DELEGATIONS Michael Kerzner, on behalf of Old Forest Investments Ltd., addressed Council with respect to the rezoning application to increase the permitted percentage of gross floor area for sales outlet purposes on the east side of Brock Road, south of Bayly Street. He requested that the gross floor area for sales outlet purposes be increased to 40% and that automotive uses be deleted. See Item #2 of the Executive Committee Report 2. The following persons addressed Council with respect to By-law 3236/89 which prohibits heavy traffic on Westney Road on Saturdays and Sundays: (a) - Jack Armstrong, Solicitor, on behalf of Timbers Brothers, submi tted a report prepared by the Aggregate Producers' Association of Ontario and a letter on behalf of C. Bowden who does not support By-law 3232/89. He stated that he supports the 60 kph speed limit on Westney Road, that Timbers Brothers has contributed significantly to the maintenance of Westney Road, that the Timbers are suffering financial loss as a result of being unable to operate on Saturdays and requested that Council permit heavy traffic on Saturdays. See By-law 3302/89 (II) 19/89 176 DELEGATIONS - continued (b) Brian Buckles, Uxbridge, member of local conservation boards, stated that MTRCA has been acquiring lands in northwest Pickering and southwest Uxbri dge to preserve the uni que beauty of the area. He spoke in support of prohi bi ti ng heavy traffi c on Westney Road on Saturdays because hikers and walkers in the park woul d be di sturbed and because the pi t could be operating on most Saturdays. Dan Buller, 1962 Bowler Drive addressed Council with respect to the three hour parking regulation. He submitted a petition of residents objecting to the three hour parking and requested that 24 hour parking be permitted on one side only of Bowler Drive. '8 (c) (d) 3. . (III) Dr. John Polonyi, 5495 Westney Road, stated that the Townshi p of Uxbri dge has prohi bi ted heavy traffic on the west and north routes from Timbers Brothers pit and refused their request to increase the tonnage removed from the pi t. He added that the Westney Road and Concession 9 area is a rural residential area and a conservation park abuts the pit. He requested that Council continue to prohibit heavy traffic on Saturdays and Sundays. Ted Richardson, who resides on the Uxbridge/Pickering Townline Road in Uxbridge, spoke in support of prohi bi ti ng heavy trucks on Saturdays. RESOLUTIONS Resolution #226/89 - See Appendix #1 Moved by Councillor Mitchell Seconded by Councillor Johnson That the Report of the Executive Committee dated October 23, 1989 be adopted with the following amendments: Item #2 was tabled pending a report from staff on the appropriatness of permitting high intensity commercial uses at major intersections. 1. Item #3 was approved with the following conditions of approval: That prior to the forwarding of an implementing by-law to Council, the owner: 8 (i) (i i) receive site plan approval from the Town; enter into an appropriate site/development agreement with and to the satisfaction of the Town which shall include but not necessarily be limited to requirements respecting the upgrading of the Kingston Road frontage of the property to full urban standards; (iii) satisfy the Region of Durham Works Department respecting the provision of sanitary sewers to the subject property. 19/89 177 Resolution #226/89 - continued 2. That the implementing by-law: i) permit a law office as a permitted use in addition to residential uses presently permitted under By-law 3036; establish a building envelope which reflects the boundaries of the existing building on the lot; 8 ii) iii) limit the gross floor area of building to be used for law office purposes to 186 square metres, bei ng the current floor area of the existing building on the lot; establish a minimum 2.6 metre by 5.3 metre parking stall size requirement; iv) v) require a minimum of nine parking spaces to be provided on site. Councillor Morgan stated that the untidy property at Greenmount Street and Valley Farm Road should be investigated under the Property Standards By-law. CARRIED (b) Counci 11 or Morgan requested a report on the policy of satellite dishes on private property. Counci 11 or Morgan stated that garbage pick up is being done on both sides of the street contrary to the contract. (c) (d) Councillor Brenner suggested that all speed limits in school zones be reduced to 40 kph. (e) Councillor Brenner stated that the pick up of leaves was not completed. Councillor Johnson stated that the speed limit si gn at Brock Road and Forbrock Street has been knocked down. Councillor Johnson asked how wide Glengrove Road will be when construction is complete. Councillor Johnson stated that the Sign By-law shoul d be enforced on Sundays regardi ng si gns on Brock Road. Counci 11 or Johnson i nqui red into the fundi ng of the Kinsale Hamlet Study. Counci 1 supports the Pi ckeri ng Hydro-El ectri c Commission in lobbying the Federal Government to accept electricity as essential to daily life, like food and medical services and thus exempting it from the proposed tax; Council support the Municipal Electric Association and the Canadian Electrical Association in their strong opposition to the proposed tax; and 3.
