Kearns Town Manager Town Clerk Co-ordinator of Council services ABSENT: Councillor Wellman - (Vacation) (I) ADOPTION OF MINUTES 8 Regular meeting of May 3, 1993. (II) DELEGA'l'IONS l. Nicholas Goldschmidt introduced Choral Festival to Council. the International 2. Fred Beer, representing the Pickering Rural Association addressed Council with respect to the sale of surplus airport lands. He thanked council for théir support of Planning Report 6/93. He stated that new homes would bring more children to already overcrowded schools. Care should be taken for those tenants who cannot afford to purchase. The Federal Government should not consider selling to the highest bidder. He suggested that the decision be deferred. 3. Rene Soetens, M.P., Ontario Riding addressed Council with respect to the sale of surplus airport lands. In 1987 the intention to sell lands was announced and in 1992 the Minister of Finance announced that the Federal Government was ready to proceed with the sale. At that time no objections to the sale were received. It was never the intent of the Federal Government to sell to the highest bidder but to give priority to long-term tenants or previous owners. He stated that as long as the lands are owned by the Federal Government, Pickering has no say over land use. The Town would be better served if these lands were taken over by the Town. e 9/93 75 (III) RESOLUTIONS Resolution #97193 - See ADoendix #1 Moved by Councillor Brenner Seconded by Councillor Van Kempen That the report of the Executive Committee meeting of May 10, 1993 be adopted with the following amendments: 8 Councillor Johnson declared an interest in Item #1 as he is a long-term tenant. Item #1 was deferred for two weeks. Item #3 was lost. Forsythe Haulage for the supply, delivery, and stockpiling of crushed gravel to various locations in the amount of $178,750.00 be approved. CARRIED Resolution #104/93 Moved by Councillor Van Kempen Seconded by Councillor Brenner 8 That the Tender T-211-93 submitted by Miller Paving Limited for the supply, delivery and application of liquid calcium chloride in the amount of $66,000.00 and that the Tender T-211-93 submitted by Canadian Protective Products for the supply and delivery of flake calcium chloride in the amount of $4,830.00 be approved. CARRIED Resolution #105193 Moved by Councillor pistritto Seconded by Councillor Johnson That Mayor Arthurs proclamations: be authorized to make the following "Anti-Dump Day in Pickering" - Saturday, May 29, 1993 June, 1993 - "Tourette Syndrome Awareness Month" June, 1993 - "The Joy of Singing Month" CARRIED 8 9/93 77 Resolution #106193 Moved by Councillor Higdon Seconded by Councillor Wellman WHEREAS the watercraft known as jet-skis are very noisy for persons who live near or wish to use Frenchman's Bay and its shoreline; and 8 WHEREAS the use of jet-skis and other motorized watercraft are detrimental to the delicate ecology of Frenchman's Bay in areas such as the wetlands and sand shores; and WHEREAS the use of jet-skis on Frenchman's Bay poses a hazard for the many boaters who use the Bay; NOW THEREFORE the Council of the corporation of the Town of Pickering hereby makes application to the Federal Government to amend the Boating Restriction Regulations to provide for a five knot or nine kilometers per hour speed limit for all motorized watercraft on Frenchman's Bay in order to provide for safe boating and to lower the noise level of motorized watercraft using Frenchman's Bay. Deferred for two weeks Resolution #107193 Moved by Councillor Van Kempen Seconded by Councillor Higdon 8 Whereas the Province of Ontario has set a goal to cut water consumption by 40% by 1996 through regulations in the Ontario Building Code; and Whereas any reduction in the amount of water consumed also provides for a reduction in the amount of water that is flushed into the storm and sanitary sewer systems;l and Whereas it is to the advantage of the Regional Municipality and the area municipalities to provide programs and measures to promote water conservation; Now Therefore the Council of the Corporation of the Town of Pickering hereby directs the Town Solicitor to work with the Director of Public Works to report on water conservation measures in all future subdivision agreements and report back to Council; and that the Regional Municipality of Durham be requested to promote retro-fitting of various plumbing devices such as toilets and shower heads as part of its water bills. (A 21/92; 18T-92017) By-law Number 4222/93 8 Being a by-law to amend the Town of Pickering Municipal Code to levy the rates necessary to cover the estimated 1993 levy from the Council of the Corporation of the Regional Municipality of Durham. By-law Number 4223/93 Being a by-law to amend the Town of Pickering Municipal Code to levy such rates against all of the assessed properties in the Town of Pickering as will be required to cover the 1993 requisitions from the Durham Board of Education and the Durham Region Roman Catholic school Board By-law Number 4224/93 Being a by-law to amend By-law 1562/82 temporarily closing roads for construction purposes (part Whites Road). By-law Number 4225/93 Being a by-law to amend By-law 3261/89 temporarily closing roads for recreational purposes (part Concession 5 Road - "Whitevale Road" . By-law Number 4226/93 8 Being a by-law to dedicate Block 91, Plan 40M-1512, Pickering, as public highway (Strathmore Crescent). 9/93 80 THIRD READING Councillor Johnson, seconded by Councillor Brenner, moved that the report of the Committee of the Whole on By-law Numbers 4221/93, 4222/93, 4223/93, 4224/93, 4225/93 and 4226/93 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED 8 (V) OTHER BUSINESS 1. Mayor Arthurs congratulated Councillor Higdon, the staff and the community for their work on the Storm Drain Marking Program. 2. Councillor Higdon stated that this week is Public Works Week and that the Storm Drain Marking Project is being undertaken by numerous groups throughout the Town. The objectives of the Project are: l) to protect the fish, 2) to eliminate hazardous chemicals being poured down the storm drains, 3) what to do with hazardous chemicals and 4) inform the public that pouring hazardous chemical down the storm drain is a criminal offence. 3. Councillor Higdon stated that the issue of ski-jets on Frenchman's Bay will be discussed on June 6th and that a letter had been received from the Durham Police stating their support through enforcement of the speed limit of ski-jets on the Bay. .8 4. Councillor Johnson advised that on June 2, 1993 Regional Council will be ratifying the tender for the widening of Liverpool Road from Glenanna Road to Finch Avenue. 5. Councillor Johnson advised that he will be attending the opening of the Goodwill Store in the Brockville Plaza on Thursday, May 20,1993. 6. Councillor Johnson advised that he attended the world's largest trade show and visted many composting facilities and landfill sites throughout Germany with numerous other government officials from the G.T.A. A slide presentation will be made to Council in the near future of this trip. 7. Councillor Brenner advised that he will be bringing forward a Notice of Motion to have Pickering host a partnership forum, which would include the C.E.O.'s and C.A.O's within the Durham Region municipalities, in an effort to seek out ways of becoming more cost effective in various operational matters in response to the recent Provincial Government cut-backs. 8. The following matters regular meeting: were considered prior to the 48 a) Councillor Van Kempen questioned the legality of heritage signs being erected in Whitevale. 9/93 81 (V) OTHER BUSINESS b) Councillor Van Kempen questioned the time-frame of comments concerning the Mayor and Councillor's job descriptions. c) Councillor Higdon advised that her motion concerning ski-jets on Frenchman's Bay will be deferred for three weeks. 8 d) Councillor Pistritto asked the Ward 2 Councillors if they had received complaints concerning vehicles being towed from the I.G.A. Plaza. e) Councillor Johnson advised that he would be making a slide presentation to Council concerning his trip to Germany, along with 15 other Canadian representatives, to visit the world's largest trade show, composting facilities and landfill sites. (VI) CONFIRlfATION BY-LAW By-law Number 4227/93 Councillor Johnson, seconded by Councillor Brenner moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 17th day May, 1993 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the corporation be thereto affixed. 8 CARRIED (VII) ADJOURliIfENT. '/ '../' /' .....------... ~' L--/ June 7th 1993 Dated 8 APPENDIX #1 TOf11I OF PICKBRING That the Executive Committee of the Town of Pickering having met on May 10, 1993, presents its eighth report to Council and recommends: LANDS DISPOSAL OF SURPLUS AIRPORT TRANSPORT CANADA PICKERING LAND PROJECT FILE NUMBER - B 1000 1. 8 1. That Town Council advise the Honourable Jean Corbeil, Federal Minister of Transport, tha tit does not support the sale of any surplus airport lands until a decision is made as to whether or not an airport will be built in Pickering; and if so, when, what size, and what type of facility. 2. 8 3. That should the Minister decide not to defer the sale of any surplus airport lands until a decision is made regarding the development of an airport in Pickering, the following matters be given serious consideration: (a) that no surplus lands be sold in the area immediately north of Highway 7, between Seaton and the non-surplus federal lands, until a decision is made on the Interim Waste Authority's site EE4, a final alignment of Highway 407 is confirmed, and a land use plan for the provincial Seaton lands is prepared; (b) that no surplus lands be sold within or immediately adjacent to the Town's existing rural settlements of Altona, Brougham and Claremont until new land use plans for these settlements have been prepared, and additional public land requirements have been determined; (c) that wherever possible, the remaining surplus lands be consolidated and sold for agricultural or open space purposes (the sale of surplus lands for non-farm residential purposes should be discouraged except where existing non-farm dwellings cannot be reorganized into viable farming units); and (d) that prior to the federal government selling any property, the Town is assured that the lands, premises and uses thereon conform to the provisions of all municipal by-laws that would become applicable once the land is sol d . That a copy of Town Planning Report 6/93 be forwarded to Mr. D.J. That Town Council requests the Ministry of Municipal Affairs and the Region of Durham to allow further discussion between local, regional and provincial staff prior to determining final positions on the proposed modifications to the 1991 Durham Regional Official Plan; 2. That Town Planning staff be authorized to participate in these discussions, using Planning Report No.7 /93 as a basis for the discussion, with particular emphasis on the following topics identified through review of the Ministry's post-circulation comments: (a) time horizons of Regional and official plans; (b) population and employment targets; (c) intensity of development; (d) establishing and expanding urban boundaries; (e) rural policies; (f) transportation; (g) the Rouge-Duffins corridor; (h) Seaton; (i) Pickering airport lands; and (j) level of detail in the Plan; local area 3. That, in addition to any other modifications to the 1991 Durham Regional Plan that may be needed, Town Council requests the incl usion of the following modifications resulting from the recent provincial announcement respecting an "agricultural preserve" in Pickering: (a) redesignate Special Study Area 1 Permanent Agricultural Reserve; and to (b) realign the urban area follow the Canadian Pacific between Whites Road and Creek; boundary to Railway line the Duffins 4. That the Town Clerk be requested to forward a copy of Planning Report No. 7/93 to the Region of Durham, the area municipalities, and the Ministry of Municipal Affairs. WINTER CONTROL PROGRAM FILE NUMBER - E 1000 That the Winter Control Program as outlined in Public Works Report to Council dated April 22, 1993 be adopted.
