HomeMy WebLinkAboutOctober 18, 1993 18/93 154 COUNCIL MINUTES A Meeting of the Pickering Town Council was held on Monday, October 18, 1993 at 7:50 p.m. PRESENT: Mayor Arthurs 8 COUNCILLORS : M. Brenner E. Higdon R. Johnson E. Pistritto K. Van Kempen D. Wellman ALSO PRESENT : C.M.T. Sheffield B. Taylor D. Kearns - Acting Town Manager - Town Clerk - Co-ordinator of Council Services (I) ADOPTION OF MINUTES Regular Meeting of October 4, 1993. Special Council Meeting of October 4, 1993. Special Council Meeting of October 12, 1993. 8 (II) DELEGATIONS Mayor Arthurs advised that a meeting was held with the solicitors concerning the Brock West Landfill Site and that this item has been deferred for one month. 1. The following persons addressed Council with respect to the Notice of Motion regarding the hiring policies of part-time firefighters. a) Colin Arnott, representing the Part-time Firefighters Association advised that there are 38 members in this association servicing the urban area, Brougham and Claremont. He stated that the system presently being followed is very good and questioned how someone in another municipality could enhance an already good system. b) Ken Matheson, 1869 Parks ide Drive advised that he sat on Council when By-law 771/78 was passed and that by-law has worked well for the past 15 years. He pointed out that there are no shortages of applications on file from Pickering qualified residents and that Council should be representing the interests of their residents not other municipal residents. The by-law becomes confusing when the boundaries outlined expand to Ajax and Uxbridge but not to Scarborough. He requested that Council defeat this motion and leave the present by-law in place. 8 lII) 8 8 2. 8 18/93 155 DELEGATIONS c) Elizabeth Quinn opposed any proposed change to the by-law stating that there is no need to change the policy concerning residency status as there is no shortage of applications from qualified residents. She requested that Council leave the present by-law in place and support the residents of Pickering. d) Brian Mitchell, 1003 Longbow Drive advised that he has been a part-time firefighter for twenty years. There are 200-300 applications on file at any given time from qualified Pickering residents. He questioned why firehall #2 and the Dixie/Finch firehall has been excluded from the by-law. He requested that council vote against this Notice of Motion. e) Bob Mitchell, 572 Stonebridge Lane advised that there are plenty of qualified residents with applications on file with the Town. The same residential policy is in place throughout the municipalities of Durham and should be left alone. Changing the present by-law could cause more human right violations and cause the Town to become vulnerable for more human rights challenges. f) Terry Nuspl, 140 Woodview Drive stated that the issue has always been discrimination concerning the residential policy. She advised that changing this by-law could cause challenges to the Human Rights Commission concerning residency and distance. She questioned the expansion to east and north but not west. She also advised that other municipalities within Durham have the same policy. The following persons addressed Council with respect to the Brock West Landfill Site. a) David Strain, representing PACT asked for a copy of the report from the Solicitor concerning the Brock West Landfill Site. He advised that there is the possibility for a conflict of interest when an outsider has been brought in and that it could be beneficial to the Town to work closely with PACT to hear and see the information which has been accumulated by them. It is PACT's, wish to see the Brock West Landfill Site closed and the Town to receive compensation for illegal expansion. b) David Steele, representing PACT advised that they have provided the Town with information and also could have information which the Town requires but use a lawyer to obtain. He stated that no E . P. A. hear ing took place, therefore, the expansion of this site was illegal. Metro has broken the contract with the Town of Pickering, therefore, legal action should be taken. 18/93 156 III) DELEGATIONS c) Dave Ryan, 1028 Rouge Valley Drive stated that he has addressed Council three times on this issue and that it has now been deferred again. PACT have worked many long hours and supplied Council with enough information. Council have been given an opportunity and the tools to take action against the Brock West Landfill Site. 8 (III ) RESOLUTIONS Resolution #206/93 - See Appendix #1 Moved by Councillor Johnson Seconded by Councillor Brenner That the Report of the Executive Committee meeting of October 4, 1993 be adopted. CARRIED Resolution #207/93 Moved by Councillor Brenner Seconded by Councillor Pistritto 8 Whereas, pursuant to section 4 of By-law 771/78, enacted March 6, 1978, any person who, c) if of good character; passes such aptitude and other tests as may be required by the Chief of the Department; is medically fit to be a part-time firefighter as certified by a duly qualified medical practitioner designated by the Chief of the Department; and is a resident of the Town of Pickering, a) b) d) is qualified to be appointed as a part-time firefighter in the Town's Fire Department; and Whereas the Council of The Corporation of the Town of Pickering wishes to provide that certain non-residents of the Town of Pickering may qualify to be appointed part-time firefighters in the Town's Fire Department; Now Therefore Be It Resolved That: 1. The Acting Town Manager is hereby directed to prepare an amendment to section 4 of By-law 771/78, the effect of which shall be to vary the qualifications for appointment of persons as part-time firefighters, ( a) by amending the residency requirement so that, 8 (i) where the part-time firefighter is to be assigned to Area 2, all residents of the Town of Pickering who live on or south of Durham Regional Road 4 may qualify; 18/93 157 tV} NOTICE OF MOTION - continued ( ii) where the part-time f iref ighter is to be assigned to Area 3, all residents of the Town of Pickering who live on or north of Durham Regional Road 4 may qualify, and all residents of the Town of Ajax who live within a 5 kilometre radius of Fire Hall 3 (Brougham) may qualify; 8 (iii ) where the part-time firefighter is to be assigned to Area 4, all residents of the Town of Pickering who live on or north of Durham Regional Road 4 may qualify, and all residents of the Township of Uxbridge who live within a 5 kilometre radius of Fire Hall 4 (Claremont) may qualify; and (iv) where the part-time firefighter is to be assigned to Area 5, all residents of the Town of Pickering who live on or south of Durham Regional Road 4 may qualify, and all residents of the Town of Ajax who live within a 5 kilometre radius of Fire Hall 5 (Brock/Bayly) may qualify; and (b) by adding a requirement that no person shall qualify who is a part-time or full-time member of any other municipality's Fire Department. 2. The Acting Town Manager is hereby further directed to prepare an amendment to sections 4 and 13 of By-law 771/78, the effect of which shall be to confirm the conditions of continued employment of persons as part-time firefighters by adding a provision that any part-time firefighter who fails to maintain any qualification for appointment as a part-time firefighter shall be dismissed without a hearing. 8 LOST Recorded Vote: Yes: No: Councillor Brenner and Mayor Arthurs Councillors Higdon, Johnson, Pistritto, Van Kempen and Wellman (IV) BY-LAWS Councillor Johnson seconded by Councillor Brenner leave to introduce by-laws of the Town of Pickering: moved for By-law Number 4327/93 8 Being a by-law to amend By-law 4095/92 stopping-up and closing Penny Lane, Plan M-997, Pickering, as public highway and authorizing the sale of parts thereof and of Block XH, Plan M-997, Pickering, to the abutting owners. 18/93 158 (IV) BY-LAWS Bv-Iaw Number 4328/93 Being a by-law to dedicate Block 89, Plan 40M-1526, Pickering, as public highway (Dellbrook Avenue). Bv-Iaw Number 4329/93 8 Being a by-law to authorize the execution of a Transfer of Part Block 19, Plan 40M-1649, Pickering, from The Corporation of the Town of Pickering to Maria Ciccone and Denis Walsh (Part 3, Plan 40R-15063¡ LD188/93) Bv-Iaw Number 4330/93 Being a by-law to appoint a By-law Enforcement Officer for certain purposes (Parking Regulation) : Ontario Condominium Corporation #2, Ontario Condominium corporation #11, Durham Condominium Corporation #58, Durham Condominium Corporation #51, Durham Condominium Corporation #19, Durham Condominium Corporation #52, Durham Condominium Corporation #60, Durham Condominium Corporation #42. THIRD READING Councillor Johnson, seconded by Councillor Brenner moved that the report of the Committee of the Whole on By-law Numbers 4327/93,4328/93,4329/93 and 4330/93 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 8 IV) OTHER BUSINESS 1. Councillor Pistritto, seconded by Councillor Brenner, introduced the following Notice of Motion: That the Confidential Report concerning the Brock West Landfill Site be shared with three PACT members and the lawyer for PACT. 2. Removal of landfill from the Brock North Landfill Site to the Brock West Landfill Site was discussed. Resolution #208/93 Moved by Councillor Brenner Seconded by Councillor Johnson For Leave to Introduce a motion concerning the removal of landfill from the Brock North Landfill Site to the Brock West Landfill Site. Pistritto, -<\~ IV) 8 8 3. 4. 5. 8 6. 18/93 159 OTHER BUSINESS Resolution #209/93 Moved by Councillor Brenner Seconded by Councillor Johnson That Council objects to the proposal of Metro Toronto to move landfill from the Brock North Landfill Site to the Brock West Landfill Site and be requested to defer this action and; That Metro and the Ministry of the Environment be so advised. CARRIED Recorded Vote: Yes: Councillors Brenner, Higdon, Johnson, Van Kempen, Wellman and Mayor Arthurs. Pistritto, The following motion was considered with the above Notice of Motion: conjunction in Resolution #210/93 Moved by Councillor Van Kempen Seconded by Councillor Wellman That the above Notice of Motion be deferred for two weeks. Councillor Brenner raised the issue concerning the report by the Acting Town Manager concerning the difficulties encountered at the Dixie/Finch firehall. He stated that this problems are causing a delay in the completion of the firehall. He questioned whether the Tender documents could be revised with respect to references. Councillor Johnson advised that he has received correspondence from the Town Clerk concerning traffic problems on Bushmill Street and Liverpool Road and he requested that this item be put on a future agenda. 10. Councillor Van Kempen advised that traffic problems due to the Pine Ridge Secondary School and parking problems due to the Maple Ridge Public School are being encountered. He requested a meeting be set up with both school boards along with Councillors Higdon, Pistritto, Johnson and himself. 11. Councillor Van Kempen advised that Tom Quinn, Director of Community Services and Facilities assured him that the new firehall will be ready to open on time. 12. Tim Sheffield advised Council of a report he received concerning removing landfill from the Brock North Landfill Site to the Brock West Landfill Site. 8 (VI) CONFIRMATION BY-LAW Bv-law Number 4331/93 Councillor Wellman, seconded by Councillor Van Kempen moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the corporation of the Town of Pickering at its meeting held on the 18th day of October, 1993 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
