Marshall - Town Manager B. Taylor - Town Clerk ABSENT: Mayor Anderson - attending A.C.R.O. Convention (I) ADOPTION OF MINUTES Meeting of September 20, 1982 (II) 1. DELEGATION Mr. Murray Stroud, representing Mr. and Mrs. R.G. Dobbin, requested that By-law Number 1552/82 to stop up and close Old Trespass Road be deferred for two weeks. (III) RESOLUTIONS Resolution #81/82 - See Appendix #1 Moved by Councillor Fisher Seconded by Councillor Coburn That the Report of the Executive Committee dated September 27, 1982 be adopted with the following amendments: Item #3 be amended by adding the words "to the Community Facilities Development Reserve Fund" Item #6 be amended by adding the words "and other intersec- tions in the Town, particularly Fieldlight Boulevard and Glenanna Road." Item #8 be deferred for two weeks. CARRIED 26/82 - 104 - (II) RESOLUTIONS (cont'd.) Resolution #82/82 - See Appendix #2 Moved by Councillor Coburn Seconded by Councillor Stoner That the Report of the Planning Committee dated September 28, 1982 be adopted. CARRIED Resolution #83/82 Moved by Councillor Fisher Seconded by Councillor Byers That Mayor Anderson be authorized to proclaim the celebra- tion of Hallowe'en on Saturday, October 30, 1982. CARRIED Resolution #84/82 Moved by Councillor Cahill Seconded by Councillor Byers That Resolution 128/79, Item #11 which deals with the retention of Totten Sims, Hubicki as professional con- sultants be reconsidered. CARRIED Resolution #85/82 Moved by Councillor Cahill Seconded by Councillor Byers That Resolution #128/79, Item #11, be amended by deleting the second paragraph and substituting therefore the following: "and that staff be authorized to utilize the services of Simcoe Engineering Limited in road and related municipal construction projects as deemed necessary and provided for in existing budget allocation." By-law Number 1571/82 Being a Restricted Area By-law to amend Restricted Area By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham on Lot 10, Plan 432, in the Town of Pickering By-law Number 1572/82 Being a Restricted Area By-law to amend Restricted Area By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, on Part of Lot 18, Range 3, Broken Front Concession designated as Part 1, Plan 40R-1986, in the Town of Pickering By-law Number 1573/82 Being a Restricted Area By-law to amend By-law 1200/80, amend- ing Restricted Area By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham on Blocks E and F, Plan 239 and Part of St. Martin's Drive (Part 1, Plan 40R-590), in the Town of Pickering By-law Number 1574/82 Being a Restricted Area By-law to amend Restricted Area By-law 2520, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham on Part Block Y, Plan M-16 in the Town of Pickering By-law Number 1575/82 Being a by-law to amend By-law Number 264/75 to establish the speed limit on Bowler Drive THIRD READING Councillor Fisher, seconded by Councillor Stoner moved that the report of the Committee of the Whole on By-law Numbers 1562/82, 1563/82, 1564/82, 1565/82, 1566/82, 1567/82, 1568/82, 1569/82, 1570/82, 1571/82, 1572/82, 1573/82, 1574/82 and 1575/82 be adopted with the following amendment: By-law Number 1552/82 was deferred for two weeks and that the said by-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. 26/82 - 107 - (V) OTHER BUSINESS 1. Councillor Byers, with the concurrence of Council, requested that a registered letter be sent to the Eaglebrook Corporation stating that the fencing provisions of the subdivision agreement pertaining to Plan M-1185 be complied with on or before October 17, 1982 or their letter of credit will be drawn from in order to complete the required fencing. 2. Councillor Stoner requested that the Crossing Guard at the north end of the intersection of Brock Road and Concession 9 Road be requested to patrol the east end of the intersection as well. 3. Councillor Stoner stated that the Ontario Land Corporation will be selling its lands in North Pickering. The O.L.C. stated that it will take twenty years to dispose of this land and they do not intend to sell it back to those they expropri- ated it from. Councillor Stoner felt that the Town should be better informed by the O.L.C. as to its future plans and that they explain why they are able to increase the rents of their lessees by 20%. 4. The Town Manager reported that the costs of the Recreation Complex will be $863,000.00 over budget because of contingencies and the imposition of sales taxes on goods purchased by municipalities. (VI) CONFIRMATION BY-LAW By-law Number 1576/82 Councillor Fisher, seconded by Councillor Byers moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on October 4, 1982 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. Appendix #1 TOWN OF PICKERING The Executive Committee having met September 27, 1982 presents its sixteenth report to the Council of the Town of Pickering and recommends: 1. PER CAPITA GRANT TO UNITED WAY OF AJAX-PICKERING FILE NUMBER - F 2300 That provision be made in the 1983 budget for a per capita grant of 32~ for the year 1983 to the United Way of Ajax - Pickering; and that permission be granted to fly the United Way flag at the Municipal Offices during the campaign period. 2. TENDER FOR COLD MIX ASPHALT FILE NUMBER - C 4300 That Tender T-21-82 submitted by Standards Aggregates for cold mix asphalt in the amount of $9,174.00 delivered and $8,760.00 picked up, be approved. 3. TRANSFER OF EXCESS NON-RECURRING REVENUE FILE NUMBER - C 5000 That the amount of $300,000.00 be transferred from the General Fundin 1982 in the Community Facilities Development Reserve Fund. SALE OF THE CLOSED PORTION OF OLD TRESPASS ROAD FILE NUMBER - E 4410 WHEREAS the Council of the Corporation of the Town of Pickering has enacted By-law 1552/82 stopping-up certain portions of Old Trespass Road being those parts of Lots 33 and 34, Range 3, B.F.C., designated as Part 1, Plan 40R-6529 and Part 1, Plan 40R-6570; and WHEREAS the said Council has enacted By-law /82 offering the sale of the said lands to the owners of abutting lands at prices to be fixed by Council, as required by the provisions of section 316 of the Municipal Act, R.S.O. 1980m chapter 302; NOW THEREFORE BE IT RESOLVED THAT: a) The portion of Old Trespass Road closed by By-law 1552/82 and authorized for sale to owners of abutting lands by By-law /82 be offered to those owners at prices fixed according to the following Table: Owner of Property No. Abutting Land Fixed Price 1 Dobbin $ 6,000 2 Coughlan 4,000 3 M.T.R.C.A. 3,510 4 Mackay 16,000 5 Coughlan/Mackay 14,000 b) The property numbers set out in the Table to section 1, above, relate to those proper- ties illustrated on the sketch attached hereto as Appendix 1 to this Resolution. Item #8 was deferred for two weeks 9 PICKERING RINGETTE ASSOCIATION FILE NUMBER - F 2300 That the request of the Pickering Ringette Association dated September 23, 1982 to hold a garage sale on the parking lot of the East Shore Community Centre be approved. - 5 - 10. SNOW PLOWING AT CONDOMINIUM CORPORATION FILE NUMBER - E 4550 That Whereas pursuant to paragraph (ii) of subsection 62 of section 210 of the Municipal Act, by-laws may be passed by the councils of local municipalities for entering into agree- ments with a condominium corporation for clear- ing away and removing snow and ice from roads on the condominium property; Now Therefore staff be directed to report on the feasibility of plowing the snow from the internal roads at condominium corporations, said report to include the costs and grants or subsidies available for such an undertaking. 11. ACCOUNTS FOR APPROVAL FILE NUMBER - C 2310 That the accounts in the amount of $677,076.91 for the period ending September 15, 1982, as submitted by the Town Manager be approved. 12. GO TRANSIT SERVICE TO CLAREMONT AREA FILE NUMBER - F 4100 Whereas residents in the Claremont area of the Town of Pickering were served by the Toronto-Peterborough-Havelock commuter train; and Whereas this service has now been discontinued by the Federal Government, and Whereas there is a definite need for commuter service in the Claremont area, Now Therefore the Council of the Corporation of the Town of Pickering hereby requests that the Toronto Area Transit Operating Authority service the Claremont area aof the Town of Pickering with a GO transit bus service. 13. ;;~ ~\' - 6 - TEMPORARY CLOSING OF VALLEY FARM ROAD SOUTH OF KINGSTON ROAD FILE NUMBER - E 4410 That the request of J.D.S. Investments Limited dated September 23, 1982 to close that portion of Valley Farm Road south of Kingston Road between the hours of 6:00 p.m. and 6:00 a.m. and on weekends and holidays while the apart- ment buildings in the Town Centre are being constructed be approved.
