site; and that an agreement be entered iAto concern- ing the joint use of the remaining ~creage for school and public park purposes. . ~/ 2. AMENDMENT TO DEVELOPMENT PLAN FOR TOWN CENTRE COMMUNITY AS IT RELATES TO GREAT KAROO ENTERPRISES FILE NUMBER - B 2310 - A 9/82 That section lJ. Retail and Personal Service Commercial be added to page 3 of the Development Plan for the Town Centre Community - Main Central Area South: "J. Retail and Personal 'Service Commercial a) To provide a variety of shopping opportunities in the Main Central Area South, a range of retail and personal service commercial uses shall be permitted under this designation. . b) In order to minimize access pro- blems that may adversely affect traffic flow along Kingston Road and/or Liverpool Road, the Town may require applicants of devel- opment proposals in this area to provide any or all of the follow- ing information as part of their site plan submission. (i) a drawing showing an internal vehi~ular access system that considers all parcels of land within the area; ( it) the commercial uses proposed for the subject property and their locations; and (iit) the progressive phasing of the subject development if implementation is to occur in more than one phase. If it is not possible to implement the internal access system describ- ed above immediately upon develop- ment, temporary alternative access may be granted provided that traf- fic safety is not diminished and the implementation of the said internal system is not jeopard- ized. c) 5. AMENDMENT TO DEVELOPMENT PLAN .FOR TOWN CENTRE COMMUNITY AS IT RELATES TO GREAT KAROO ENTERPRISES FILE NUMBER - B 2310 - A 9/82 That Schedule A of the Development Plan for the Town Centre Community - Main Central be amended by designating certain lands west of Liverpool Road and south of Kingston Road as Retail and Personal Service Commercial, as shown on Appendix I to this memorandum. - 3 - 6. PROPOSED STORM SEWERS ON ROSEBANK ROAD TO BE CONSTRUCTED AS A LOCAL IMPROVEMENT FILE NUMBER - E 5300 That Resolution #74/82, Item #5 to approve the request made by petition to proceed with the installation of storm sewers to service lands on the west side of Rosebank ROàd South for a distance of 860 fee pursuant to the Local Improvement Act be rescinded. < < . 7. LEASE OF PICKERING CORPORATE CENTRE FROM J.D.S. INVESTMENT LTD. FILE NUMBER - D 3350 That the Town Solicitor be directed to advise J.D.S. Investments Limited of the Town's intent- ion to renew its existing lease on the Pickering Corporate Centre from January 1,1983 to Decemb- er 31, 1984. 8. 1983 CONTRACT WITH ONTARIO HUMANE SOCIETY FILE NUMBER - F 2300.15 That the 1983 municipal contract fees payable to the Ontario Humane Society in the amount. of $146,800.00 of which $55,358.00 shall be paid by the Town of Pickering as outlined in a report of the Clerk of the Town of Whitby dated December 6, 1982, be approved. 9. 1983 CONTRACT WITH ONTARIO HUMANE SOCIETY FILE NUMBER - F 2300.15 That the 1983 expenses for repairs and mainten- anceto the Animal Shelter in the amount of . $4,600.00 of which $1,535.00 shall be paid. to the Town of Pickering as outlined in the report of the Clerk of the Town of Whitby dated 'Dec:ember 6, 1982 be approved. . - 4 - 10. BRUNSWICK HILLS BAPTIST CEMETERY FILE NUMBER - F 2200 That the report of November 1,1982 from the Treasurer-Collector with respect to the Bruns- wick Hills Baptist Cemetery perpetual care funds be received; and that Council endorse the use of these funds for purposes of improving the cemetery. 11. REGIONAL SEWER RATE SUBSIDY FILE NUMBER - A 2260.07 That the report of the Treasurer-C~llector dated October 19, 1982 with respect to the 1983 Regional Sewer Rate for the Town of Pick- ering be adopted; and that the 1983 Sewer Commodity Rates and Service Charges for the Town of Pickering be set at 92.5% of the Region's uniform rates and charges; and further that the balance of the required revenue be secured by a charge to the Sewage Reserve Fund held by the Region on behalf of the Town of Pickering. 12.
