Arthurs COUNCIlLORS: M. Brenner D. Dickerson R. Johnson G. Martin B. Mitchell K. Van Kempen ALSO PRESENT: N. C. Marshall B. Taylor - Town Manager - Town Clerk (1) ADOPTION OF MINUTES Regular Meeting of August 8, 1991. (II) DELEGATIONS 1. Anita Witty, Campaign Chairman, Ajax/Pickering United Way, thanked Council for supporting a 5% increase in the Town's annual per capita grant to the United Way. In addition to raising money through grants and payroll deductions, there will be a number of special events to be held in each community. Despite the tough economic times, she has had a lot of support for her campaign. 2. Eileen Higdon, representing Save Our Bay Ad Hoc Committee, stated that her organization came into existence for the purpose of stopping the proposed townhouse development on the east side of the Bay. She has a petition with 7,000 signatures which also objects to this development. She supports the Notice of Motion to trade or acquire the subject lands because 65 acres cannot be built upon because it is environmentally significant but the balance of 5 acres that can be developed is also significant. All levels of government have stated that Frenchman's Bay and its shore area must be preserved. 3. Allen Stackhouse, representing Save Our Bay Ad Hoc Committee, stated that he supports the Notice of Motion to trade or acquire the lands in Part of Lot 24, Range 3 for which there is a development proposal. Much of the wetlands in southern Ontario have been lost and the problem of preserving what is left must be shared by all levels of government, bus inesses and the community. The Watershed Interim Report considers the subject lands as very environmentally important, they are a habitat for many animals and they provide a link to other sensitive areas. 4. 8 5. 6. 7. 8. 8 9. 10. tt 114 14/91 Bernie Luttmer, representing the Pickering East Shore Community Association, stated that he supports the Notice of Motion to trade or acquire the lands in Part of Lot 24, Range 3 for which there is a development proposal. He stated that green areas must be preserved and noted that the proposed development of the subject lands would cut of access to the Bay. Jacqueline Smart, 829 Fairview Avenue, stated that she supports the Notice of Motion to trade or acquire the lands in Part of Lot 24, Range 3 for which there is a development proposal. She stated that Council has missed opportunities in the past to acquire land to ensure preservation of sensitive areas and noted that if the Metropolitan Toronto and Region Conservation Authority were to purchase these lands, it would cost Pickering residents very little. Louise Dick, 824 Fairview Avenue, stated that the Crombie Commission noted that there is no comprehensive waterfront plan for the Town of Pickering. She is concerned that if the lands in Part of Lot 24, Range 3 is developed, that many animal habitats would be destroyed. Phil Frampton, 1810 Post Drive, representing the Taxpayers Coalition of Ontario, stated that his organization was established to make Councils aware of their fiscal responsibilities. He stated that Council has no obligation to help the owners of Part of Lot 24, Range 3 to achieve a profit from their lands. William McKechnie, 849 Fairview Avenue, stated that he supports the Notice of Motion to trade or acquire the lands in Part of Lot 24, Range 3, for which there is a development proposal. He opposes the development of these lands because it will destroy environmentally sensitive lands and growth in the area is already destroying many animal habitats. He noted that de:velepment of the subject lands would be a burden on present hard and soft services. Sonja Chang Poon stated that she development on the waterfront. The Town has acquired land in the past for the community's benefit and must acquire the subject lands now in ôrder to preserve the environment. The land must be negotiated on the basis of its present zoning and he noted that there may not be an adequate sewer allocation for this development. Mr. Kitchen also addressed Council with respect to the reconstruction of Liverpool Road and noted that the portion of Liverpool Road between Annland Street and Wharf Street were recently reconstructed and the road width is 28 feet. There is no reason to widen Liverpool Road to 32 in this area. 11. 8 12. 13. 8 14. 15. e 115 14/91 Lorne A1mack, representing the Pickering Rural Association, stated that he disagrees with that portion of the economic strategy report prepared by Coldwell/Banker that supports and airport in Pickering. He also noted that the Greater Toronto Area Airport Study Committee which also supports an airport in Pickering does not have the mandate of the Federal Ministry of Transport. A referendum on the airport would be improper because the Council has no authority in this matter, the question would be difficult to phrase and people are not adequately informed about the issue. The Ministry of Transport is presently carrying out an environmental assessment to determine if a third runway can be constructed at Pearson International Airport. Mr. Almack stated that he contacted a representative of the Canadian Air Transport Association who stated that he supports an expansion of Pearson International Airport but opposes the Pickering airport because it would be very expensive for the airlines. The development of the Pickering airport would be like Mirabel which was a failure and did not attract industry as planned. Any development of the airport lands would require a full environmental assessment and with the Duffin Creek running through the site, such an application would fail. Ann Ray, 1827 Post Drive, stated that the issue of consumer protection as it relates to the inspection of new houses has been before the Council since the mid 1980s. She stated that she and her fellow neighbours did not get Council's support in their appeal to the Registration Appeals Board. In order to protect future homeowners, she stated that she supports the Notice of Motion to enhance the enforcement of the Building Code. Patricia Lyons, 1990 Whites Road, Unit #73, stated that 38 children from her co-op development must attend the public school on Strouds Lands which is very long walk for such small children. The school board is not willing to provide a bus for these.children and she stressed that governments should not cut back on its expenditures at the expense of safety for children. Janice Perry, 1555 Finch Avenue, Unit #54, stated that children from her co-op development must cross Valley Farm Road at the times when it is very busy in order to get to school. Parked cars and the lack of a continuous sidewalk make for a potentially dangerous situation on Valley Farm Road. She requested that Council install a pedestrian crosswalk at the intersection of Valley Farm Road and Fieldlight Boulevard and the Valley Retirement Centre supports her request. Mr. Ken Walton, 1826 Forestview Drive, stated that he wants the staff of the Planning Department to study an alternate access for construction traffic to access the Lebovic subdivision. The traffic is now using Waterford Gate and is creating a dangerous situation of children, the equipment is noisy, the construction traffic creates dust and the heavy equipment is hard on the road. He noted that a temporary service road could be constructed from the Fram Homes, the planned extension of Pinegrove Avenue to Altona Road could proceed or traffic could use Pinegrove Avenue. Mr. Walton noted that originally, heavy traffic access to the Lebovic subdivision was to be from Woodview Avenue but this was later changed by Council. 8 8 . 116 14/91 (III) RESOLUTIONS Resolution #133/91 Moved by Councillor Van Kempen Seconded by Councillor Johnson That the Report of the Executive Committee dated September 9, 1991 be adopted with the following amendment: Item #2 was amended by deleting therefrom the entire recommendation and substituting therefor the following: IIThat the Director of Public Works be directed to proceed with the reconstruction of Liverpool Road by urbanizing that portion of Liverpool Road from Wharf Street southerly; and that the road width established at 32 feet; on this portion of Liverpool Road be and that this project proceed allocated for 1991 will permit," only far funds presently as as CARRIED Recorded Vote on Item #1: Yes: Councillors Dickerson, Martin, Mitchell, Van Kempen and Mayor Arthurs No: Councillors Brenner and Johnson Resolution #135/91 Moved by Councillor Van Kempen Seconded by Councillor Brenner That Tender T-16-9l submitted by Empire Paving Limited for asphalt pavement repairs in the amount of $102,399.00 be approved. CARRIED Resolution #136/91 Moved by Councillor Van Kempen Seconded by Councillor Mitchell Whereas the Town of Pickering has received an application to construct 39 townhouses on lands west of Fairview Avenue and known as Part Lot 24, Range 3 that abut Frenchman's Bay; and Whereas these lands should be acquired by the Metropolitan Toronto and Region Conservation Authority to be used for the enjoyment of the public and for the conservation of the Bay and the shore lands; and 117 14/91 Whereas by Resolution 195/90 passed on December 17, 1990, the Council of the Town of Pickering endorsed the Watershed Interim Report prepared by the Royal Commission on the Future of the Toronto Waterfront wherein it is stated that the Province should declare the waterfront from Burlington to Newcastle as a Provincial Resource; Whereas no landowner/taxpayer should be adversely affected by the acquisition of land by the Metropolitan Toronto and Region Conservation Authority; 8 Now Therefore the Council of the Corporation of the Town of Pickering hereby establishes a Committee comprised of Councillors Van Kempen and Mitchell, a representative of Save Our Bay Ad Hoc Committee and appropriate Town staff to meet with representatives of the applicant and the Metropolitan Toronto and Region Conservation Authority to discuss the feasibility of initiating a trade or acquisition of lands that will provide for the preservation of the lands in Part Lot 24, Range 3 and which may allow the applicant to develop on less sensitive lands. Moved by Councillor Mitchell Seconded by Councillor Van Kempen Whereas this Council and past Councils of the Town of Pickering have objected to the development of an airport in the northwest quadrant of the Town of Pickering; and Whereas the economic strategy report entitled "a Turning Point" prepared by Coldwell Banker for the Economic Development Task Force specifically mentions that an airport within the Town will be a major impetus to industrial and commercial development in the Town; and 118 14/91 Whereas the Greater Toronto Area Airport Study Committee has identified the Pickering airport lands as being an important component to an efficient air traffic system in the Greater Toronto Area; and Whereas the Council of the Town of Pickering should seek the input of all the residents of the Town of Pickering on such a major issue; 8 Now Therefore the Council of the Corporation of the Town of Pickering hereby directs that a question be put on the ballot of the 1991 Municipal Election asking the residents unbiased questions about various airport options. CARRIED Recorded Vote: 8 Yes: Councillor Dickerson, Mitchell, Van Kempen and Mayor Arthurs No: Councillors Brenner, Johnson and Martin Resolution #141/91 Moved by Councillor Brenner Seconded by Councillor Dickerson Whereas during the past several years, a number of issues have arisen pertaining to matters of Building Code violations resulting in a high level of frustration on the part of some residents who purchased new homes in the Town of Pickering; and Whereas in some instances, homeowners have been subj ected to both emotional and financial hardships as a direct result; Now Therefore the Council of the Corporation of the Town of Pickering hereby resolves that in an effort to protect the interest of present and future residents through the effective and efficient administration of the Building Code, 1. Town staff should bring forward an amendment to its Building By-law pursuant to its powers under Section 5(2) of the Building Code Act to prescribe time limits for the giving by builders to the Town's Chief Building Official of notices required by the Building Code, especially Section 2.4.5.1(1) thereof, (see Appendix "A"), - 8 - 8 119 14/91 2. The Director of Public Works should implement immediately a more formal and aggressive identification and follow-up of Building Code deficiencies (i. e . through the issuance of written Orders to Comply respecting any deficiencies identified at any inspection as well as through random but regular testing of a wider range of building materials and methods). CARRIED Recorded Vote: Yes: Brenner, Dickerson, Johnson, Martin, Mitchell, Van Kempen and Mayor Arthurs Resolution #142/91 Moved by Councillor Mitchell Seconded by Councillor Brenner Whereas motorists are seeking a shortcut to Whites Road and the ramp onto Highway 401 by travelling westbound on Bayly Street and making left turns onto West Shore Boulevard then using Oklahoma Drive to access Whites Road; and Whereas these motorists are interferring with the safe movement of pedestrians, particularly school children, and school buses; Now Therefore the Council of the Corporation of the Town of Pickering hereby requests the Regional Municipality of Durham to prohibit left turns for traffic travelling westbound on Bayly Street onto West Shore Boulevard between the hours of 7:00 a.m. and 9:00 a.m. Monday to Friday, buses and emergency vehicles excepted. Referred to the Region of Durham for its consideration Resolution #143/91 Moved by Councillor Mitchell Seconded by Councillor Brenner That Resolution #142/91 be amended by adding the words "and emergency vehicles" after the word "buses" in the last paragraph. CARRIED Resolution #144/91 Moved by Councillor Brenner Seconded by Councillor Dickerson That Resolution #142/91 be forwarded to the Regional Municipality of Durham for its consideration. CARRIED Resolution #145/91 Moved by Councillor Johnson Seconded by Councillor Martin Whereas the Town of Pickering will be incurring an over-expenditure of approximately $60,000.00 in 1991 to remove litter and debris from the roadsides; and 120 14/91 Whereas this problem has occurred because of the increased tipping fees at the Brock West Landfill Site and the charge to residents from Metro and Durham delivering garbage in a pick-up truck; and Whereas the extension of the life of the Brock West Landfill Site has led to an increase of traffic through the host municipality with no reimbursement whatsoever; 8 Now Therefore the Council of the Corporation of the Town of Pickering hereby requests that Metropolitan Toronto reimburse the Town of Pickering for the costs it has incurred in cleaning litter and debris from the roadsides. CARRIED Recorded Vote: Yes: Councillors Brenner, Dickerson, Johnson, Martin, Mitchell, Van Kempen and Mayor Arthurs Resolution #148/91 Moved by Councillor Brenner Seconded by Councillor Dickerson tÞ Whereas the Federal Government has adopted a "Buy Canadian" policy; and Whereas the Provincial Government Ontario" policy; and of Ontario has a similar "Buy 121 14/91 Whereas both senior levels of government have population to follow their respective leads; and encouraged the Whereas the Town of Pickering recognizes the need to develop policies that promote and support existing and future business both within the Region of Durham and the Town of Pickering; Be It Therefore Resolved that the Council of the Town of Pickering supports a policy which reflects a "Buy Durham" philosophy and forwards this motion to the Regional Chairman and Councillors of the Regional Municipality of Durham. 8 CARRIED Record Vote: Yes: Councillors Brenner, Dickerson, Johnson, Martin, Mitchell, Van Kempen and Mayor Arthurs Resolution #149/91 Moved by Councillor Brenner Seconded by Councillor Dickerson Whereas in view of possible safety risks being encountered by local children attending Highbush Public School who reside in communities near Finch Avenue and Whites Road; and Whereas these risks may be attributed to a 1.5 kilometre walk on a major arterial sidewalked roadway during peak rush hours; and Whereas at certain points these children are expected to cross major access points out of the Fox Hollow subdivision; and e Whereas the location of Finch Avenue and Whites Road is only 0.1 kilometre outside the Durham Board of Educations's rigid policy of 1.6 kilometres; Now Therefore be it resolved that for the safety of these children, the Council of the Corporation of the Town of Pickering hereby requests flexibility on the part of the Durham Board of Education's administrative policy on busing in order for these children to access an existing bus which services children to the north.
