Melymuk - Manager, Policy and Information Division m (i) ADOPTION OF MINUTES Regular meeting of March 7, 1988. m(ii) DELEGATIONS 1. Mr. David McWhirter, 1502 Oberon Court, requested Council mto support Notice of Motion #3 because it is unfair of Canada Post to place the supermailboxes where they will detrimentally affect a resident and it is unfair for the mresidents of Pickering to pay for the tax loss as a result of the Ontario Municipal Board decision. 2. Mr. Murray Chusid, representing Pickering Square 1986 minc., stated that with respect to the proposed commercial site at the northeast corner of Valley Farm Road and Kingston Road, the staff does not support special purpose mor general retail uses, however, a market study has proven that these uses are viable. Traffic from the commercial site would have no adverse impact on Valley Farm Road or Kingston Road. He stated that he would mrecommend to his client that the be allowed public input to the site plans for the commercial site. m3. Dr. Mofeed Michael, representing the Durham Housing Corporation, stated that he supports the recommendations of the Executive Committee regarding the commercial site at Valley Farm Road and Kingston Road because it will provide for the development of non-profit housing to the north. He reviewed the mandate of the Durham Housing Corporation and gave examples of well-maintained mdevelopments in Oshawa. 4. Mr. Paul Woodcroft, representing the Adhod Association, mstated that he supports the proposal for non-profit housing. It will provide proper housing for handicapped and low income people and he stated that the Durham Housing Corporation builds quality projects which allow m the disadvantaged to live in dignity. m 9/88 (II) DELEGATIONS- (continued) 5. Rev. Ian Gray, representing the Social Planning Council and the Ajax-Picketing Ministerial Association, stated that the management of Durham Non-Profit Housing has been competent and there is no documentation to support the fact that property values of abutting lands are lowered because of such projects. Non-profit housing will enhance the quality of life in the community because it will provide for a greater cross section of people and will provide a pool of workers for new industries. At present, there is no control over illegal basement apartments and non-profit housing will help to alleviate this problem. 6. Mrs. Barbara Black stated that she has been resident of a Pickering for the past 26 years and can sympathize with the residents who have been opposing the non-profit housing because they are being asked to compromise. She felt that basement apartments proliferate because of a lack of subsidized housing. 7. Mary Stinson, Co-ordinator of the Food Bank, stated that the Food Bank started in January of 1988 and already there are 70 families in Ajax and Pickering that rely on this service. For many of these families, their rental costs are taking more than 60% of their income. 8. Mr. George Clement, 1907 Valley Farm Road, stated that basement apartments have been a part of the community for many years and statistics show that they are no more hazardous than any other type of dwelling unit. He stated that priority will be given to needy residents in the Region of Durham and not specifically in Picketing. He was concerned that future residents in the non-profit housing could be affected by the electromagnetic fields in the hydro right-of-way. 9. Mr. Rod Mason, 1748 Finch Avenue, stated that Scarborough has permitted strip development over the years and now realizes the problems this type of development causes. The Tridel development will provide a support for the Town Centre and because of this, no further strip commercial development is required Although the Town does require affordable housing it should not be at the expense of further commercial strip plazas. He stated that he was in favour of office uses on the subject lands but not retail uses. 10. Mr. Steve Tichener, representing the Glengrove Community Association, stated that he opposes the Official Plan amendment application to allow commercial uses at the northeast corner of Valley Farm Road and Kingston Road. He stated that the developer is using the non-profit housing issue to secure a commercial use at this location. The proposed non-profit housing will not el imi nate basement apartments because there i s no guarantee that Pickering residents will get priority to live in this project. By allowing half of the property to be used for commercial purposes, the Town is cutting back on the amount of land available for affordable housing. He was concerned that the Pickering Square Plaza was rezoned after it was built to allow further commercial uses and that the same situation could occur at this proposed plaza. He stated that if Council approves the application to permit commercial uses at the northeast corner of Valley Farm Road and Kingston Road, the zoning by-law will be referred to the Ontario Municipal Board and this delay could jeopardize the non-profit housing statement. m 9/88 (II) DELEGATIONS- (continued) m 11. Mr. George Martin, representing the Greenwood and Area Ratepayers Association, stated that he supports the estate residential policy because the area in and around Greenwood is environmentally sensitive and controls are needed. He felt that the restriction to limit estate residential housing to approximately 1% of the total housing stock is too ambiguous and is open to a wide interpretation. Estate residential lots should be two acres in size in order to properly accommodate a weeping m bed and an alternate weeping bed. Estate residential development should be constructed on an internal road in order to alleviate strip residential development on rural roads. The policy should be amended to state that estate m residential development shall take place on lands with a low agricultural use or capability. Mr. Martin stated that estate development should be strictly limited m because it puts demands on the farming community and the Town to provide urban services. m 12. Mr. Don Given, representing Bill Brown, stated that he supports the estate residential policy with the exception that the policy should have some flexibility to allow houses to front on existing roads where to do otherwise m the landscape may be damaged. He stated that each application for estate residential development should be judged on its merits wi th no reference to the 1% m restriction or a prohibition to construct houses on existing roads. (III) RESOLUTIONS Resolution #55/88 - See Appendix #1 Moved by Councillor Mitchell Seconded by Councillor Coburn That the Report of the Executive Committee dated March 14, 1988, be adopted with the following amendments: Item #7 was amended by deleting clause l(c) from Appendix I to Planning Report No. 12/88 which pertains to the number of estate residential lots which may be developed. Item #7 was further amended by deleting the word "agricultural" from clause l(e)(vi) in Appendix I to Planning Report No. 12/88 and adding to Section l(e) the following clause: "have low capability of use for agriculture, or are not actively being used for agricultural purposes." CARRIED Resolution #61/88 by Councillor Morgan Moved Seconded by Councillor Arthurs MOE MEETING WITH PACT FOR A CONSULTANT FILE NUMBER - A 2310.15 That Whereas the Corporation of the Town of Pickering entered into an agreement dated February 1970 with Metropolitan Toronto respecting the operation of the Brock West Landfill Site; and Whereas the agreement stipulates that Metropolitan Toronto shall create eight foot cells to be covered daily with a final finished cover of a minimum of four feet of soil; and Whereas the staff of Metropolitan Toronto have stated that twenty foot cells have been created with an advance face of one foot of soil cover and two feet of soil cover on top of the cells and a final soil cover of four feet when an area reaches its final contour; and Whereas on January 1, 1988 and January 9, 1988, P.A.C.T. witnessed no daily soil cover and they took core samples on subsequent days and showed only one inch to 12 inches of soil applied to cells; and 51 9/88 Resolution #61/88 - {continued) Whereas P.A.C.T. took core samples in an area that was finally covered and produced readings that showed a final cover of eight inches to twenty-six inches; and Whereas soil cover is required to control odour, moisture infiltration, seagulls, litter, insects and rodents; and Whereas the agreement states that no hazardous material shall be dumped at the Brock West Landfill Site; and Whereas P.A.C.T. observed readings at the said Landfill Site of 34 to 87 microrems per hour with a radiation metre; and Whereas Mr. Horgan of Metropolitan Toronto has confirmed that all vehicles entering the Brock West Landfill Site are not checked with a geiger counter for carrying radio-active hazardous materials; and Whereas representatives of the Ministry of Labour have recommended that the microrem readings are sufficiently high to warrant an investigation; and Whereas the Gas Reclaim System chosen by Metropolitan Toronto may not provide for the proper disposal of upper level, low quality gases as stated in a presentation to the Dump Metro Committee in 1987 and thus causing the transportation of toxic wastes through the municipality; Now Therefore the Council of the Corporation of the Town of Pickering hereby resolves that a meeting take place as soon as possible with the Minister of the Environment, Mr. Jim Bradley, to discuss the concerns expressed by P.A.C.T. and that a formal request be made at that time asking the Minister to allow the Town of Pickering to hire a Consultant to investigate the P.A.C.T. concerns; and that the costs of such a Consultant be paid for by the Ministry to ensure that the terms of the Agreement between Metropolitan Toronto and the Town of Pickering are being complied with; and that a copy of this resolution and P.A.C.T documentation be forwarded to the Honourable Jim Bradley, Minister of the Environment and Mrs. Norah Stoner, M.P.P. and that Mrs. Stoner be requested to be part of such a meeting with the Minister of the Environment; and that the P.A.C.T. documentation be forwarded to Mr. Bob Rae, Leader of the Official Opposition and Mr And ,. the Progressive Conservatiw D~ ..... Leader of comments. ~ rar~y ur un:arlo tor their perusal and CARRIED Resolution #62/88 Moved by Councillor Brenner Seconded by Councillor Arthurs LEGAL ACTION AGAINST CANADA POST AND SUPERMAILBOXES FILE NUMBER - A 2400 Whereas the Ontario Municipal Board has upheld the premise that supermailboxes are a nuisance to the abutting property owners thereby resulting in a 5% tax reduction; and 9/88 52 Resolution #62/88 - (continued) Whereas the Province of Ontario has implemented, based on the Ontario Municipal Board decision a 5% tax reduction for all homeowners abutting supermailboxes effective 1989; and Whereas the Treasurer-Collector for the Town of Pickerin9 has suggested major financial implications as a result of the decision in favour of this reduction; and Whereas Municipalities across the Province and other parts of Canada will suffer loss of revenue; Now therefore in order to recover all tax losses incurred because of the supermailboxes, staff or someone appointed by the municipality to represent the municipality are hereby directed to pursue legal action in Small Claims Court to recover the revenue that has been lost to date; and That this action be made against the Canadian Government and jointly the Canada Post Corporation; and That all municipalities within the Province of Ontario and across Canada be encouraged to initiate similar legal steps to recover lost revenue; and That a copy of this resolution be sent to the Association of Municipalities of Ontario and the Federation of Canadian Municipal ities. Councillor Arthurs requested that the site plans for the Pickering Civic Complex be reviewed by Council. 2. Councillor Arthurs inquired into the disposition of the quotation for the purchase of a new vehicle for the Director of Parks and Recreation. 3. Councillor Arthurs stated that the Firehall Location Study was tabled; however, since the trees were cut down on the firehall site on Finch Avenue it would appear that this site has been selected for a firehall. 4. Councillor Morgan thanked the Municipal Law Enforcement Officers for assisting the chi.ldren at the new school crossing at Finch Avenue and Forest Park Drive. 5. Councillor Mitchell commended Pickering Hydro for restoring power quickly in the Amberlea area due to an accident which occurred on March 20, 1988 at Finch Avenue and Fairport Road. m6. councillor Brenner requested, and the Council concurred that the following motion be considered: ' Resolution #63/88 Moved by Councillor Brenner m s econded by Councillor Mitchell STOP SIGN ON NEW STREET mFILE NUMBER - E 4000 That the Town Clerk be directed to prepare a by-law to authorize a stop on New Street facing northbound traffic.
