McKay - Council Secretary (I) ADOPTION OF MINUTES Meeting of January 6, 1986. (II) DELEGATION 1. Mr. Will Walker, representing Mr. T. Zanata addressed Council with respect to his draft plan of subdivision at the north end of Fawndale Road. He stated his client was in agreement with the amendments in the draft plan of subdivision. See Item #3 of Executive Committee Report (III)~RESOLUTION~S Resolution #5/86 - See Appendix I Moved by Councillor Robertson Seconded by Councillor Mitchell . That the Executive Committee Report dated January 13, 1986, be adopted with the following amendments; Item #3, Condition 6 was amended to read as follows: 6. a) that Lots 1-10, inclusive, shall not be developed unless satisfactory arrangements whereby the owner herein will share (in accordance with Town's existing policy on cost sharing) with the owner to the south, the costs of the li/ road upon which the lots front, and the services therein; b) that the owner, prior to registration of the plan, pay to the Town the sume of $4,800 cash in lieu of the construction of a storm sewer from the closest location thereon in Draft Plan 18T85004 to the northerly end of the Fawndale Road extension and deed Block 12 to the Town. Item #7, was withdrawn by the applicant. 2/86 Recorded Vote on Item #11: Yes: Councillors Brenner, Coburn, Mitchell, Stoner and Mayor Anderson No: Councillors Arthurs and Robertson CARRIED Resolution #6/86 Moved by Councillor Arthurs Seconded by Councillor Mitchell That Tender T-24-85 submitted by Ontario Truck Centre for the supply and delivery of one 4 wheel pick-up truck in the amount of $18,925.09, be approved. CARRIED Resolution #7/86 Moved by Councillor Stoner Seconded by Councillor Arthurs That the quotation for Poles, Fixtures and Lamps for the Esplanade Park submitted by Westburne Electric Supply Limited, in the amount of $44,050.00 plus Provincial Sales Tax be approved. CARRIED (IV) BY-LAWS Councillor Robertson, seconded by Councillor Stoner moved for leave to introduce By-laws of the Town of Pickering: By-law Number 2128/86 Being a By-law to amend By-law 1364/81 respecting prohibited turns. By-law Number 2129/86 Being a By-law to amend the Town of Pickering Municipal Code to adopt the 1986 estimates of all sums required during the year for the purposes of the Municipality of the Corporation of the Town of Pickering, and to provide for the levying of the rates resulting therefrom and to levy the rates necessary to cover the estimated 1986 levy from the Council of the Corporation of the Regional Municipality of Durham. By-law Number 2130/86 Being a by-law to amend the Town of Pickering Municipal Code to fix installment dates respecting the collection of taxes. 2/86 7 By-law Number 2131/86 Being a by-law to provide for interest to be added to tax arrears. By-law Number 2132/86 Being a by-law to establish a penalty for non-payment of current taxes. By-law Number 2133/86 Being a by-law to authorize the execution of an Agreement between the Corporation of the Town of Pickering and G.D.S. Disposal to provide for the collection, removal and disposal of garbage from 1210 Radom Street, Pickering, during 1986. By-law Number 2134/86 Being a by-law to exempt Lots 88, 95 and 96, Plan 40M-1333, Pickering from part lot control. By-law Number 2135/86 Being a by-law to amend By-law 911/78 designating certain highways within the Town of Pickering as through highways. By-law Number 2136/86 Being a by-law to amend By-law 506/76 to provide for the erection of "Stop" signs at certain intersections within the Town of Pickering. By-law Number 2137/86 Being a by-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lot 33, Range, B.F.C. in the Town of Pickering. (A16/83; 18T-830112) By-law Number 2138/86 Being a by-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lots 33 and 34, Range 3, B.F.C. in the Town of Pickering. (A 46/82; 18T-82038) THIRD READING Councillor Mitchell, seconded by Councillor Brenner moved that the report of the Committee of the Whole on By-law Numbers 2128/86, 2129/86, 2130/86, 2131/86, 2132/86, 2133/86, 2134/86, 2135/86, 2136/86, 2137/86, and 2138/86 be adopted, and that the said ,-laws be now read a Third Time and PASSED, and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 2/86 (V) OTHER BUSINESS 1. Mayor Anderson announced that Penwalt Pharmaceutical Corporation will be locating its head office in the Amberlea Industrial Park in the near future. 2. Councillor Mitchell warned of flooding dangers of creeks and watercourses. 3. Mayor Anderson asked what the status was of the Region of Durham's installation of traffic signals at the intersection of Finch Avenue and Brock Road. 4. Councillor Stoner stated that the Region of Durham approved the installation of traffic signals at the intersection of Finch Avenue and Brock Road and they are scheduled to be installed in January. 5. Councillor Arthurs asked that an investigation be made with respect to a trailer which is parked at the east end of Finch Avenue which prevents vehicles from turning. 6. Councillor Stoner asked that construction vehicles which are parked at Finch Avenue and Brock Road be investi- gated. (VI) CONFIRMATION BY-LAW By-law Number 2139/86 Councillor Mitchell, seconded by Councillor Stoner moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on January 20, 1986 and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. FLORESE ON THE EAST SIDE OF APPLEVIEW ROAD, SOUTH OF BONITA AVENUE FILE NUMBER - B 2310 - A 29/85 That Zoning By-law Amendment Application A 29/85 by Mr. George Dawe on behalf of the owners M. & G. Florese, to amend Zoning By-law 3036 to rezone the subject property from "R3" One-Family Detached Dwelling - Third Density Zone (minimum 18.0 metre lot frontage) to "R4" One-Family Detached Dwelling - Fourth Density Zone (minimum 15.0 metre lot frontage) be APPROVED. DRAFT PLAN OF SUBDIVISION AND ZONING AMENDMENT APPLICATION SUBMITTED BY T. ZANATA ON THE WEST SIDE OF ALTONA ROAD, SOUTH OF LITTLEFORD'S LANE FILE NUMBER - B 4100 - 18T-85019 FILE NUMBER - A 35/85 This Draft Plan of Subdivision 18T-85019, submitted by T. Zanata on lands being Part of Lot 33, B.F.C. Range 3, Town of Picketing be APPROVED AS REVISED, to permit development of 10 detached dwellings subject to the following conditions: 1. Changes in "red" as shown on the plan received July 23rd, 1985, stamped approved this date. 2. That the owner make satisfactory arrangements with the Town regarding the required parkland dedication. 3. That prior to final registration of this plan, the owner: a) satisfy the requirements of the Metropolitan TOronto and Region Conservation Authority and the Ministry of Natural Resources; b) submit a Draft 40M- Plan to be approved by the Town Planning Department; c) submit a detailed tree preservation programme to the satisfaction of the Town and agree that no trees be approved by the Town except as authorized by the Director of Parks and Recreation. 12. That prior to final registration of this plan, the owner: a) satisfy the Town's Director of Public Works regard- ing the provision of appropriate stormwater manage- ment facilities on the property; b) satisfy the Town with respect to necessary contri- butions to the required stormwater detention pond proposed downstream, east of Altona Road (Altona Detention Pond). 3 13. That development of those lands in the area of Lot 6 containing the existing watercourse be prohibited until such time as the existing watercourse is no longer required for stormwater management purposes as determined by the Director of Public Works. 14. That the owner satisfy the Town that the proposed retained portion of the owner's entire land holdings conform to the provisions of By-law 3036. Amended APPLICATION TO AMEND MINISTER'S ZONING ORDER SUBMITTED BY J. MCINNES, SOUTH OF THE 8TH CONCESSION, WEST OF THE CLAREMONT CONSERVATION AREA FILE NUMBER B 2310 18-Z0-0298511 (1) That the Ministry of Municipal Affairs be advised that the Town of Pickering has no objection to the approval of Minister's Zoning Order Amendment. Application 18-ZO-0298511(1) in Part Lot 13, Concession 7 to permit the establishment of a hobby farm and accessory detached residential dwelling and storage shed on a lot having an area of 5.61 hectares subject to the following conditions: 1. That any amending regulation respecting this application include building performance standards which conform to those required by the 'A' - Rural Agricultural Zone within the Town of Pickering Zoning By-law 3037 (including a provision requiring a minimum dwelling floor area of 139 square metres), 2. That the owner satisfy the Ministry of Municipal Affairs with respect to noise attenuation, 3. The owner satisfy the requirements of the Metropolitan Toronto and Region Conservation Authority prior to the issuance of a building permit. APPLICATION TO AMEND THE MINISTER'S ZONING ORDER SUBMITTED BY C. AND S. BOZANIS ON THE WEST SIDE OF SIDELINE 4, BETWEEN CONCESSION 8 AND 9 FILE NUMBER - B 2310 - 18-Z0-0298512~1) That the Ministry of Municipal Affairs be advised that the Town of Pickering has no objection to the approval of Minister's Zoning Order Amendment Application 18-ZO-0298512(1) submitted by C. & S. Bozanis to permit the construction of a detached residential dwelling unit on the subject lands, being Part of Lot 5, Concession 8, Town of Pickering, having a lot frontage of 152.4 metres and lot area of 6.16 hectares, subject to the following condition: 1. That any amending regulation respecting this application include building setback requirements which conform to those required by the Town of Pickering Zoning By-law 3037 (Section 6.2.1) for residential uses in an Agriculturtal Zone. 4 REQUEST FOR EXEMPTION FROM COUNCIL'S LAND SEVERANCE POLICY TO PERMIT DEVELOPMENT SUBMITTED BY A. MCCLYMENT FILE NUMBER - B 2300 That the request of A. McClyment for an exemption to Council's Land Severance Policy to permit the creation of four lots for detached residential dwellings to proceed by application for land severance through the Durham Land Division Committee on lands being Part 2, Plan 40R-8814 be APPROVED subject to the following condition: 1. That prior to application being made for consent to sever to the Durham Land Division Committee, the owner enter into an appropriate development agreement with and to the satisfaction of the Town of Pickering respecting: a) the dedication of a 20 m road allowance to the Town through the subject lands, b) required improvements of Brock Road across the total frontage of the subject lands, c) the payment of lot development fees. REZONING APPLICATION SUBMITTED BY LEXTON DEVELOPMENTS LTD. AND LUCKY DAY LTD. ON THE SOUTH SIDE OF KINGSTON ROAD, WEST OF LIVERPOOL ROAD FILE NUMBER - B 2310 - A15/85 That Zoning By-law Amendment Application A 15/85 submitted by Mr. W.R. Burton on behalf of Lexton Developments Limited and Lucky Day Limited on lands being Part of Lot 23, Concession 1, Town of Pickering, to amend Zoning By-law 3036 (as amended by By-laws 1680/83, 1727/83 and 2006/85), to eliminate Temporary Access Area C (as identified on Schedule 'A' to By-law 1727/83) and introduce one permanent vehicular access point be REFUSED. Withdrawn PROPOSED OFFICIAL PLAN AMENDMENT AND ZONING STRATEGY FOR GAS STATIONS IN SOUTH PICKERING FILE NUMBER - B 2300 That Town Council endorse and forward to Regional Council for approval, the proposed amendment to the Pickering District Plan dealing with gas stations, as outlined in Appendix I to Town Planning Report # 59/85. I5 I 9. PROPOSED OFFICIAL PLAN AMENDMENT AND ZONING STRATEGY FOR GAS STATIONS IN SOUTH PICKERING FILE NUMBER - B 2300 That Town Council request Planning Staff to bring forward appropriate amendments to the zoning by-laws to implement the zoning strategy on gas stations, as outlined in Appendix II to Town Planning Report # 59/85. 10. GRANT TO CLAREMONT WINTER CARNIVAL FILE NUMBER - F 3000 FILE NUMBER - C 2163 That a grant in the amount of $250.00 be provided to assist the 3rd Annual Claremont Winter Carnival in Claremont, Ontario from January 29th through to February 2nd 1986 inclusive; and that the said grant be charged to Account 2195/2112 (Grant to Organizations, Recreation) 11. FREE TRANSIT SERVICES FOR SENIOR CITIZENS AND HANDICAPPED PERSONS FILE NUMBER - F 4100 That Council approve free transit for senior citizens using Pickering Transit; and that an additional $3,500 be allocated to Account 2350-9950 (Fares). 12. PROPOSED SIDEWALK PROGRAM FOR 1986 FILE NUMBER - E 4000 That the report of the Director of Public Works dated December 20, 1985 with respect to the proposed 1986 sidewalk program be received. 13. PROPOSED SALE OF A PORTION OF THE ANIMAL SHELTER PROPERTY TO THE WHITBY HYDRO-ELECTRIC COMMISSION FILE NUMBER - F 2300.15 That the Council of the Town of Pickering endorses the sale of a portion of the animal shelter property to the Whitby Hydro-Electric Commission for the future use as a hydro substation site; and that the Treasurer of the Town of Whitby be authorized to negotiate the terms and conditions of the agreement of purchase and sale on behalf of the Town of Pickering.
